8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 12.106(d), Education Code, is amended to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | (d) Subject to Subsection (e), in addition to other amounts |
---|
12 | 12 | | provided by this section, a charter holder is entitled to receive, |
---|
13 | 13 | | for the open-enrollment charter school, funding per student in |
---|
14 | 14 | | average daily attendance in an amount equal to the guaranteed level |
---|
15 | 15 | | of state and local funds per student per cent of tax effort under |
---|
16 | 16 | | Section 46.032(a) multiplied by the lesser of: |
---|
17 | 17 | | (1) the state average interest and sinking fund tax |
---|
18 | 18 | | rate imposed by school districts for the current year; or |
---|
19 | 19 | | (2) a rate that would result in a total amount to |
---|
20 | 20 | | which charter schools are entitled under this subsection for the |
---|
21 | 21 | | current year equal to $60 million $90 million. |
---|
22 | 22 | | SECTION 2. This Act takes effect September 1, 2023. |
