| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 102.02, Alcoholic Beverage Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | Sec. 102.02. PROVIDING SAMPLES. Notwithstanding any other |
|---|
| 12 | 12 | | provision of this code, the holder of a wholesaler's or |
|---|
| 13 | 13 | | distributor's permit or the holder's agent, representative, or |
|---|
| 14 | 14 | | employee may furnish or give a sample of liquor or malt beverages to |
|---|
| 15 | 15 | | a holder of a permit authorizing the sale of that category of |
|---|
| 16 | 16 | | alcoholic beverage at retail if the retail permittee has not |
|---|
| 17 | 17 | | previously purchased that brand from that wholesaler or distributor |
|---|
| 18 | 18 | | permittee. The wholesaler or distributor may give the retail |
|---|
| 19 | 19 | | permittee not more than 750 milliliters of any brand of distilled |
|---|
| 20 | 20 | | spirits, not more than three liters of any brand of wine in that |
|---|
| 21 | 21 | | package, and not more than one six pack72 ounces of any other |
|---|
| 22 | 22 | | alcoholic beverage so packaged. The retail permittee or the |
|---|
| 23 | 23 | | permittee's agent, servant, or employee may sample the product on |
|---|
| 24 | 24 | | the licensed premises only if the wholesaler or distributor the |
|---|
| 25 | 25 | | wholesaler's or distributor's agent, servant, or employee is |
|---|
| 26 | 26 | | present. |

| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2023. |
