66 AN ACT
77 relating to the determination of prescription drug reimbursement
88 amounts under the Medicaid vendor drug program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 32.0462, Human Resources Code, is
1111 amended by adding Subsection (a-1) to read as follows:
1212 (a-1) In determining the usual and customary price of a
1313 prescription drug for purposes of determining the reimbursement
1414 amount for that drug under Subsection (a)(1), the commission shall
1515 exclude any discount price offered for the prescription drug,
1616 including a discount offered through a third-party discount card.
1717 SECTION 2. If before implementing any provision of this Act
1818 a state agency determines that a waiver or authorization from a
1919 federal agency is necessary for implementation of that provision,
2020 the agency affected by the provision shall request the waiver or
2121 authorization and may delay implementing that provision until the
2222 waiver or authorization is granted.
2323 SECTION 3. This Act takes effect September 1, 2023.
