| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 11.0171, Parks and Wildlife Code, is |
|---|
| 11 | 11 | | amended by adding Subsection (c) to read as follows: |
|---|
| 12 | 12 | | (c) If the executive director or the executive director's |
|---|
| 13 | 13 | | designee does not receive any responsive bids on a competitive |
|---|
| 14 | 14 | | solicitation for goods or services, the executive director or the |
|---|
| 15 | 15 | | executive director's designee after making a written determination |
|---|
| 16 | 16 | | that competition is not available may negotiate with and award the |
|---|
| 17 | 17 | | contract to any qualified vendor who meets the requirements of the |
|---|
| 18 | 18 | | original solicitation. |
|---|
| 19 | 19 | | SECTION 2. Section 11.0171(c), Parks and Wildlife Code, as |
|---|
| 20 | 20 | | added by this Act, applies only to a contract for which bids are |
|---|
| 21 | 21 | | first solicited on or after the effective date of this Act. A |
|---|
| 22 | 22 | | contract for which bids are first solicited before the effective |
|---|
| 23 | 23 | | date of this Act is governed by the law as it existed immediately |
|---|
| 24 | 24 | | before the effective date of this Act, and that law is continued in |
|---|
| 25 | 25 | | effect for that purpose. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2023. |
