55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the display of the national motto and historically
88 significant documents to the founding of the United States in
99 public schools and institutions of higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 1.004, Education Code, is amended to
1212 read as follows:
1313 Sec. 1.004. DISPLAY OF NATIONAL MOTTO AND HISTORICALLY
1414 SIGNIFICANT DOCUMENTS. (a) A public elementary or secondary
1515 school or an institution of higher education as defined by Section
1616 61.003 must display in a conspicuous place in each building of the
1717 school or institution a durable poster or framed copy of the United
1818 States national motto, "In God We Trust," and the historically
1919 significant documents to the founding of the United States if the
2020 poster or framed copy meets the requirements of Subsection (b) and
2121 is:
2222 (1) donated for display at the school or institution;
2323 or
2424 (2) purchased from private donations and made
2525 available to the school or institution.
2626 (a-1) In this section, "historically significant documents
2727 to the founding of the United States" means:
2828 (1) the United States Declaration of Independence;
2929 (2) the United States Constitution; and
3030 (3) the Ten Commandments.
3131 (b) A poster or framed copy [of the national motto]
3232 described by Subsection (a):
3333 (1) must contain:
3434 (A) the national motto, a representation of the
3535 United States flag centered under the national motto, and a
3636 representation of the state flag;
3737 (B) one or more of the historically significant
3838 documents to the founding of the United States; or
3939 (C) both the items described by Paragraph (A) and
4040 one or more items described by Paragraph (B); and
4141 (2) may not depict any words, images, or other
4242 information other than the items [representations] listed in
4343 Subdivision (1).
4444 (c) A public elementary or secondary school and an
4545 institution of higher education may accept and use private
4646 donations for the purposes of Subsection (a).
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2023.
