55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the treatment of and education on sickle cell disease
88 and the sickle cell task force.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1111 amended by adding Section 533.0091 to read as follows:
1212 Sec. 533.0091. SICKLE CELL DISEASE TREATMENT. The
1313 commission shall:
1414 (1) in collaboration with the sickle cell task force
1515 established under Chapter 52, Health and Safety Code:
1616 (A) ensure that health care services provided
1717 under a managed care plan to recipients diagnosed with sickle cell
1818 disease align with national clinical practice guidelines and
1919 protocols for sickle cell disease treatment; and
2020 (B) increase sickle cell disease education for
2121 Medicaid providers, including emergency room providers; and
2222 (2) use the commission's existing data to identify
2323 opportunities for improving health outcomes of recipients
2424 diagnosed with sickle cell disease by:
2525 (A) reducing hospital admissions and
2626 readmissions; and
2727 (B) connecting those recipients to a sickle cell
2828 disease expert.
2929 SECTION 2. Sections 52.0003 and 52.0007, Health and Safety
3030 Code, are amended to read as follows:
3131 Sec. 52.0003. COMPOSITION OF TASK FORCE. The task force is
3232 composed of the following members appointed by the executive
3333 commissioner:
3434 (1) two members from community-based organizations
3535 with experience addressing the needs of individuals with sickle
3636 cell disease;
3737 (2) two physicians specializing in hematology;
3838 (3) two members of the public, each of whom either has
3939 sickle cell disease or is a parent of a person with sickle cell
4040 disease or trait; [and]
4141 (4) one representative of a health-related
4242 institution;
4343 (5) one representative of the Texas Education Agency;
4444 and
4545 (6) one representative of the commission.
4646 Sec. 52.0007. ANNUAL REPORT. (a) Not later than December 1
4747 of each year, the task force shall prepare and submit to the
4848 governor and the legislature an annual written report that
4949 summarizes the task force's work and includes any recommended
5050 actions or policy changes endorsed by the task force.
5151 (b) The task force shall, in collaboration with the
5252 commission, include in the task force's annual report
5353 recommendations for improving sickle cell disease education for
5454 health care providers.
5555 SECTION 3. Subtitle B, Title 2, Health and Safety Code, is
5656 amended by adding Chapter 52A to read as follows:
5757 CHAPTER 52A. SICKLE CELL DISEASE CARE EDUCATION
5858 Sec. 52A.001. EMERGENCY AND PRIMARY CARE MEDICINE GRADUATE
5959 MEDICAL EDUCATION PROGRAM CURRICULUM. (a) In this section,
6060 "medical school" has the meaning assigned by Section 58A.001,
6161 Education Code.
6262 (b) A medical school in this state that offers an emergency
6363 medicine, family medicine, or internal medicine residency program
6464 shall include in the curriculum requirements for the program
6565 education focused on sickle cell disease and sickle cell trait. The
6666 medical school may enter into agreements as necessary for the
6767 purposes of this section.
6868 Sec. 52A.002. INFORMATION FOR PUBLIC SCHOOL DISTRICT
6969 PERSONNEL. (a) The Texas Education Agency shall collaborate with
7070 sickle cell disease community-based organizations to provide
7171 information on sickle cell disease and sickle cell trait to public
7272 school districts and district staff, including school nurses,
7373 teachers, and coaches.
7474 (b) The commission in collaboration with the sickle cell
7575 task force established under Chapter 52 shall explore methods for
7676 improving sickle cell disease education and awareness within the
7777 public school system and provide recommendations to the Texas
7878 Education Agency on the improvement methods.
7979 SECTION 4. As soon as practicable after the effective date
8080 of this Act, the executive commissioner of the Health and Human
8181 Services Commission shall appoint the new members of the sickle
8282 cell task force as required by Section 52.0003, Health and Safety
8383 Code, as amended by this Act.
8484 SECTION 5. Section 52A.001, Health and Safety Code, as
8585 added by this Act, applies to residents entering an emergency
8686 medicine, family medicine, or internal residency program at a
8787 medical school in this state on or after January 1, 2024.
8888 SECTION 6. This Act takes effect September 1, 2023.
