| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 4102, Insurance Code, is |

| 11 | 11 | | amended by adding Section 4102.007 to read as follows: |

| 12 | 12 | | Sec. 4102.007. RIGHT TO CONTRACT WITH LICENSE HOLDER. (a) |
|---|
| 13 | 13 | | An insured has the right to enter into a contract with a license |
|---|
| 14 | 14 | | holder to help the insured meet the insured's obligations under the |
|---|
| 15 | 15 | | insured's insurance policy. An insurance policy issued in this |
|---|
| 16 | 16 | | state may not impede or prohibit this right. |
|---|
| 17 | 17 | | (b) An insured is not required to enter into a contract |
|---|
| 18 | 18 | | described by Subsection (a). |

| 19 | 19 | | SECTION 2. Section 4102.007, Insurance Code, as added by |
|---|
| 20 | 20 | | this Act, applies only to an insurance policy delivered, issued for |
|---|
| 21 | 21 | | delivery, or renewed on or after January 1, 2024. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
