55 relating to the hearings officer of the Texas Department of

77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 11.202(b), Finance Code, is amended to
99 read as follows:
1010 (b) The Texas Department of Banking may employ a hearings
1111 officer to serve the finance agencies as determined by interagency
1212 agreement. For the purposes of Section 2003.021, Government Code,
1313 a hearings officer employed under this section may be retained
1414 under contract to provide services on a part-time basis and is
1515 considered to be an employee of each agency for which hearing
1616 services are provided. The hearings officer's only duty under the
1717 hearings officer's contract is to preside over matters related to
1818 contested cases before a finance agency.
1919 SECTION 2. This Act takes effect immediately if it receives
2020 a vote of two-thirds of all the members elected to each house, as
2121 provided by Section 39, Article III, Texas Constitution. If this
2222 Act does not receive the vote necessary for immediate effect, this
2323 Act takes effect September 1, 2023.
