| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 11.202(b), Finance Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | (b) The Texas Department of Banking may employ a hearings |
|---|
| 11 | 11 | | officer to serve the finance agencies as determined by interagency |
|---|
| 12 | 12 | | agreement. For the purposes of Section 2003.021, Government Code, |
|---|
| 13 | 13 | | a hearings officer employed under this section may be retained |
|---|
| 14 | 14 | | under contract to provide services on a part-time basis and is |
|---|
| 15 | 15 | | considered to be an employee of each agency for which hearing |
|---|
| 16 | 16 | | services are provided. The hearings officer's only duty under the |
|---|
| 17 | 17 | | hearings officer's contract is to preside over matters related to |
|---|
| 18 | 18 | | contested cases before a finance agency. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2023. |
