66 relating to the authorization of distributors to provide malt
77 beverage products to retailers for authorized sampling purposes.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 102.02, Alcoholic Beverage Code, is
1010 amended to read as follows:
1111 Sec. 102.02. PROVIDING SAMPLES. Notwithstanding any other
1212 provision of this code, the holder of a wholesaler's or
1313 distributor's permit or the holder's agent, representative, or
1414 employee may furnish or give a sample of liquor or malt beverages to
1515 a holder of a permit authorizing the sale of that category of
1616 alcoholic beverage at retail if the retail permittee has not
1717 previously purchased that brand from that wholesaler or distributor
1818 permittee. The wholesaler or distributor may give the retail
1919 permittee not more than 750 milliliters of any brand of distilled
2020 spirits, not more than three liters of any brand of wine in that
2121 package, and not more than one six pack72 ounces of any other
2222 alcoholic beverage so packaged. The retail permittee or the
2323 permittee's agent, servant, or employee may sample the product on
2424 the licensed premises only if the wholesaler or distributor the
2525 wholesaler's or distributor's agent, servant, or employee is
2626 present.
2727 SECTION 2. This Act takes effect September 1, 2023.
