88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 181.005(b) and (c), Election Code, are
1010 amended to read as follows:
1111 (b) A political party is entitled to have the names of its
1212 nominees placed on the ballot, without qualifying under Subsection
1313 (a), in each subsequent general election following a general
1414 election in which the party had a nominee for a statewide office who
1515 received a number of votes equal to at least 10 [five] percent of
1616 the total number of votes received by all candidates for that
1717 office.
1818 (c) A political party is entitled to have the names of its
1919 nominees placed on the general election ballot, without qualifying
2020 under Subsection (a) or (b), if the party had a nominee for a
2121 statewide office who received a number of votes equal to at least 10
2222 [two] percent of the total number of votes received by all
2323 candidates for that office at least once in the five previous
2424 general elections.
2525 SECTION 2. This Act takes effect September 1, 2023.
