55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to allowing parents and guardians to elect for a student to
88 repeat or retake a course or grade.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.02124, Education Code, is amended by
1111 amending Subsection (a) and adding Subsections (a-1) and (a-2) to
1212 read as follows:
1313 (a) Subject to Subsection (c), a parent or guardian may
1414 elect for a student to:
1515 (1) repeat prekindergarten;
1616 (2) enroll in prekindergarten, if the student would
1717 have been eligible to enroll in prekindergarten during the previous
1818 school year under Section 29.153(b) and the student has not yet
1919 enrolled in kindergarten;
2020 (3) repeat kindergarten;
2121 (4) enroll in kindergarten, if the student would have
2222 been eligible to enroll in kindergarten in the previous school year
2323 and has not yet enrolled in first grade; or
2424 (5) for grades one through eight [three], repeat the
2525 grade in which the student was enrolled during the previous school
2626 year.
2727 (a-1) Subject to Subsection (c), for courses taken for high
2828 school credit, a parent or guardian may elect for a student to
2929 repeat any course in which the student was enrolled in during the
3030 previous school year. A parent or guardian may not elect for a
3131 student to repeat a course under this subsection if the school
3232 district or open-enrollment charter school determines the student
3333 has met all of the requirements for graduation.
3434 (a-2) A parent or guardian may make an election under
3535 Subsection (a)(5) or (a-1), or both.
3636 SECTION 2. This Act applies beginning with the 2023-2024
3737 school year.
3838 SECTION 3. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2023.
