| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter H, Chapter 201, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 201.625 to read as follows: |
|---|
| 13 | 13 | | Sec. 201.625. ON-SITE IDENTIFICATION REQUIREMENTS FOR |
|---|
| 14 | 14 | | CERTAIN DEPARTMENT CONTRACTORS AND SUBCONTRACTORS. (a) The |
|---|
| 15 | 15 | | commission shall adopt rules establishing identification |
|---|
| 16 | 16 | | requirements for department contractors and subcontractors while |
|---|
| 17 | 17 | | working at the site of a construction, maintenance, or improvement |
|---|
| 18 | 18 | | project of the department. |
|---|
| 19 | 19 | | (b) The rules adopted under Subsection (a) must require: |
|---|
| 20 | 20 | | (1) an employee of the contractor or subcontractor |
|---|
| 21 | 21 | | while working at the site of the project to wear an identification |
|---|
| 22 | 22 | | badge, in the form and manner prescribed by the commission, that |
|---|
| 23 | 23 | | clearly identifies the employee as a department contractor or |
|---|
| 24 | 24 | | subcontractor; and |
|---|
| 25 | 25 | | (2) each vehicle of the contractor or subcontractor |
|---|
| 26 | 26 | | while the vehicle is at the site of the project to display on each |
|---|
| 27 | 27 | | side of the vehicle, in the form and manner prescribed by the |
|---|
| 28 | 28 | | commission, insignia or other markings identifying the vehicle as a |
|---|
| 29 | 29 | | vehicle of a department contractor or subcontractor. |
|---|
| 30 | 30 | | SECTION 2. Not later than December 1, 2023, the Texas |
|---|
| 31 | 31 | | Transportation Commission shall adopt the rules required by Section |
|---|
| 32 | 32 | | 201.625, Transportation Code, as added by this Act. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2023. |
