8 | 8 | | amounts under the Medicaid vendor drug program. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 32.0462, Human Resources Code, is |
---|
11 | 11 | | amended by adding Subsection (a-1) to read as follows: |

12 | 12 | | (a-1) In determining the usual and customary price of a |
---|
13 | 13 | | prescription drug for purposes of determining the reimbursement |
---|
14 | 14 | | amount for that drug under Subsection (a)(1), the commission shall |
---|
15 | 15 | | exclude any discount price offered for the prescription drug, |
---|
16 | 16 | | including a discount offered through a third-party discount card. |
---|
17 | 17 | | SECTION 2. If before implementing any provision of this Act |
---|
18 | 18 | | a state agency determines that a waiver or authorization from a |
---|
19 | 19 | | federal agency is necessary for implementation of that provision, |
---|
20 | 20 | | the agency affected by the provision shall request the waiver or |
---|
21 | 21 | | authorization and may delay implementing that provision until the |
---|
22 | 22 | | waiver or authorization is granted. |
---|
23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
