| 7 | 7 | | relating to public school system accountability. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 39A.111, Education Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 39A.111. CONTINUED UNACCEPTABLE PERFORMANCE RATING. |
|---|
| 12 | 12 | | If a campus is considered to have an unacceptable performance |
|---|
| 13 | 13 | | rating for five consecutive school years the commissioner, subject |
|---|
| 14 | 14 | | to Section 39A.112, may [shall] order: |
|---|
| 15 | 15 | | (1) appointment of a board of managers to govern the |
|---|
| 16 | 16 | | school district as provided by Section 39A.202; [or] |
|---|
| 17 | 17 | | (2) closure of the campus; or[.] |
|---|
| 18 | 18 | | (3) any action authorized under Section 39A.002. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect on the 91st day after the last day of the |
|---|
| 24 | 24 | | legislative session. |
