66 AN ACT
77 relating to on-site identification requirements for certain
88 contractors and subcontractors of the Texas Department of
99 Transportation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter H, Chapter 201, Transportation Code,
1212 is amended by adding Section 201.625 to read as follows:
1313 Sec. 201.625. ON-SITE IDENTIFICATION REQUIREMENTS FOR
1414 CERTAIN DEPARTMENT CONTRACTORS AND SUBCONTRACTORS. (a) The
1515 commission shall adopt rules establishing identification
1616 requirements for department contractors and subcontractors while
1717 working at the site of a construction, maintenance, or improvement
1818 project of the department.
1919 (b) The rules adopted under Subsection (a) must require:
2020 (1) an employee of the contractor or subcontractor
2121 while working at the site of the project to wear an identification
2222 badge, in the form and manner prescribed by the commission, that
2323 clearly identifies the employee as a department contractor or
2424 subcontractor; and
2525 (2) each vehicle of the contractor or subcontractor
2626 while the vehicle is at the site of the project to display on each
2727 side of the vehicle, in the form and manner prescribed by the
2828 commission, insignia or other markings identifying the vehicle as a
2929 vehicle of a department contractor or subcontractor.
3030 SECTION 2. Not later than December 1, 2023, the Texas
3131 Transportation Commission shall adopt the rules required by Section
3232 201.625, Transportation Code, as added by this Act.
3333 SECTION 3. This Act takes effect September 1, 2023.
