77 relating to an annual report regarding certain newborn screening
88 tests.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 33, Health and Safety
1111 Code, is amended by adding Section 33.020 to read as follows:
1212 Sec. 33.020. ANNUAL REPORT. (a) For each newborn screening
1313 test that screens for a disorder included in the list of core
1414 conditions described by Section 33.011(a-1) that is not required by
1515 the department, the department shall, not later than September 1 of
1616 each year, prepare and submit a written report to the governor, the
1717 lieutenant governor, the speaker of the house of representatives,
1818 and each standing committee of the legislature having primary
1919 jurisdiction over the department. The written report must:
2020 (1) identify any additional program capacity or
2121 resources the department would need to:
2222 (A) implement the additional newborn screening
2323 test; and
2424 (B) require each newborn in the state to receive
2525 the additional newborn screening test; and
2626 (2) summarize the plan for implementing and requiring
2727 the additional newborn screening test, including by identifying:
2828 (A) any potential barriers to implementation;
2929 and
3030 (B) the anticipated implementation date.
3131 (b) As part of the plan described by Subsection (a)(2), the
3232 report must include information on whether the department is
3333 capable of implementing the required additional newborn screening
3434 test within a 24-month period.
3535 SECTION 2. Section 33.054, Health and Safety Code, is
3636 repealed.
3737 SECTION 3. This Act takes effect September 1, 2023.
