| 7 | 7 | | relating to certain student records required on a child's |
|---|
| 8 | 8 | | enrollment in a public school or on a child's transfer from one |
|---|
| 9 | 9 | | school district to another school district. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 25.002(a), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (a) If a parent or other person with legal control of a child |
|---|
| 14 | 14 | | under a court order enrolls the child in a public school, the parent |
|---|
| 15 | 15 | | or other person or the school district in which the child most |
|---|
| 16 | 16 | | recently attended school shall furnish to the school district: |
|---|
| 17 | 17 | | (1) the child's birth certificate or another document |
|---|
| 18 | 18 | | suitable as proof of the child's identity; |
|---|
| 19 | 19 | | (2) a copy of the child's records from the school the |
|---|
| 20 | 20 | | child most recently attended if the child has been previously |
|---|
| 21 | 21 | | enrolled in a school in this state or another state, including for a |
|---|
| 22 | 22 | | child who most recently attended a public school in this state, a |
|---|
| 23 | 23 | | copy of the child's disciplinary record and any threat assessment |
|---|
| 24 | 24 | | involving the child's behavior conducted under Section 37.115; and |
|---|
| 25 | 25 | | (3) a record showing that the child has the |
|---|
| 26 | 26 | | immunizations as required under Section 38.001, in the case of a |
|---|
| 27 | 27 | | child required under that section to be immunized, proof as |
|---|
| 28 | 28 | | required by that section showing that the child is not required to |
|---|
| 29 | 29 | | be immunized, or proof that the child is entitled to provisional |
|---|
| 30 | 30 | | admission under that section and under rules adopted under that |
|---|
| 31 | 31 | | section. |

| 32 | 32 | | SECTION 2. Section 25.036, Education Code, is amended by |
|---|
| 33 | 33 | | adding Subsection (c) to read as follows: |
|---|
| 34 | 34 | | (c) In the case of a transfer under this section, a child's |
|---|
| 35 | 35 | | school district of residence shall provide the receiving district |
|---|
| 36 | 36 | | with the child's disciplinary record and any threat assessment |
|---|
| 37 | 37 | | involving the child's behavior conducted under Section 37.115. |
|---|
| 38 | 38 | | SECTION 3. This Act applies beginning with the 2023-2024 |
|---|
| 39 | 39 | | school year. |
|---|
| 40 | 40 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2023. |
