77 relating to the direct reimbursement of certain employers under the
88 Skills Development Fund.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 303.003(b-1), Labor Code, is amended to
1111 read as follows:
1212 (b-1) The commission by rule may establish and develop
1313 additional job incentive programs that use the skills development
1414 fund to create incentives for public community and technical
1515 colleges in partnership with one or more employers, including
1616 prospective employers who commit to establishing a place of
1717 business in this state, to provide workforce training in an effort
1818 to create and retain employment opportunities in this state. Under
1919 a program established under this subsection, the commission may
2020 commit money to a prospective employer described by this subsection
2121 contingent on the employer's establishment of a place of business
2222 in this state. The rules must provide a procedure under which a
2323 prospective employer described by this subsection may seek and
2424 obtain direct reimbursement from the skills development fund for
2525 costs incurred by the employer in relation to training provided to
2626 new employees on the employer's demonstration that the training is
2727 proprietary and protected by trademark, patent, or copyright. The
2828 rules must provide that the employer may be reimbursed for each new
2929 employee receiving the proprietary training.
3030 SECTION 2. This Act takes effect September 1, 2023.
