| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subtitle A, Title 14, Occupations Code, is |
|---|
| 9 | 9 | | amended by adding Chapter 2311 to read as follows: |
|---|
| 10 | 10 | | CHAPTER 2311. ELECTRIC VEHICLE CHARGING STATIONS |
|---|
| 11 | 11 | | Sec. 2311.001. ELECTRIC VEHICLE CHARGING STATION |
|---|
| 12 | 12 | | STANDARDS. (a) This section applies only to an electric vehicle |
|---|
| 13 | 13 | | charging station that is: |
|---|
| 14 | 14 | | (1) installed after December 1, 2024; |
|---|
| 15 | 15 | | (2) made available to the public; |
|---|
| 16 | 16 | | (3) not intended primarily for private use; and |
|---|
| 17 | 17 | | (4) funded through public grants or state rebate |
|---|
| 18 | 18 | | programs. |
|---|
| 19 | 19 | | (b) The Texas Department of Licensing and Regulation, in |
|---|
| 20 | 20 | | consultation with the Texas Department of Transportation, shall |
|---|
| 21 | 21 | | adopt standards for electric vehicle charging stations that require |
|---|
| 22 | 22 | | the charging stations to be equipped with a standard electric |
|---|
| 23 | 23 | | vehicle charging connector or plug type that is widely compatible |
|---|
| 24 | 24 | | with as many electric vehicles as practicable. |
|---|
| 25 | 25 | | SECTION 2. (a) Not later than December 1, 2024, the Texas |
|---|
| 26 | 26 | | Department of Licensing and Regulation shall adopt the standards |
|---|
| 27 | 27 | | required by Section 2311.001, Occupations Code, as added by this |
|---|
| 28 | 28 | | Act. |
|---|
| 29 | 29 | | (b) An electric vehicle charging station installed in this |
|---|
| 30 | 30 | | state must be operated in compliance with the standards adopted |
|---|
| 31 | 31 | | under Chapter 2311, Occupations Code, as added by this Act, not |
|---|
| 32 | 32 | | later than January 1, 2030. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2023. |
