7 | 7 | | relating to the display of the national motto and historically |
---|
8 | 8 | | significant documents to the founding of the United States in |
---|
9 | 9 | | public schools and institutions of higher education. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 1.004, Education Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | Sec. 1.004. DISPLAY OF NATIONAL MOTTO AND HISTORICALLY |
---|
14 | 14 | | SIGNIFICANT DOCUMENTS. (a) A public elementary or secondary |
---|
15 | 15 | | school or an institution of higher education as defined by Section |
---|
16 | 16 | | 61.003 must display in a conspicuous place in each building of the |
---|
17 | 17 | | school or institution a durable poster or framed copy of the United |
---|
18 | 18 | | States national motto, "In God We Trust," and the historically |
---|
19 | 19 | | significant documents to the founding of the United States if the |
---|
20 | 20 | | poster or framed copy meets the requirements of Subsection (b) and |
---|
21 | 21 | | is: |
---|
22 | 22 | | (1) donated for display at the school or institution; |
---|
23 | 23 | | or |
---|
24 | 24 | | (2) purchased from private donations and made |
---|
25 | 25 | | available to the school or institution. |
---|
26 | 26 | | (a-1) In this section, "historically significant documents |
---|
27 | 27 | | to the founding of the United States" means: |
---|
28 | 28 | | (1) the United States Declaration of Independence; |
---|
29 | 29 | | (2) the United States Constitution; and |
---|
30 | 30 | | (3) the Ten Commandments. |
---|
31 | 31 | | (b) A poster or framed copy [of the national motto] |
---|
32 | 32 | | described by Subsection (a): |
---|
33 | 33 | | (1) must contain: |
---|
34 | 34 | | (A) the national motto, a representation of the |
---|
35 | 35 | | United States flag centered under the national motto, and a |
---|
36 | 36 | | representation of the state flag; |
---|
37 | 37 | | (B) one or more of the historically significant |
---|
38 | 38 | | documents to the founding of the United States; or |
---|
39 | 39 | | (C) both the items described by Paragraph (A) and |
---|
40 | 40 | | one or more items described by Paragraph (B); and |
---|
41 | 41 | | (2) may not depict any words, images, or other |
---|
42 | 42 | | information other than the items [representations] listed in |
---|
43 | 43 | | Subdivision (1). |
---|
44 | 44 | | (c) A public elementary or secondary school and an |
---|
45 | 45 | | institution of higher education may accept and use private |
---|
46 | 46 | | donations for the purposes of Subsection (a). |
---|
47 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
---|
48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
---|
49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
---|
51 | 51 | | Act takes effect September 1, 2023. |
