66 AN ACT
77 relating to peace officers commissioned by the Health and Human
88 Services Commission's office of inspector general.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 2.12, Code of Criminal Procedure, is
1111 amended to read as follows:
1212 Art. 2.12. WHO ARE PEACE OFFICERS. The following are peace
1313 officers:
1414 (1) sheriffs, their deputies, and those reserve
1515 deputies who hold a permanent peace officer license issued under
1616 Chapter 1701, Occupations Code;
1717 (2) constables, deputy constables, and those reserve
1818 deputy constables who hold a permanent peace officer license issued
1919 under Chapter 1701, Occupations Code;
2020 (3) marshals or police officers of an incorporated
2121 city, town, or village, and those reserve municipal police officers
2222 who hold a permanent peace officer license issued under Chapter
2323 1701, Occupations Code;
2424 (4) rangers, officers, and members of the reserve
2525 officer corps commissioned by the Public Safety Commission and the
2626 Director of the Department of Public Safety;
2727 (5) investigators of the district attorneys', criminal
2828 district attorneys', and county attorneys' offices;
2929 (6) law enforcement agents of the Texas Alcoholic
3030 Beverage Commission;
3131 (7) each member of an arson investigating unit
3232 commissioned by a city, a county, or the state;
3333 (8) officers commissioned under Section 37.081,
3434 Education Code, or Subchapter E, Chapter 51, Education Code;
3535 (9) officers commissioned by the General Services
3636 Commission;
3737 (10) law enforcement officers commissioned by the
3838 Parks and Wildlife Commission;
3939 (11) officers commissioned under Chapter 23,
4040 Transportation Code;
4141 (12) municipal park and recreational patrolmen and
4242 security officers;
4343 (13) security officers and investigators commissioned
4444 as peace officers by the comptroller;
4545 (14) officers commissioned by a water control and
4646 improvement district under Section 49.216, Water Code;
4747 (15) officers commissioned by a board of trustees
4848 under Chapter 54, Transportation Code;
4949 (16) investigators commissioned by the Texas Medical
5050 Board;
5151 (17) officers commissioned by:
5252 (A) the board of managers of the Dallas County
5353 Hospital District, the Tarrant County Hospital District, the Bexar
5454 County Hospital District, or the El Paso County Hospital District
5555 under Section 281.057, Health and Safety Code;
5656 (B) the board of directors of the Ector County
5757 Hospital District under Section 1024.117, Special District Local
5858 Laws Code;
5959 (C) the board of directors of the Midland County
6060 Hospital District of Midland County, Texas, under Section 1061.121,
6161 Special District Local Laws Code; and
6262 (D) the board of hospital managers of the Lubbock
6363 County Hospital District of Lubbock County, Texas, under Section
6464 1053.113, Special District Local Laws Code;
6565 (18) county park rangers commissioned under
6666 Subchapter E, Chapter 351, Local Government Code;
6767 (19) investigators employed by the Texas Racing
6868 Commission;
6969 (20) officers commissioned under Chapter 554,
7070 Occupations Code;
7171 (21) officers commissioned by the governing body of a
7272 metropolitan rapid transit authority under Section 451.108,
7373 Transportation Code, or by a regional transportation authority
7474 under Section 452.110, Transportation Code;
7575 (22) investigators commissioned by the attorney
7676 general under Section 402.009, Government Code;
7777 (23) security officers and investigators commissioned
7878 as peace officers under Chapter 466, Government Code;
7979 (24) officers appointed by an appellate court under
8080 Subchapter F, Chapter 53, Government Code;
8181 (25) officers commissioned by the state fire marshal
8282 under Chapter 417, Government Code;
8383 (26) an investigator commissioned by the commissioner
8484 of insurance under Section 701.104, Insurance Code;
8585 (27) apprehension specialists and inspectors general
8686 commissioned by the Texas Juvenile Justice Department as officers
8787 under Sections 242.102 and 243.052, Human Resources Code;
8888 (28) officers appointed by the inspector general of
8989 the Texas Department of Criminal Justice under Section 493.019,
9090 Government Code;
9191 (29) investigators commissioned by the Texas
9292 Commission on Law Enforcement under Section 1701.160, Occupations
9393 Code;
9494 (30) commission investigators commissioned by the
9595 Texas Private Security Board under Section 1702.061, Occupations
9696 Code;
9797 (31) the fire marshal and any officers, inspectors, or
9898 investigators commissioned by an emergency services district under
9999 Chapter 775, Health and Safety Code;
100100 (32) officers commissioned by the State Board of
101101 Dental Examiners under Section 254.013, Occupations Code, subject
102102 to the limitations imposed by that section;
103103 (33) investigators commissioned by the Texas Juvenile
104104 Justice Department as officers under Section 221.011, Human
105105 Resources Code; [and]
106106 (34) the fire marshal and any related officers,
107107 inspectors, or investigators commissioned by a county under
108108 Subchapter B, Chapter 352, Local Government Code; and
109109 (35) commissioned officers employed by the Health and
110110 Human Services Commission's office of inspector general.
111111 SECTION 2. Section 531.1022, Government Code, is amended by
112112 amending Subsections (a), (b), and (d) and adding Subsections (b-1)
113113 and (e) to read as follows:
114114 (a) The commission's office of inspector general shall
115115 employ and commission [not more than five] peace officers [at any
116116 given time] for the purpose of assisting the office in carrying out
117117 the office's duties [of the office] relating to:
118118 (1) assisting a state or local law enforcement agency
119119 in the investigation of an alleged criminal offense involving:
120120 (A) a state hospital patient; or
121121 (B) a state supported living center client or
122122 resident; and
123123 (2) the investigation of fraud, waste, and abuse
124124 under:
125125 (A) [in] Medicaid; or
126126 (B) the supplemental nutrition assistance
127127 program under Chapter 33, Human Resources Code.
128128 (b) Peace officers employed under this section to
129129 investigate fraud, waste, and abuse under Medicaid:
130130 (1) may not exceed five in number at any given time;
131131 and
132132 (2) are administratively attached to the Department of
133133 Public Safety.
134134 (b-1) The commission shall provide administrative support
135135 to the Department of Public Safety as [department] necessary to
136136 support peace officer assignments [the assignment of peace officers
137137 employed] under Subsection (b)(2) [this section].
138138 (d) The commission's office of inspector general [A peace
139139 officer employed and commissioned under this section] shall obtain
140140 prior approval from the office of the attorney general before a
141141 peace officer employed under Subsection (b) carries [carrying] out
142142 any duties requiring peace officer status.
143143 (e) The commission's office of inspector general shall
144144 ensure a peace officer employed under this section is compensated
145145 according to Schedule C of the position classification salary
146146 schedule prescribed by the General Appropriations Act.
147147 SECTION 3. Section 659.301(5), Government Code, is amended
148148 to read as follows:
149149 (5) "State employee" means an individual who:
150150 (A) is a commissioned law enforcement officer of
151151 the Department of Public Safety, the Texas Facilities Commission,
152152 the Texas Alcoholic Beverage Commission, the Texas Department of
153153 Criminal Justice, the attorney general, [or] the insurance fraud
154154 unit of the Texas Department of Insurance, or the Health and Human
155155 Services Commission's office of inspector general;
156156 (B) is a commissioned security officer of the
157157 comptroller;
158158 (C) is a law enforcement officer commissioned by
159159 the Parks and Wildlife Commission;
160160 (D) is a commissioned peace officer of an
161161 institution of higher education;
162162 (E) is an employee or official of the Board of
163163 Pardons and Paroles or the parole division of the Texas Department
164164 of Criminal Justice if the employee or official has routine direct
165165 contact with inmates of any penal or correctional institution or
166166 with administratively released prisoners subject to the board's
167167 jurisdiction;
168168 (F) has been certified to the Employees
169169 Retirement System of Texas under Section 815.505 as having begun
170170 employment as a law enforcement officer or custodial officer,
171171 unless the individual has been certified to the system as having
172172 ceased employment as a law enforcement officer or custodial
173173 officer;
174174 (G) before May 29, 1987, received hazardous duty
175175 pay based on the terms of any state law if the individual holds a
176176 position designated under that law as eligible for the pay; or
177177 (H) is a security officer employed by the Texas
178178 Military Department.
179179 SECTION 4. Section 661.918(a), Government Code, is amended
180180 to read as follows:
181181 (a) This section applies to a peace officer under Article
182182 2.12, Code of Criminal Procedure, who is commissioned as a law
183183 enforcement officer or agent, including a ranger, by:
184184 (1) the Public Safety Commission and the director of
185185 the Department of Public Safety;
186186 (2) the Parks and Wildlife Commission;
187187 (3) the Texas Alcoholic Beverage Commission;
188188 (4) the attorney general; [or]
189189 (5) the insurance fraud unit of the Texas Department
190190 of Insurance; or
191191 (6) the Health and Human Services Commission's office
192192 of inspector general.
193193 SECTION 5. (a) The classification officer in the office of
194194 the state auditor shall classify the position of commissioned peace
195195 officer employed as an investigator by the Health and Human
196196 Services Commission's office of inspector general as a Schedule C
197197 position under the position classification plan maintained under
198198 Chapter 654, Government Code.
199199 (b) The change made by the classification officer as
200200 required by this section applies beginning with the state fiscal
201201 biennium beginning September 1, 2023.
202202 (c) This section expires September 1, 2025.
203203 SECTION 6. Section 661.918(a), Government Code, as amended
204204 by this Act, applies only to an injury that occurs on or after the
205205 effective date of this Act.
206206 SECTION 7. If before implementing any provision of this Act
207207 a state agency determines that any other waiver or authorization
208208 from a federal agency is necessary for implementation of that
209209 provision, the agency affected by the provision shall request the
210210 waiver or authorization and may delay implementing that provision
211211 until the waiver or authorization is granted.
212212 SECTION 8. This Act takes effect September 1, 2023.
