55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a review by a local law enforcement agency of a school
88 district's multihazard emergency operations plan.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.2071, Education Code, is amended by
1111 adding Subsections (a-1), (h-1), and (h-2) to read as follows:
1212 (a-1) Before submitting a multihazard emergency operations
1313 plan to the center at the center's request under Subsection (b), a
1414 school district shall request provisional feedback from the center
1515 regarding the plan. The school district shall make adjustments to
1616 its plan as necessary.
1717 (h-1) After approval of a plan by the center under this
1818 section, a school district shall submit its plan to an appropriate
1919 local law enforcement agency for review and to provide suggestions
2020 on the plan.
2121 (h-2) For purposes of Subsection (h-1), an appropriate
2222 local law enforcement agency includes:
2323 (1) a school district police department, if the
2424 district employs and commissions peace officers;
2525 (2) the police department of a municipality in which
2626 the district is located; and
2727 (3) the sheriff of the county in which the district is
2828 located.
2929 SECTION 2. This Act applies beginning with the 2023-2024
3030 school year.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2023.
