55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to prohibiting the imposition of a monetary fine or
88 penalty for a violation of a money services business's terms of
99 service agreement; providing a civil penalty.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) This section takes effect only if the Act of
1212 the 88th Legislature, Regular Session, 2023, relating to the
1313 regulation of money services businesses, does not become law.
1414 (b) Subchapter E, Chapter 151, Finance Code, is amended by
1515 adding Section 151.406 to read as follows:
1616 Sec. 151.406. PROHIBITION ON IMPOSITION OF FINE OR PENALTY
1717 FOR TERMS OF SERVICE VIOLATION. (a) A money transmission license
1818 holder may not include in the license holder's terms of service
1919 agreement a provision allowing or providing for a monetary fine or
2020 penalty for violating any provision of the terms of service
2121 agreement.
2222 (b) This section may not be construed to prevent a money
2323 transmission license holder from closing a customer account as a
2424 result of a customer's violation of the license holder's terms of
2525 service agreement.
2626 (c) In addition to any other relief provided for a violation
2727 of this chapter, a money transmission license holder that violates
2828 this section is liable to this state for a civil penalty in an
2929 amount equal to three times the amount of the fine or penalty
3030 imposed by the license holder.
3131 (d) The attorney general may bring an action in the name of
3232 the state to recover the civil penalty under Subsection (c). The
3333 attorney general may recover attorney's fees and costs incurred in
3434 bringing an action under Subsection (c).
3535 SECTION 2. (a) This section takes effect only if the Act of
3636 the 88th Legislature, Regular Session, 2023, relating to the
3737 regulation of money services businesses, becomes law.
3838 (b) Subchapter G, Chapter 152, Finance Code, is amended by
3939 adding Section 152.305 to read as follows:
4040 Sec. 152.305. PROHIBITION ON IMPOSITION OF FINE OR PENALTY
4141 FOR TERMS OF SERVICE VIOLATION. (a) A money transmission
4242 licensee may not include in the licensee's terms of service
4343 agreement a provision allowing or providing for a monetary fine or
4444 penalty for violating any provision of the terms of service
4545 agreement.
4646 (b) This section may not be construed to prevent a money
4747 transmission licensee from closing a customer account as a result
4848 of a customer's violation of the licensee's terms of service
4949 agreement.
5050 (c) In addition to any other relief provided for a violation
5151 of this chapter, a money transmission licensee that violates this
5252 section is liable to this state for a civil penalty in an amount
5353 equal to three times the amount of the fine or penalty imposed by
5454 the licensee.
5555 (d) The attorney general may bring an action in the name of
5656 the state to recover the civil penalty under Subsection (c). The
5757 attorney general may recover attorney's fees and costs incurred in
5858 bringing an action under Subsection (c).
5959 SECTION 3. This Act applies only to a terms of service
6060 agreement entered into after the effective date of this Act. A
6161 terms of service agreement entered into before the effective date
6262 of this Act is governed by the law as it existed immediately before
6363 the effective date of this Act, and the former law is continued in
6464 effect for that purpose.
6565 SECTION 4. This Act takes effect September 1, 2023.
