| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 33, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 33.020 to read as follows: |
|---|
| 12 | 12 | | Sec. 33.020. ANNUAL REPORT. (a) For each newborn screening |
|---|
| 13 | 13 | | test that screens for a disorder included in the list of core |
|---|
| 14 | 14 | | conditions described by Section 33.011(a-1) that is not required by |
|---|
| 15 | 15 | | the department, the department shall, not later than September 1 of |
|---|
| 16 | 16 | | each year, prepare and submit a written report to the governor, the |
|---|
| 17 | 17 | | lieutenant governor, the speaker of the house of representatives, |
|---|
| 18 | 18 | | and each standing committee of the legislature having primary |
|---|
| 19 | 19 | | jurisdiction over the department. The written report must: |
|---|
| 20 | 20 | | (1) identify any additional program capacity or |
|---|
| 21 | 21 | | resources the department would need to: |
|---|
| 22 | 22 | | (A) implement the additional newborn screening |
|---|
| 23 | 23 | | test; and |
|---|
| 24 | 24 | | (B) require each newborn in the state to receive |
|---|
| 25 | 25 | | the additional newborn screening test; and |
|---|
| 26 | 26 | | (2) summarize the plan for implementing and requiring |
|---|
| 27 | 27 | | the additional newborn screening test, including by identifying: |
|---|
| 28 | 28 | | (A) any potential barriers to implementation; |
|---|
| 29 | 29 | | and |
|---|
| 30 | 30 | | (B) the anticipated implementation date. |
|---|
| 31 | 31 | | (b) As part of the plan described by Subsection (a)(2), the |
|---|
| 32 | 32 | | report must include information on whether the department is |
|---|
| 33 | 33 | | capable of implementing the required additional newborn screening |
|---|
| 34 | 34 | | test within a 24-month period. |
|---|
| 35 | 35 | | SECTION 2. Section 33.054, Health and Safety Code, is |
|---|
| 36 | 36 | | repealed. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2023. |
