| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 64.012(b), Election Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (b) An offense under this section is a felony of the second |
|---|
| 12 | 12 | | degree unless the person is convicted of an attempt. In that case, |
|---|
| 13 | 13 | | the offense is a state jail felony [Class A misdemeanor]. |
|---|
| 14 | 14 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 15 | 15 | | an offense committed on or after the effective date of this Act. An |
|---|
| 16 | 16 | | offense committed before the effective date of this Act is governed |
|---|
| 17 | 17 | | by the law in effect when the offense was committed, and the former |
|---|
| 18 | 18 | | law is continued in effect for that purpose. For purposes of this |
|---|
| 19 | 19 | | section, an offense was committed before the effective date of this |
|---|
| 20 | 20 | | Act if any element of the offense occurred before that date. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 22 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 24 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 25 | | Act takes effect September 1, 2023. |
