6	6		relating to the preservation of Fairfield Lake State Park; granting
7	7		the power of eminent domain.
8	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9		SECTION 1. Subchapter Q, Chapter 22, Parks and Wildlife
10	10		Code, is amended by adding Section 22.230 to read as follows:
11	11		SUBCHAPTER Q: FAIRFIELD LAKE STATE PARK
12		-	Sec. 22.230. PRESERVATION OF FAIRFIELD LAKE STATE ~~PARK.~~
13		-	(a) The legislature finds that:

	13	+	PARK. (a) The legislature finds that:
14	14		(1) in the year of the centennial celebration of Texas
15		-	State Parks, the state has a vested ~~interest~~ in preserving and
	15	+	State Parks, the state has a vested interested in preserving and
16	16		protecting state parks operated by Parks and Wildlife Department;
17	17		(2) the state of Texas and the Parks and Wildlife
18	18		Department have invested over $70 million in the development and
19	19		operation of Fairfield Lake State Park.
20	20		(b) the department has the power of eminent domain to
21	21		acquire in the manner provided by Chapter 21, Property Code, any
22	22		property necessary to preserve Fairfield Lake State Park, and to
23	23		carry out the purposes of this section, including the acquisition
24	24		of approximately 1,821.353 acres and the adjoining acres associated
25	25		with that property.
26	26		SECTION 2. This Act takes effect immediately if it receives
27	27		a vote of two-thirds of all the members elected to each house, as
28	28		provided by Section 39, Article III, Texas Constitution. If this
29	29		Act does not receive the vote necessary for immediate effect, this
30	30		Act takes effect September 1, 2023.
