66 AN ACT
77 relating to the establishment of the case assistance affiliate
88 program to provide certain assistance to Medicaid recipients and
99 child health plan program enrollees.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 531, Government Code, is amended by
1212 adding Subchapter T to read as follows:
1313 SUBCHAPTER T. CASE ASSISTANCE AFFILIATE PROGRAM
1414 Sec. 531.801. DEFINITIONS. In this subchapter:
1515 (1) "Case assistance affiliate" means a managed care
1616 organization or dental maintenance organization that participates
1717 in the program by assisting Medicaid recipients and child health
1818 plan program enrollees by providing application and renewal
1919 assistance and benefit case management services.
2020 (2) "Case assistant" means an employee of a case
2121 assistance affiliate who directly provides application and renewal
2222 assistance and benefit case management services to a recipient or
2323 enrollee.
2424 (3) "Enrollee" means an individual enrolled in the
2525 child health plan program.
2626 (4) "Program" means the case assistance affiliate
2727 program established under this subchapter.
2828 (5) "Program manager" means the employee of a case
2929 assistance affiliate who is designated by the affiliate to oversee:
3030 (A) case assistants; and
3131 (B) the application and renewal assistance
3232 activities and benefit case management services provided by the
3333 affiliate under the program.
3434 (6) "Recipient" means a Medicaid recipient.
3535 (7) "Virtual case assistance website" means an
3636 Internet website described by Section 531.803.
3737 Sec. 531.802. ESTABLISHMENT OF CASE ASSISTANCE AFFILIATE
3838 PROGRAM. (a) The commission shall:
3939 (1) establish a statewide case assistance affiliate
4040 program under which managed care organizations and dental
4141 maintenance organizations that participate in Medicaid or the child
4242 health plan program are allowed to operate as case assistance
4343 affiliates by maintaining virtual case assistance websites; and
4444 (2) provide a training and certification process for
4545 program managers and case assistants providing services under the
4646 program.
4747 (b) In establishing the program, the commission:
4848 (1) shall consult with:
4949 (A) experts, as determined by the commission; and
5050 (B) other interested persons, including managed
5151 care organizations and dental maintenance organizations
5252 participating in Medicaid or the child health plan program; and
5353 (2) may establish a work group or advisory committee
5454 that includes interested persons to advise the commission on the
5555 establishment of the program.
5656 Sec. 531.803. VIRTUAL CASE ASSISTANCE WEBSITES. (a) A case
5757 assistance affiliate shall establish and maintain Internet
5858 websites for purposes of providing virtual application and renewal
5959 assistance and benefit case management services to the recipients
6060 and enrollees served by those organizations.
6161 (b) In providing benefit case management services, a case
6262 assistance affiliate may use its virtual case assistance website to
6363 assist a recipient or enrollee with applying for and managing the
6464 recipient's or enrollee's benefits under other public assistance
6565 programs, including nutritional and financial assistance benefits.
6666 (c) The commission shall ensure that a virtual case
6767 assistance website allows a recipient or enrollee to access the
6868 website from any electronic device that provides Internet access.
6969 Sec. 531.804. ADMINISTRATIVE EXPENSE. The commission shall
7070 allow a case assistance affiliate to categorize the services the
7171 affiliate provides under the program as administrative expenses.
7272 Sec. 531.805. RULES: PROGRAM REQUIREMENTS AND STANDARDS.
7373 The executive commissioner shall adopt rules necessary to implement
7474 the program, including rules:
7575 (1) establishing requirements for a managed care
7676 organization or dental maintenance organization to participate in
7777 the program;
7878 (2) establishing the training and certification
7979 process required by Section 531.802(a)(2);
8080 (3) providing for the suspension, revocation, and, as
8181 appropriate, periodic renewal of a case assistant's or program
8282 manager's certification;
8383 (4) protecting the confidentiality of recipients' and
8484 enrollees' information; and
8585 (5) establishing any other standards or requirements
8686 the executive commissioner determines necessary.
8787 SECTION 2. If before implementing any provision of this Act
8888 a state agency determines that a waiver or authorization from a
8989 federal agency is necessary for implementation of that provision,
9090 the agency affected by the provision shall request the waiver or
9191 authorization and may delay implementing that provision until the
9292 waiver or authorization is granted.
9393 SECTION 3. This Act takes effect immediately if it receives
9494 a vote of two-thirds of all the members elected to each house, as
9595 provided by Section 39, Article III, Texas Constitution. If this
9696 Act does not receive the vote necessary for immediate effect, this
9797 Act takes effect September 1, 2023.
