88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 ARTICLE 1. GENERAL PROVISIONS AND DEPARTMENT OF PUBLIC SAFETY
1010 SECTION 1.01. This Act pertains to the authority for Texas
1111 and national criminal history record information to be released to
1212 state agencies and those agencies’ handling of the information.
1313 SECTION 1.02. Section 411.082(2) – (6), Government Code, is
1414 amended to add new section (2) and renumber subsequent sections
1515 accordingly to read as follows:
1616 (2) “Applicant” means an individual who submits an
1717 application for employment, licensure, certification, or
1818 registration which requires a background check using criminal
1919 history record information by the department.
2020 (3) ”Application” means an individual who submits an
2121 application either by hard copy or electronically for employment,
2222 licensure, certification, or registration which requires a
2323 background check using criminal history record information by the
2424 department.
2525 (24) "Criminal history record information" means
2626 information collected about a person by a criminal justice agency
2727 that consists of identifiable descriptions and notations of
2828 arrests, detentions, indictments, informations, and other formal
2929 criminal charges and their dispositions. The term does not
3030 include:
3131 (A) identification information, including
3232 fingerprint records, to the extent that the identification
3333 information does not indicate involvement of the person in the
3434 criminal justice system; or
3535 (B) driving record information maintained by the
3636 department under Subchapter C, Chapter 521, Transportation Code.
3737 (35) "Criminal justice agency" means:
3838 (A) a federal or state agency that is engaged in
3939 the administration of criminal justice under a statute or executive
4040 order and that allocates a substantial portion of its annual budget
4141 to the administration of criminal justice; or
4242 (B) a nongovernmental railroad or campus police
4343 department that has obtained an originating agency identifier from
4444 the Federal Bureau of Investigation.
4545 (46) "Criminal justice purpose" means:
4646 (A) an activity that is included in the
4747 administration of criminal justice; or
4848 (B) screening of applicants for employment
4949 with a criminal justice agency.
5050 (57) "Office of capital and forensic writs" means the
5151 office of capital and forensic writs established under Subchapter
5252 B, Chapter 78.
5353 (68) "Public defender's office" has the meaning
5454 assigned by Article 26.044(a), Code of Criminal Procedure.
5555 Section 1.03. Section 411.891, Government Code, is amended
5656 to read as follows:
5757 Sec. 411.0891. DEPARTMENT ACCESS TO CRIMINAL HISTORY
5858 RECORD INFORMATION: CERTAIN DEPARTMENTAL AUTHORIZATIONS. (a)
5959 Subject to Section 411.087, the department is authorized to obtain
6060 and use criminal history record information maintained by the
6161 Federal Bureau of Investigation or the department that relates to a
6262 person who:
6363 (1) is an applicant for or holds a registration issued
6464 by the director under Subchapter C, Chapter 481, Health and Safety
6565 Code, that authorizes the person to manufacture, distribute,
6666 analyze, or conduct research with a controlled substance;
6767 (2) is an applicant for or holds a registration issued
6868 by the department under Chapter 487, Health and Safety Code, to be a
6969 director, manager, or employee of a dispensing organization, as
7070 defined by Section 487.001, Health and Safety Code;
7171 (3) is an applicant for or holds an authorization
7272 issued by the department under Section 521.2476, Transportation
7373 Code, to do business in this state as a vendor of ignition interlock
7474 devices;
7575 (4) is an applicant for or holds certification by the
7676 department as an inspection station or an inspector under
7777 Subchapter G, Chapter 548, Transportation Code, holds an inspection
7878 station or inspector certificate issued under that subchapter, or
7979 is the owner of an inspection station operating under that chapter;
8080 or
8181 (5) is an applicant for or holds a certificate of
8282 registration issued by the department under Chapter 1956,
8383 Occupations Code, to act as a metal recycling entity.
8484 (6) is an applicant for or holds a license to carry a
8585 handgun issued by the department under Subchapter H, Chapter 411,
8686 Government Code, or is an applicant for or holds a certification as
8787 an instructor issued by the department under that chapter;
8888 (7) is an applicant for or holds a capitol access pass
8989 issued by the department under Section 411.0625, Government Code;
9090 (8) is an applicant for or holds a license or commission
9191 issued by the department under Chapter 1702, Occupations Code;
9292 (b) The department may release or disclose Texas criminal
9393 history record information obtained or used by the department for a
9494 purpose described by Subsection (a) to another person or agency
9595 only:
9696 (1) in a criminal proceeding;
9797 (2) in a hearing conducted by the department;
9898 (3) under an order from a court; or
9999 (4) with the consent of the person who is the subject of
100100 the criminal history record information.
101101 (c) This section may not be construed to limit the authority
102102 of the department to disseminate criminal history record
103103 information as provided by Section 411.083.
104104 (d) The department may require any person for whom the
105105 department is authorized to obtain and use criminal history record
106106 information maintained by the Federal Bureau of Investigation or
107107 the department under Subsection (a) to submit a complete and
108108 legible set of fingerprints to the department on a form prescribed
109109 by the department for the purpose of obtaining criminal history
110110 record information.
111111 (e) Criminal history record information obtained from the
112112 Federal Bureau of Investigation shall not be disseminated.
113113 Section 1.04. Section 411.122(d), Government Code, is
114114 amended to read as follows:
115115 (d) The following state agencies are subject to this
116116 section:
117117 (1) Texas Appraiser Licensing and Certification Board;
118118 (2) Texas Board of Architectural Examiners;
119119 (3) Texas Board of Chiropractic Examiners;
120120 (4) State Board of Dental Examiners;
121121 (5) Texas Board of Professional Engineers;
122122 (6) Texas Funeral Service Commission;
123123 (7) Texas Board of Professional Geoscientists;
124124 (8) Health and Human Services Commission, except as
125125 provided by Section 411.110, and agencies attached to the
126126 commission;
127127 (9) Texas Board of Professional Land Surveying;
128128 (10) Texas Department of Licensing and Regulation,
129129 except as provided by Section 411.093;
130130 (11) Texas Commission on Environmental Quality;
131131 (12) Texas BoardExecutive Council of Physical Therapy

148148 ARTICLE 2. TEXAS APPRAISAL DISTRICT, APPOINTMENT TO APPRAISAL
149149 REVIEW BOARD, AND TEXAS APPRAISER LICENSING AND CERTIFICATION BOARD
150150 SECTION 2.01. Section 411.1296, Government Code, is amended
151151 to read as follows:
152152 Sec. 411.1296. ACCESS TO CRIMINAL HISTORY RECORD
153153 INFORMATION: EMPLOYMENT BY APPRAISAL DISTRICT,AND APPOINTMENT TO
154154 APPRAISAL REVIEW BOARD, AND APPLICANT TO TEXAS APPRAISER LICENSING
155155 AND CERTIFICATION BOARD. (a) Except as provided by Subsection (b),
156156 an appraisal district established by Section 6.01, Tax Code and the
157157 Texas Appraiser Licensing and Certification Board, isare entitled
158158 to obtain from the department criminal history record information
159159 maintained by the department that relates to a person who is an
160160 applicant for employment by the appraisal district,or for
161161 appointment to the appraisal review board for the appraisal
162162 district, or a license or certification as an appraiser trainee,
163163 licensed residential appraiser, certified residential appraiser,
164164 certified general appraisal, or an appraisal management company
165165 regulated by the Texas Appraiser Licensing and Certification Board.
166166 (b) An appraisal district is not entitled to obtain under
167167 this section any information about a person if the appraisal
168168 district is entitled to obtain under another section of this
169169 subchapter any criminal history record information about the
170170 person.
171171 (c) The appraisal district may provide Texas criminal
172172 history record information obtained under this section to the local
173173 administrative district judge or to the appraisal review board
174174 commissioners appointed by the local administrative district
175175 judge.
176176 (d) Texas criminal history record information obtained by an
177177 appraisal district or the Texas Appraiser Licensing and
178178 Certification Board under Subsection (a) related to an applicant
179179 for employment by the appraisal district, appointment to the
180180 appraisal review board for the appraisal district, or a license or
181181 certification as an appraiser trainee, licensed residential
182182 appraiser, certified residential appraiser, certified general
183183 appraisal, or an appraisal management company regulated by the
184184 Texas Appraiser Licensing and Certification Board may not be
185185 released or disclosed to any person except on court order, with the
186186 written consent of the person or entity that is the subject of the
187187 criminal history record information, or as provided by Subsection
188188 (c).
189189 (e) After an individual is employed, licensed, or certified
190190 as described in this section, an appraisal district or the Texas
191191 Appraiser Licensing and Certification Board shall destroy the
192192 criminal history record information that relates to that
193193 individual. An appraisal district or the Texas Appraiser Licensing
194194 and Certification Board shall destroy the criminal history record
195195 information that relates to:
196196 (1) an applicant for licensure under (a);
197197 (2) an applicant for employment with an appraisal
198198 district or the Texas Appraiser Licensing and Certification Board
199199 after that applicant is employed or, for an applicant who is not
200200 employed, after the check of the criminal history record
201201 information on that applicant is completed.
202202 (f) An appraisal district or the Texas Appraiser Licensing
203203 and Certification Board shall destroy criminal history record
204204 information that relates to an applicant who is not licensed or
205205 employed, as applicable.
206206 (g) An appraisal district or the Texas Appraiser Licensing
207207 and Certification Board is not prohibited from disclosing Texas
208208 criminal history record information obtained under Subsection (a)
209209 in a criminal proceeding or in a hearing conducted by an appraisal
210210 district or the Texas Appraiser Licensing and Certification Board.
211211 (h) In accordance with Section 411.087, an appraisal district
212212 or the Texas Appraiser Licensing and Certification Board may obtain
213213 criminal history record information from the Federal Bureau of
214214 Investigation identification division through the department.
215215 (i) Criminal history record information obtained by the
216216 Federal Bureau of Investigation shall not be disseminated.
217217 ARTICLE 3. TEXAS BOARD OF ARCHITECTURAL EXAMINERS
218218 SECTION 3.01. Chapter 411, Government Code, is amended by
219219 adding Section 411.### to read as follows:
220220 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD
221221 INFORMATION: TEXAS BOARD OF ARCHITECTURAL EXAMINERS. (a) The
222222 Texas Board of Architectural Examiners is entitled to obtain from
223223 the department criminal history record information maintained by
224224 the department that relates to:
225225 (1) a person who is:
226226 (A) an applicant for an architectural
227227 registration under Texas Occupations Code Chapter 1051; or
228228 (B) the holder of an architectural registration
229229 under that Chapter;
230230 (2) a person who is:
231231 (A) an applicant for a landscape architectural
232232 registration under Texas Occupations Code Chapter 1052; or
233233 (B) the holder of a landscape architectural
234234 registration under that Chapter; or
235235 (3) a person who is:
236236 (A) an applicant for an interior design
237237 registration under Texas Occupations Code Chapter 1053; or
238238 (B) the holder of an interior design registration
239239 under that Chapter.
240240 (b) Texas criminal history record information obtained by the
241241 Texas Board of Architectural Examiners under Subsection (a) may not
242242 be released or disclosed to any person except on court order or as
243243 provided by Subsection (f).
244244 (c) After a person is registered, the Texas Board of
245245 Architectural Examiners shall destroy the criminal history record
246246 information that relates to that person.
247247 (d) If the Texas Board of Architectural Examiners receives
248248 updated criminal history record information from the department
249249 that relates to a person who holds an architectural, landscape
250250 architectural, or interior design registration, the Texas Board of
251251 Architectural Examiners shall destroy the criminal history record
252252 information after the check of the criminal history record
253253 information on that registration holder is completed.
254254 (e) The Texas Board of Architectural Examiners shall destroy
255255 criminal history record information that relates to an applicant
256256 who is not registered.
257257 (f) The Texas Board of Architectural Examiners is not
258258 prohibited from disclosing criminal history record information
259259 obtained under Subsection (a) in a criminal proceeding or in a
260260 hearing conducted by the Texas Board of Architectural Examiners or
261261 the State Office of Administrative Hearings, as applicable.
262262 (g) In accordance with Section 411.087 and/or Texas
263263 Occupations Code Section 1051.3041, the Texas Board of
264264 Architectural Examiners shall obtain criminal history record
265265 information from the Federal Bureau of Investigation
266266 identification division for all applicants and holders of
267267 architectural, landscape architectural, and interior design
268268 registrations.
269269 (h) Criminal history record information obtained by the
270270 Federal Bureau of Investigation shall not be disseminated.
271271 ARTICLE 4. HEALTH AND HUMAN SERVICES COMMISSION: OFFICE OF
272272 INSPECTOR GENERAL
273273 SECTION 4.01. Section 411.1143, Government Code, is amended
274274 to read as follows:
275275 Sec. 411.1143. ACCESS TO CRIMINAL HISTORY RECORD
276276 INFORMATION; AGENCIES OPERATING PART OF MEDICAL ASSISTANCE
277277 PROGRAM. (a) The Health and Human Services Commission, an agency
278278 operating part of the medical assistance program under Chapter 32,
279279 Human Resources Code, or the office of inspector general
280280 established under Chapter 531, Government Code, is entitled to
281281 obtain from the department the criminal history record information
282282 maintained by the department that relates to a provider under the
283283 medical assistance program or a person applying to enroll as a
284284 provider under the medical assistance program.
285285 (a-1) Criminal history record information an agency or the
286286 office of inspector general is authorized to obtain under
287287 Subsection (a) includes criminal history record information
288288 relating to:
289289 (1) a person with a direct or indirect ownership or
290290 control interest, as defined by 42 C.F.R. Section 455.101, in a
291291 provider of five percent or more; and
292292 (2) a person whose information is required to be
293293 disclosed in accordance with 42 C.F.R. Part 1001.
294294 (b) Texas criminal history record information obtained by
295295 the commission or an agency under Subsection (a):
296296 (1) may not be released or disclosed to any person
297297 except in a criminal proceeding, in an administrative proceeding,
298298 on court order, or with the written consent of the provider or
299299 applicant; and
300300 (2) must be destroyed after it has been used to
301301 determine the eligibility of the provider or applicant to be a
302302 provider under Chapter 32, Human Resources Code.
303303 (c) In accordance with Section 411.087, the commission or an
304304 agency under Subsection (a) may obtain criminal history record
305305 information from the Federal Bureau of Investigation
306306 identification division.
307307 (d) Criminal history record information obtained by the
308308 Federal Bureau of Investigation shall not be disseminated.
309309 ARTICLE 5. STATE OFFICE OF ADMINISTRATIVE HEARINGS
310310 SECTION 5.01. Subchapter F, Chapter 411, Government Code, is
311311 amended by adding Section 411.1411 to read as follows:
312312 Sec. 411.1411. ACCESS TO CRIMINAL HISTORY RECORD
313313 INFORMATION: STATE OFFICE OF ADMINISTRATIVE HEARINGS. (a) In this
314314 section, "office" means the State Office of Administrative
315315 Hearings.
316316 (b) The office is entitled to obtain from the department
317317 criminal history record information maintained by the department
318318 that relates to a person who is:
319319 (1) an employee of, or an applicant for employment
320320 with, the office;
321321 (2) a contractor, volunteer, or intern of the office,
322322 or an applicant to serve in one of those capacities; or
323323 (3) a current or proposed contractor or subcontractor
324324 of the office.
325325 (c) Texas criminal history record information obtained by
326326 the office under Subsection (b) may not be released or disclosed to
327327 any person except by court order or with the written consent of the
328328 person who is the subject of the criminal history record
329329 information.
330330 (d) The office shall destroy criminal history record
331331 information obtained under Subsection (b) that relates to:
332332 (1) an applicant for employment after that applicant is
333333 employed or, for an applicant who is not employed, after a final
334334 employment determination on that applicant is made; or
335335 (2) an employee, contractor, volunteer, or intern of
336336 the office, after the check of the criminal history record
337337 information on that person or entity is completed.
338338 (e) In accordance with Section 411.087, the office may
339339 obtain criminal history information from the Federal Bureau of
340340 Investigation identification division.
341341 (f) Criminal history record information obtained by the
342342 office from the Federal Bureau of Investigation shall not be
343343 disseminated.
344344 ARTICLE 6. TEXAS ALCOHOLIC BEVERAGE COMMISSION
345345 SECTION 6.01. Chapter 411, Government Code, is amended by
346346 adding Section 411.XXX to read as follows:
347347 Sec. 411.XXX. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION
348348 OF THE FEDERAL BUREAU OF INVESTIGATION: TEXAS ALCOHOLIC BEVERAGE
349349 COMMISSION. (a) Subject to Section 411.087 and Public Law 92-544,
350350 the Texas Alcoholic Beverage Commission is authorized to obtain and
351351 use criminal history record information maintained by the Federal
352352 Bureau of Investigation that relates to a person who is an applicant
353353 for or holds a license, permit, or certificate under the Texas
354354 Alcoholic Beverage Code.
355355 (b) Criminal history record information obtained by the
356356 commission under this section may only be released or disclosed as
357357 provided in Section 411.084(b).
358358 (c) This section may not be construed to limit the
359359 commission’s ability to obtain criminal history record information
360360 for criminal justice purposes or as otherwise authorized by other
361361 law.
362362 (d) The commission may require any person for whom the
363363 commission is authorized to obtain and use criminal history record
364364 information under Subsection (a) to submit a complete and legible
365365 set of fingerprints to the commission on a form prescribed by the
366366 commission for the purpose of obtaining criminal history record
367367 information.
368368 ARTICLE 7. TEXAS BEHAVIORAL HEALTH EXECUTIVE COUNCIL
369369 SECTION 7.01. Chapter 411, Government Code, is amended by
370370 adding Section 411.XXX to read as follows:
371371 SECTION 411.XXX. ACCESS TO CRIMINAL HISTORY RECORD
372372 INFORMATION: TEXAS BEHAVIORAL HEALTH EXECUTIVE COUNCIL. (a) The
373373 executive council is entitled to obtain from the Department of
374374 Public Safety of the State of Texas, criminal history record
375375 information maintained by the department that relates to a person
376376 who is an applicant for or licensed as:
377377 (1) a licensed psychologist, licensed psychological
378378 associate, or licensed specialist in school psychology under
379379 Chapter 501 of the Occupations Code;
380380 (2) a licensed marriage and family therapist or
381381 licensed marriage and family therapist associate under Chapter 502
382382 of the Occupations Code;
383383 (3) a licensed professional counselor or licensed
384384 professional counselor associate under Chapter 503 of the
385385 Occupations Code; or
386386 (4) a licensed baccalaureate social worker, licensed
387387 master social worker, or licensed clinical social worker under
388388 Chapter 505 of the Occupations Code.
389389 (b) Texas criminal history record information obtained by
390390 the executive council under subsection (a) may not be released or
391391 disclosed to any person except on court order, with the written
392392 consent of the person that is the subject of the criminal history
393393 record information, or as provided by Subsection (f).
394394 (c) After a person is licensed, the executive council shall
395395 destroy the criminal history record information that relates to
396396 that person.
397397 (d) The executive council shall destroy criminal history
398398 record information that relates to an applicant who is not
399399 licensed.
400400 (e) After a license has been renewed or denied renewal, the
401401 executive council shall destroy criminal history record
402402 information that relates to the license holder renewing or
403403 attempting to renew the license.
404404 (f) The executive council is not prohibited from disclosing
405405 criminal history record information obtained under Subsection (a)
406406 in a criminal proceeding or in a hearing conducted by the executive
407407 council or State Office of Administrative Hearings.
408408 (g) In accordance with Section 411.087 of the Government
409409 Code, the executive council shall obtain criminal history record
410410 information from the Federal Bureau of Investigation
411411 identification division by fingerprint submission.
412412 (h) Criminal history record information obtained from the
413413 Federal Bureau of Investigation shall not be disseminated.
414414 ARTICLE 8. TEXAS DEPARTMENT OF MOTOR VEHICLES
415415 SECTION 8.01. Chapter 411, Government Code, is amended by
416416 adding Section 411.### to read as follows:
417417 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
418418 TEXAS DEPARTMENT OF MOTOR VEHICLES. (a) The Texas Department of
419419 Motor Vehicles is entitled to obtain from the department criminal
420420 history record information maintained by the department that
421421 relates to a person who is:
422422 (1) an applicant for or holds a general distinguishing
423423 number under Chapter 503, Transportation Code;
424424 (2) an applicant for or holds a license under Chapter
425425 2301 or Chapter 2302, Occupations Code; or
426426 (3) an officer, director, member, manager, principal,
427427 partner, trustee, or other person acting in a representative
428428 capacity for an applicant, general distinguishing number holder, or
429429 license holder and whose act or omission would be cause for denying,
430430 revoking, or suspending a general distinguishing number or license
431431 issued under Chapter 503, Transportation Code or Chapter 2301 or
432432 Chapter 2302, Occupations Code.
433433 (b) Texas criminal history record information obtained by
434434 the Texas Department of Motor Vehicles under Subsection (a) may not
435435 be released or disclosed to any person except on court order, with
436436 the written consent of the person or entity that is the subject of
437437 the criminal history record information, or as provided by
438438 Subsection (c).
439439 (c) The Texas Department of Motor Vehicles is not prohibited
440440 from disclosing Texas criminal history record information obtained
441441 under Subsection (a) in a criminal proceeding or in a hearing in
442442 which the Texas Department of Motor Vehicles is a party.
443443 (d) In accordance with Section 411.087, the Texas Department
444444 of Motor Vehicles may obtain criminal history record information
445445 from the Federal Bureau of Investigation identification division.
446446 (e) Criminal history record information obtained from the
447447 Federal Bureau of Investigation shall not be disseminated.
448448 ARTICLE 9. TEXAS REAL ESTATE COMMISSION
449449 SECTION 9.01. Chapter 411, Government Code, is amended by
450450 adding Section 411.### to read as follows:
451451 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
452452 TEXAS REAL ESTATE COMMISSION AND TEXAS APPRAISER LICENSING AND
453453 CERTIFICATION BOARD. (a) In this section:
454454 (1) “Commission” means the Texas Real Estate
455455 Commission.
456456 (2) “Board” means the Texas Appraiser Licensing and
457457 Certification Board.
458458 (b) The commission is entitled to obtain from the department
459459 criminal history record information maintained by the department
460460 that relates to:
461461 (1) an applicant for an initial broker or sales agent
462462 license or renewal of a broker or sales agent license under Chapter
463463 1101, Occupations Code;
464464 (2) an applicant for an original certificate of
465465 registration as an easement or right-of-way agent or renewal of a
466466 certificate of registration as an easement or right-of-way agent
467467 under Chapter 1101, Occupations Code; or
468468 (3) an applicant for an apprentice inspector license, a
469469 real estate inspector license, or a professional inspector license
470470 or renewal of an apprentice inspector license, a real estate
471471 inspector license, or a professional inspector license under
472472 Chapter 1102, Occupations Code.
473473 (c) The board is entitled to obtain from the department
474474 criminal history record information maintained by the department
475475 that relates to:
476476 (1) an applicant for an appraiser trainee license, a
477477 residential appraiser license, a residential appraiser certificate
478478 or a general appraiser certificate or renewal of an appraiser
479479 trainee license, a residential appraiser license, a residential
480480 appraiser certificate, or general appraiser certificate under
481481 Chapter 1103, Occupations Code; or
482482 (2) an applicant for registration or renewal of a
483483 registration as an appraisal management company under Chapter 1104,
484484 Occupations Code.
485485 (d) Neither the commission or the board is prohibited from
486486 disclosing Texas criminal history record information obtained

489489 (e) In accordance with Section 411.087, and Sections
490490 1101.3521, 1101.4521, 1101.5041, 1102.1051, and 1103.2031
491491 Occupations Code, both the commission and board may obtain criminal
492492 history record information from the Federal Bureau of Investigation
493493 identification division.
494494 (f) Criminal history record information obtained by the
495495 Federal Bureau of Investigation shall not be disseminated.
496496 SECTION 9.02. Sec. 1101.002, Occupations Code, is amended by
497497 adding new subdivision (3-a) as follows:
498498 (3-a) “Easement or right-of-way agent” means a person
499499 who sells, buys, leases, or transfers an easement or right-of-way
500500 for another, for compensation or with the expectation of receiving
501501 compensation, for use in connection with telecommunication,
502502 utility, railroad, or pipeline service.
503503 SECTION 9.03. Sec. 1101.501, Occupations Code, is amended as
504504 follows:
505505 Sec. 1101.501. CERTIFICATE REQUIRED. A person may not act as
506506 an easement or right-of-way agent [sell, buy, lease, or transfer an
507507 easement or right-of-way for another, for compensation or with the
508508 expectation of receiving compensation, for use in connection with
509509 telecommunication, utility, railroad, or pipeline service] unless
510510 the person:
511511 (1) holds a license issued under this chapter; or
512512 (2) holds a certificate of registration issued under
513513 this subchapter.
514514 SECTION 9.04. Sec. 1101.5041, Occupations Code, is amended as
515515 follows:
516516 Sec. 1101.5041. CRIMINAL HISTORY RECORD INFORMATION
517517 REQUIREMENT FOR CERTIFICATE. An applicant for an original
518518 certificate of registration as an easement or right-of-way agent or
519519 renewal of a certificate of registration as an easement or
520520 right-of-way agent must comply with the criminal history record
521521 check requirements of Section 1101.3521.
522522 ARTICLE 10. TEXAS STATE BOARD OF PLUMBING EXAMINERS
523523 SECTION 10.01. Chapter 411, Government Code, is amended by
524524 adding Section 411.XXX to read as follows:
525525 Sec. 411.XXX. ACCESS TO CRIMINAL HISTORY RECORD
526526 INFORMATION: Texas State Board of Plumbing Examiners. (a) The
527527 Texas State Board of Plumbing Examiners is entitled to obtain from
528528 the department criminal history record information maintained by
529529 the department that relates to an applicant for a license,
530530 registration, endorsement, or certificate under Chapter 1301,
531531 Texas Occupations Code, Plumbing License Law (PLL) including Master
532532 Plumber, Journeyman Plumber, Plumbing Inspector, Tradesman-Plumber
533533 Limited, Plumber’s Apprentice, Medical Gas Piping Installation
534534 Endorsement, Multipurpose Residential Fire Protection Sprinkler
535535 Specialist Endorsement, and Water Supply Protection Specialist
536536 Endorsement.
537537 (b) Texas criminal history record information obtained by
538538 the Texas State Board of Plumbing Examiners under Subsection (a)
539539 may not be released or disclosed to any person except on court
540540 order, with the written consent of the person or entity that is the
541541 subject of the criminal history record information, or as provided
542542 by Subsection (e).
543543 (c) After the applicant is licensed, registered, endorsed,
544544 or certified, the Texas State Board of Plumbing Examiners shall
545545 destroy the criminal history record information that relates to
546546 that applicant.
547547 (d) The Texas State Board of Plumbing Examiners may destroy
548548 criminal history record information that relates to an applicant
549549 who is not licensed, registered, endorsed, or certified, as
550550 applicable.
551551 (e) The Texas State Board of Plumbing Examiners is not
552552 prohibited from disclosing Texas criminal history record
553553 information obtained under Subsection (a) in a criminal proceeding
554554 or in a hearing conducted by the Texas State Board of Plumbing
555555 Examiners.
556556 (f) In accordance with Section 411.087 and Chapter 1301,
557557 Texas Occupations Code, the Texas State Board of Plumbing Examiners
558558 shall obtain criminal history record information from the Federal
559559 Bureau of Investigation identification division.
560560 (g) Criminal history record information obtained by the
561561 Federal Bureau of Investigation shall not be disseminated.
562562 ARTICLE 11. TEXAS BOARD OF CHIROPRACTIC EXAMINERS
563563 SECTION 11.01. Chapter 411, Government Code, is amended by
564564 adding Section 411.XXX to read as follows:
565565 Sec. 411.XXX. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
566566 TEXAS BOARD OF CHIROPRACTIC EXAMINERS. (a) The Texas Board of
567567 Chiropractic Examiners are entitled to obtain from the department
568568 criminal history record information maintained by the department
569569 that relates to:
570570 (1) a person who is an applicant for a license or
571571 registration under Texas Occupations Code Chapter 201; or
572572 (2) the holder of a license or registration under Texas
573573 Occupations Code Chapter 201.
574574 (b) Texas criminal history record information obtained by
575575 the Texas Board of Chiropractic Examiners under Subsection (a) may
576576 not be released or disclosed to any person except on court order,
577577 with the written consent of the person or entity that is the subject
578578 of the criminal history record information, or as provided by
579579 Subsection (e).
580580 (c) After an entity is licensed or registered, the Texas
581581 Board of Chiropractic Examiners shall destroy the criminal history
582582 record information that relates to that entity.
583583 (d) The Texas Board of Chiropractic Examiners shall destroy
584584 criminal history record information that relates to an applicant
585585 who is not licensed or registered, as applicable.
586586 (e) The Texas Board of Chiropractic Examiners is not
587587 prohibited from disclosing Texas criminal history record
588588 information obtained under Subsection (a) in a criminal proceeding
589589 or in a hearing conducted under the authority of the Texas Board of
590590 Chiropractic Examiners.
591591 (f) In accordance with Section 411.087, the Texas Board of
592592 Chiropractic Examiners shall obtain criminal history record
593593 information from the Federal Bureau of Investigation
594594 identification division.
595595 (g) Criminal history record information obtained by the
596596 Federal Bureau of Investigation shall not be disseminated.
597597 ARTICLE 12. TEXAS STATE BOARD OF PUBLIC ACCOUNTANCY
598598 SECTION 12.01. Section 411.105, Government Code, is amended
599599 to read as follows:
600600 Sec. 411.105. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
601601 TEXAS STATE BOARD OF PUBLIC ACCOUNTANCY. (a) The Texas State Board
602602 of Public Accountancy is entitled to obtain from the department and
603603 the Federal Bureau of Investigation, pursuant to 901.169 of the
604604 Public Accountancy Act, Chapter 901 Occupations Code, criminal
605605 history record information maintained by the department and the
606606 Federal Bureau of Investigation that relates toa person who is:
607607 (1) an individual, pursuant to Chapter 901 of the
608608 Occupations Code, who is:
609609 (A) an applicant for certification as a certified
610610 public accountant under Chapter 901, Occupations Code; or an
611611 applicant to take the uniform CPA examination under that Act.;
612612 (B) an applicant to be certified;
613613 (C) an applicant to be licensed;
614614 (D) an applicant to be reinstated;
615615 (E) an applicant to have a license renewed;
616616 (F) an applicant to become a non-CPA owner of a CPA
617617 firm; or
618618 (G) a license holder or non-CPA owner of a CPA
619619 firm.
620620 (b) Texas criminal history record information obtained by
621621 the board under Subsection (a) shall not be released or disclosed to
622622 any person except on court order, with the written consent of the
623623 person that is the subject of the criminal history record
624624 information, or as provided by Subsection (d).
625625 (c) After an individual’s application is approved or denied,
626626 or an investigation completed, the board shall destroy the criminal
627627 history record information that relates to that individual.
628628 (d) The board is not prohibited from disclosing Texas
629629 criminal history record information obtained under Subsection (a)
630630 in a criminal proceeding or in a hearing conducted by or on behalf
631631 of the board.
632632 (e) Criminal history record information obtained by the
633633 Federal Bureau of Investigation shall not be disseminated.
634634 ARTICLE 13. TEXAS OPTOMETRY BOARD
635635 SECTION 13.01. Chapter 411, Government Code, is amended by
636636 adding Section 411. ### to read as follows:
637637 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD
638638 INFORMATION: Texas Optometry Board. (a) The Texas Optometry Board
639639 is entitled to obtain from the department criminal history record
640640 information maintained by the department that relates to:
641641 (1) a person who is:
642642 (A) an applicant for a license under Section
643643 351.251, Texas Occupations Code; or
644644 (B) the holder of a license under Section
645645 351.302, Texas Occupations Code.
646646 (b) Texas criminal history record information obtained by
647647 the Texas Optometry Board under Subsection (a) shall not be
648648 released or disclosed to any person except on court order, with the
649649 written consent of the person or entity that is the subject of the
650650 criminal history record information, or as provided by Subsection
651651 (e).
652652 (c) After a person is licensed, the Texas Optometry Board
653653 shall destroy the criminal history record information that relates
654654 to that person.
655655 (d) The Texas Optometry Board shall destroy criminal history
656656 record information that relates to an applicant who is not
657657 licensed, as applicable.
658658 (e) The Texas Optometry Board is not prohibited from
659659 disclosing Texas criminal history record information obtained
660660 under Subsection (a) in a criminal proceeding or in a hearing
661661 conducted by the Texas Optometry Board.
662662 (g) In accordance with Section 411.087, Sec. 351.2525, Texas
663663 Occupations Code, and Sec. 351.3045, Texas Occupations Code, the
664664 Texas Optometry Board shall obtain criminal history record
665665 information from the Federal Bureau of Investigation
666666 identification division.
667667 (h) Criminal history record information obtained by the
668668 Federal Bureau of Investigation shall not be disseminated.
669669 ARTICLE 14. EXECUTIVE COUNCIL OF PHYSICAL THERAPY AND OCCUPATIONAL
670670 THERAPY EXAMINERS
671671 SECTION 14.01. Chapter 411, Government Code, is amended by
672672 adding Section 411.XXX to read as follows:
673673 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
674674 EXECUTIVE COUNCIL OF PHYSICAL THERAPY AND OCCUPATIONAL THERAPY
675675 EXAMINERS.
676676 (a) The Executive Council of Physical Therapy and
677677 Occupational Therapy Examiners is entitled to obtain from the
678678 department criminal history record information maintained by the
679679 department that relates to a person who is:
680680 (1) an applicant for or the holder of a physical
681681 therapist or physical therapist assistant license under Chapter
682682 453, Occupations Code; or
683683 (2) an applicant for or the holder of an
684684 occupational therapist or occupational therapy assistant license
685685 under Chapter 454, Occupations Code.
686686 (b) Texas criminal history record information obtained
687687 by the Executive Council of Physical Therapy and Occupational
688688 Therapy Examiners under Subsection (a) may not be released or
689689 disclosed to any person except on court order, with the written
690690 consent of the person who is the subject of the criminal history
691691 record information, or as provided by Subsection (f).
692692 (c) After a person is licensed, the Executive Council
693693 of Physical Therapy and Occupational Therapy Examiners shall
694694 destroy the criminal history record information that relates to
695695 that person.
696696 (d) The Executive Council of Physical Therapy and
697697 Occupational Therapy Examiners shall destroy criminal history
698698 record information that relates to an applicant who is not
699699 licensed.
700700 (e) After a license has been renewed or denied renewal,
701701 the Executive Council of Physical Therapy and Occupational Therapy
702702 Examiners shall destroy criminal history record information that
703703 relates to the license holder who is renewing or attempting to renew
704704 the license.
705705 (f) The Executive Council of Physical Therapy and
706706 Occupational Therapy Examiners is not prohibited from disclosing
707707 Texas criminal history record information obtained under
708708 Subsection (a) in a criminal proceeding or in a hearing conducted by
709709 the Executive Council of Physical Therapy and Occupational Therapy
710710 Examiners.
711711 (g) In accordance with Section 411.087, the Executive
712712 Council of Physical Therapy and Occupational Therapy Examiners
713713 shall obtain criminal history record information from the Federal
714714 Bureau of Investigation identification division.
715715 (h) Criminal history record information obtained by the
716716 Federal Bureau of Investigation shall not be disseminated.
717717 ARTICLE 15. HEALTH AND HUMAN SERVICES
718718 SECTION 15.01. Section 411.110, Government Code, is amended
719719 to read as follows:
720720 Sec. 411.110. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
721721 DEPARTMENT OF STATE HEALTH SERVICES AND HEALTH AND HUMAN SERVICES
722722 COMMISSION. (a) The Department of State Health Services and the
723723 Health and Human Services Commission are entitled to obtain from
724724 the department criminal history record information maintained by
725725 the department that relates to a person who is required to be
726726 fingerprinted and:
727727 (1) the a person who is:
728728 (A) an applicant for a license or certificate
729729 under the Emergency Health Care Act (Chapter 773,
730730 Health and Safety Code);
731731 (B) an owner or manager of an applicant for an
732732 emergency medical services provider license under
733733 that Act; or
734734 (C) the holder of a license or certificate under
735735 that Act;
736736 (2) is an applicant for a license or a license holder
737737 under Subchapters I, L or N, Chapter 431, Health and
738738 Safety Code;
739739 (3) is an applicant for employment at or current
740740 employee of:
741741 (A) a public health hospital as defined by Section
742742 13.033, Health and Safety Code; or
743743 (B) the South Texas Health Care System;
744744 (4) is an applicant for employment at, current employee
745745 of, or person who contracts or may contract to provide goods
746746 or services with the Council on Sex Offender Treatment or
747747 other division or component of the Health and Human Services
748748 Commission that monitors sexually violent predators as
749749 described by Section 841.003(a), Health and Safety Code; or
750750 (5) is a person authorized to access vital records or
751751 the vital records electronic registration system under
752752 Chapter 191, Health and Safety Code, including an employee of
753753 or contractor for the Department of State Health Services, a
754754 local registrar, a medical professional, or a funeral
755755 director.; or
756756 (6) is an applicant for a license or a license holder
757757 under Subchapter C, Chapter 443, Health and Safety Code.
758758 (b) Texas Ccriminal history record information obtained by
759759 the Department of State Health Services or the Health and Human
760760 Services Commission under Subsection (a) may not be released or
761761 disclosed to any person except:
762762 (1) on court order,
763763 (2) with the written consent of the person or entity
764764 that is the subject of the criminal history record information,
765765 (3) by either the Department of State Health Services or
766766 the Health and Human Services Commission that is sharing with the
767767 other agency information obtained under this section for the
768768 purposes authorized by this section; or
769769 (4)or as provided by Subsection (ec).
770770 (c) After an entity is licensed or certified, the Department
771771 of State Health Services or the Health and Human Services
772772 Commission, as applicable, shall destroy the criminal history
773773 record information that relates to that entity. The Department of
774774 State Health Services or the Health and Human Services Commission,
775775 as applicable, shall destroy the criminal history record
776776 information that relates to:
777777 (1) an applicant for employment after that applicant is
778778 employed or, for an applicant who is not employed, after the check
779779 of the criminal history record information on that applicant is
780780 completed; or
781781 (2) an employee or contractor after the check of the
782782 criminal history record information on that employee or contractor
783783 is completed.
784784 (d) The Department of State Health Services or the Health and
785785 Human Services Commission, as applicable, shall destroy criminal
786786 history record information that relates to an applicant who is not
787787 certified or employed, as applicable.
788788 (e) The Department of State Health Services or the Health and
789789 Human Services Commission is not prohibited from disclosing Texas
790790 criminal history record information obtained under Subsection (a)
791791 in a criminal proceeding or in a hearing conducted by the Department
792792 of State Health Services or the Health and Human Services
793793 Commission, as applicable.
794794 (f) The Department of State Health Services or the Health and
795795 Human Services Commission may not consider offenses described by
796796 Section 542.304, Transportation Code, to determine whether to hire
797797 or retain an employee or to contract with a person on whom criminal
798798 history record information is obtained under this section.
799799 (g) In accordance with Section 411.087 and consistent with
800800 the public policy of this state, the Department of State Health
801801 Services and the Health and Human Services Commission may obtain
802802 criminal history record information from the Federal Bureau of
803803 Investigation identification division.
804804 (h) Criminal history record information obtained by the
805805 Federal Bureau of Investigation shall not be disseminated.
806806 SECTION 15.02. Section 411.1103, Government Code, is amended
807807 to read as follows:
808808 Sec. 411.1103 ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
809809 DEPARTMENT OF STATE HEALTH SERVICES AND HEALTH AND HUMAN SERVICES
810810 COMMISSION AND PERSONNEL AT STATE HOSPITALS. (a) The Department of
811811 State Health Services and the Health and Human Services Commission
812812 isare entitled to obtain from the department as provided by
813813 Subsection (b) criminal history record information maintained by
814814 the department that relates to a person:
815815 (1) who is required to be fingerprinted and who is:
816816 (A) an applicant for employment at a state
817817 hospital established under Chapter 552, Health and Safety Code;
818818 (B) an employee of a state hospital established
819819 under Chapter 552, Health and Safety Code;
820820 (C) a person who contracts or may contract to
821821 provide goods or services to the Department of State Health
822822 Services or the Health and Human Services Commission, as
823823 applicable, at a state hospital established under Chapter 552,
824824 Health and Safety Code, or an employee of or applicant for
825825 employment with that person;
826826 (D) a volunteer with a state hospital established
827827 under Chapter 552, Health and Safety Code; or
828828 (E) an applicant for a volunteer position with a
829829 state hospital established under Chapter 552, Health and Safety
830830 Code; and
831831 (2) who is required to be fingerprinted and who would be
832832 placed in direct contact with a patient at a state hospital
833833 established under Chapter 552, Health and Safety Code.
834834 (b) Subject to Section 411.087 and consistent with the public
835835 policy of this state, the [Department of State Health Services and
836836 the] Health and Human Services Commission is [are] entitled to:
837837 (1) obtain through the Federal Bureau of Investigation
838838 criminal history record information maintained or indexed by that
839839 bureau that pertains to a person described by Subsection (a); and
840840 (2) obtain from any other criminal justice agency in
841841 this state criminal history record information maintained by that
842842 criminal justice agency that relates to a person described by
843843 Subsection (a).
844844 (b)(c)The Department of State Health Services or the Health
845845 and Human Services Commission may not release or disclose to any
846846 entity, public or private, criminal history record information
847847 obtained under Subsection (b)(1). Texas Ccriminal history record
848848 information obtained by the Department of State Health Services or
849849 the Health and Human Services Commission under Subsection (b)(2)
850850 this section may not be released or disclosed to any person except:
851851 (1) on court order;
852852 (2) with the consent of the person who is the subject of
853853 the criminal history record information;
854854 (3) for purposes of an administrative hearing held by
855855 the Department of State Health Services or the Health and Human
856856 Services Commission, as applicable, concerning the person who is
857857 the subject of the criminal history record information; or
858858 (4) as provided by Subsection (d)(c).
859859 (c)(d) The Department of State Health Services or the Health
860860 and Human Services Commission is not prohibited from releasing
861861 criminal history record information obtained under Subsection
862862 (d)(2)this section to the person who is the subject of the criminal
863863 history record information.
864864 (e) The Health and Human Services Commission shall destroy
865865 the criminal history record information that relates to:
866866 (1) an applicant for employment after that applicant is
867867 employed or, for an applicant who is not employed, after the check
868868 of the criminal history record information on that applicant is
869869 completed;
870870 (2) an employee or contractor after the check of the
871871 criminal history record information on that employee or contractor
872872 is completed; or
873873 (3) a volunteer after the check or the criminal history
874874 record information is completed.
875875 (e)(f) This section does not prohibit the Department of State
876876 Health Services or the Health and Human Services Commission from
877877 obtaining and using criminal history record information as provided
878878 by other law.
879879 SECTION 15.03. Section 411.1105, Government Code, is amended
880880 to read as follows:
881881 Sec. 411.1105 ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
882882 DEPARTMENT OF STATE HEALTH SERVICES AND HEALTH AND HUMAN SERVICES

888888 (1) an applicant for a chemical dependency counselor's
889889 license, a counselor intern's registration, or a clinical
890890 supervisor certification under Chapter 504, Occupations Code; or
891891 (2) the holder of a license, registration, or
892892 certification under that chapter.
893893 (b) Subject to Section 411.087 and consistent with the public
894894 policy of this state, the Health and Human Services Commission is
895895 entitled to:
896896 (1) obtain through the Federal Bureau of Investigation
897897 criminal history record information maintained or indexed by that
898898 bureau that pertains to a person described by Subsection (a); and
899899 (2) obtain from any other criminal justice agency in
900900 this state criminal history record information maintained by that
901901 criminal justice agency that relates to a person described by
902902 Subsection (a).
903903 (c) In addition to information obtained from the Federal
904904 Bureau of Investigation under Section 411.087 and consistent with
905905 the public policy of this state, the Department of State Health
906906 Services and the Health and Human Services Commission isare
907907 entitled to obtain information relating to the wanted persons
908908 status of an individual listed in Subsection (a).
909909 (c)(d) Criminal history record information obtained by the Health
910910 and Human Services Commission under Subsection (b)(1) may not be
911911 released or disclosed to any other person or entity, public or
912912 private. Criminal history record information obtained by the
913913 Department of State Health Services or theHealth and Human Services
914914 Commission under Subsection (b)(2)(a) may not be released or
915915 disclosed to any person or entity, public or private, except:
916916 (1) on court order,;
917917 (2) with the consent of the person who is the subject of
918918 the criminal history record information,; or
919919 (3) as provided by Subsection (e)(d).
920920 (e)(d) The Department of State Health Services or theHealth
921921 and Human Services Commission, as applicable, may provide the
922922 applicant or licensee with a copy of the person's criminal history
923923 record information obtained from the Department of Public Safety,
924924 Federal Bureau of Investigation identification division, or
925925 another law enforcement agency.
926926 (f) The Health and Human Services Commission shall destroy
927927 the criminal history record information that relates to:
928928 (1) an applicant for a chemical dependency counselor's
929929 license, a counselor intern's registration, or a clinical
930930 supervisor certification under Chapter 504, Occupations Code,
931931 under Subsection (a) (1) after the check of the criminal history
932932 record information on that applicant is completed; or
933933 (2) the holder of a license, registration, or
934934 certification under that chapter after the check of the criminal
935935 history record information on that holder is completed.
936936 (g) This section does not prohibit the Health and Human
937937 Services Commission from obtaining and using criminal history
938938 record information as provided by other law.
939939 SECTION 15.04. Section 411.1106, Government Code, is amended
940940 to read as follows:
941941 Sec. 411.1106. ACCESS TO CRIMINAL HISTORY RECORD
942942 INFORMATION: HEALTH AND HUMAN SERVICES COMMISSION. (a) In this
943943 section, "commission" means the Health and Human Services
944944 Commission.
945945 (b) The executive commissioner of the commission, or the
946946 executive commissioner's designee, is entitled to obtain from the
947947 department criminal history record information maintained by the
948948 department as provided by Subsection (c) that relates to a person
949949 who is required to be fingerprinted and who is:
950950 (1) an applicant for employment, an employee, a
951951 contractor, an applicant for a volunteer position, or a volunteer
952952 for a position in which the person, as an employee, contractor, or
953953 volunteer, would have access to sensitive personal or financial
954954 information, as determined by the executive commissioner, in:
955955 (A) the eligibility services division of the
956956 commission as established by Section 531.008(d); or
957957 (B) the commission's office of inspector general
958958 as established by Section 531.008(c)(2) and Subchapter C, Chapter
959959 531; or
960960 (C) the regulatory services division of the
961961 commission as established by Section 531.008(c)(3); or
962962 (2) an employee of the commission who has access
963963 to sensitive personal or financial information, as determined by
964964 the executive commissioner.
965965 (c) Subject to Section 411.087 and consistent with the public
966966 policy of this state, the commission is entitled to:
967967 (1) obtain through the Federal Bureau of Investigation criminal
968968 history record information maintained or indexed by that bureau
969969 that pertains to a person described by Subsection (b); and
970970 (2) obtain from any other criminal justice agency in this state
971971 criminal history record information maintained by that criminal
972972 justice agency that relates to a person described by Subsection
973973 (b).
974974 (c)(d) Criminal history record information obtained by the
975975 commission under Subsection (c)(1) may not be released or disclosed
976976 to any other person or entity, public or private. Criminal history
977977 record information obtained by the executive commissioner of the
978978 commission, or by the executive commissioner's designee, under
979979 Subsection (c)(2) [(b)] may not be released or disclosed, except:
980980 (1) if the information is in a public record at the time
981981 the information is obtained;
982982 (2) on court order;
983983 (3) to a criminal justice agency, upon request;
984984 (4) with the consent of the person who is the subject of
985985 the criminal history record information; or
986986 (5) as provided by Subsection (e) [(d)].
987987 (d)(e) The commission is not prohibited from disclosing
988988 criminal history record information obtained under Subsection
989989 (b)(2)(c)(2) in a criminal proceeding or in a hearing conducted by
990990 the commission.
991991 (e)(f) The commission shall destroy all criminal history
992992 record information obtained under Subsection (b)(c) as soon as
993993 practicable after the information is used for its authorized
994994 purpose.
995995 (f)(g) This section does not prohibit the commission from
996996 obtaining and using criminal history record information as provided
997997 by other law.
998998 SECTION 15.05. Section 411.1131, Government Code, is amended
999999 to read as follows:
10001000 Sec. 411.1131. ACCESS TO CRIMINAL HISTORY RECORD
10011001 INFORMATION: HEALTH AND HUMAN SERVICES COMMISSION. (a) The Health
10021002 and Human Services Commission is entitled to obtain from the
10031003 department as provided by Subsection (b) criminal history record
10041004 information maintained by the department that relates to a person
10051005 who is required to be fingerprinted and who is an applicant for a
10061006 staff position at an outdoor training program for children who are
10071007 deaf or hard of hearing conducted by a private entity through a
10081008 contract with the Health and Human Services Commission in
10091009 accordance with Section 81.013, Human Resources Code.
10101010 (b) Subject to Section 411.087 and consistent with the public
10111011 policy of this state, the Health and Human Services Commission is
10121012 entitled to:
10131013 (1) obtain through the Federal Bureau of Investigation
10141014 criminal history record information maintained or indexed by that
10151015 bureau that pertains to a person described by Subsection (a); and
10161016 (2) obtain from any other criminal justice agency in
10171017 this state criminal history record information maintained by that
10181018 criminal justice agency that relates to a person described by
10191019 Subsection (a).
10201020 (c) [(b)] Criminal history record information obtained
10211021 by the Health and Human Services Commission under Subsection (b)
10221022 [(a)] may be used only to evaluate an applicant for a staff position
10231023 at an outdoor training program for children who are deaf or hard of
10241024 hearing. The Health and Human Services Commission may release or
10251025 disclose the information obtained under Subsection (b)(2) to a
10261026 private entity described by Subsection (a) for that purpose.
10271027 (d) [(c)] The Health and Human Services Commission may
10281028 not release or disclose information obtained under Subsection
10291029 (b)(1) to any other person or entity, public or private. The Health
10301030 and Human Services Commission may not release or disclose
10311031 information obtained under Subsection (b)(2) [(a)], except on court
10321032 order or with the consent of the person who is the subject of the
10331033 criminal history record information, and shall destroy all criminal
10341034 history record information obtained under Subsection (b) [(a)]
10351035 after the information is used for its authorized purpose.
10361036 (e) This section does not prohibit the Health and Human
10371037 Services Commission from obtaining and using criminal history
10381038 record information as provided by other law.
10391039 SECTION 15.06. Section 411.114, Government Code, is amended
10401040 to read as follows:
10411041 Sec. 411.114 ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
10421042 DEPARTMENT OF FAMILY AND PROTECTIVE SERVICES AND HEALTH AND HUMAN
10431043 SERVICES COMMISSION. (a)(1) In this subsection:
10441044 (A) "Child," "child-care facility," "child-placing
10451045 agency," "facility," and "family home" have the meanings assigned
10461046 by Section 42.002, Human Resources Code.
10471047 (A-1) "Department of Family and Protective Services"
10481048 includes:
10491049 (i) the Department of Family and Protective
10501050 Services as authorized by Section 40.002, Human Resources Code; and
10511051 (ii) any person or entity acting as an authorized
10521052 agent of the Department of Family and Protective Services.
10531053 (B) "Elderly person" has the meaning assigned by
10541054 Section 48.002, Human Resources Code.
10551055 (D) "Person with a disability" has the meaning assigned
10561056 by Section 48.002, Human Resources Code.
10571057 (2) The Department of Family and Protective Services or
10581058 the Health and Human Services Commission, as applicable, shall
10591059 obtain from the department criminal history record information
10601060 maintained by the department that relates to a person who is:
10611061 (A) an applicant for a license, registration,
10621062 certification, or listing under Chapter 42, Human Resources Code;
10631063 (B) an owner, operator, or employee of or an
10641064 applicant for employment by a child-care facility, child-placing
10651065 agency, or family home licensed, registered, certified, or listed
10661066 under Chapter 42, Human Resources Code;
10671067 (C) a person 14 years of age or older who will be
10681068 regularly or frequently working or staying in a facility or family
10691069 home, other than a child in the care of the home or facility;
10701070 (D) an applicant selected for a position with the
10711071 Department of Family and Protective Services or the Health and
10721072 Human Services Commission, the duties of which include direct
10731073 delivery of protective services to children, elderly persons, or
10741074 persons with a disability;
10751075 (E) an employee of, an applicant for employment
10761076 with, or a volunteer or an applicant volunteer with a business
10771077 entity or person that contracts with the Department of Family and
10781078 Protective Services or the Health and Human Services Commission to
10791079 provide direct delivery of protective services to children, elderly
10801080 persons, or persons with a disability, if the person's duties or
10811081 responsibilities include direct contact with children, elderly
10821082 persons, or persons with a disability;
10831083 (F) a registered volunteer with the Department of
10841084 Family and Protective Services or the Health and Human Services
10851085 Commission;
10861086 (G) a person providing or applying to provide
10871087 in-home, adoptive, or foster care for children in the care of the
10881088 Department of Family and Protective Services or the Health and
10891089 Human Services Commission and other persons living in the residence
10901090 in which the child will reside;
10911091 (H) a Department of Family and Protective Services
10921092 employee or a Health and Human Services Commission employee who is
10931093 engaged in the direct delivery of protective services to children,
10941094 elderly persons, or persons with a disability;
10951095 (I) an alleged perpetrator in a report the
10961096 Department of Family and Protective Services or the Health and
10971097 Human Services Commission receives alleging that the person has
10981098 abused, neglected, or exploited a child, an elderly person, or a
10991099 person with a disability, provided that:
11001100 (i) the report alleges the person has engaged
11011101 in conduct that meets the applicable definition of abuse, neglect,
11021102 or exploitation under Chapter 261, Family Code, or Chapter 48,
11031103 Human Resources Code; and
11041104 (ii) the person is not also the victim of the
11051105 alleged conduct;
11061106 (J) a person providing child care for a child who
11071107 is in the care of the Department of Family and Protective Services
11081108 or the Health and Human Services Commission and who is or will be
11091109 receiving adoptive, foster, or in-home care;
11101110 (K) through a contract with a nonprofit management
11111111 center, an employee of, an applicant for employment with, or a
11121112 volunteer or an applicant volunteer with a nonprofit, tax-exempt
11131113 organization that provides any service that involves the care of or
11141114 access to a child, an elderly person, or a person with a disability;
11151115 or
11161116 (L) an applicant for a child-care administrator or
11171117 child-placing agency administrator license under Chapter 43, Human
11181118 Resources Code.
11191119 (3) In addition to the criminal history record
11201120 information the Department of Family and Protective Services or the
11211121 Health and Human Services Commission is required to obtain under
11221122 Subdivision (2), the Department of Family and Protective Services
11231123 or the Health and Human Services Commission, as applicable, is
11241124 entitled to obtain from the department criminal history record
11251125 information maintained by the department that relates to a person
11261126 who is:
11271127 (A) an applicant for a position with the
11281128 Department of Family and Protective Services or the Health and
11291129 Human Services Commission regardless of the duties of the position,
11301130 including a position described by Subdivision (2)(D);
11311131 (B) a Department of Family and Protective Services
11321132 employee or a Health and Human Services Commission employee
11331133 regardless of the duties of the employee's position, including an
11341134 employee described by Subdivision (2)(H);
11351135 (C) a volunteer or applicant volunteer with the
11361136 Department of Family and Protective Services or the Health and
11371137 Human Services Commission regardless of the duties to be performed,
11381138 including a registered volunteer;
11391139 (D) an employee of, an applicant for employment
11401140 with, or a volunteer or an applicant volunteer with an entity or
11411141 person that contracts with the Department of Family and Protective
11421142 Services or the Health and Human Services Commission, as
11431143 applicable, and has access to confidential information in that
11441144 department's or commission's records, if the employee, applicant,
11451145 volunteer, or applicant volunteer has or will have access to that
11461146 confidential information;
11471147 (E) a person living in the residence in which the
11481148 alleged victim of the report resides, including an alleged
11491149 perpetrator in a report described by Subdivision (2)(I);
11501150 (F) a person providing, at the request of the
11511151 child's parent, in-home care for a child who is the subject of a
11521152 report alleging the child has been abused or neglected;
11531153 (G) a person providing, at the request of the
11541154 child's parent, in-home care for a child only if the person gives
11551155 written consent to the release and disclosure of the information;
11561156 (H) a child who is related to the caretaker, as
11571157 determined under Section 42.002, Human Resources Code, or any other
11581158 person who resides in, is present in, or has unsupervised access to
11591159 a child in the care of a facility or family home;
11601160 (I) a relative of a child in the care of the
11611161 Department of Family and Protective Services or the Health and
11621162 Human Services Commission, as applicable, to the extent necessary
11631163 to comply with Section 162.007, Family Code;
11641164 (J) a person providing or applying to provide
11651165 in-home, adoptive, or foster care for children to the extent
11661166 necessary to comply with Subchapter B, Chapter 162, Family Code;
11671167 (K) a person who volunteers to supervise
11681168 visitation under Subchapter B, Chapter 263, Family Code;
11691169 (L) an employee of or volunteer at, or an
11701170 applicant for employment with or to be a volunteer at, an entity
11711171 that provides supervised independent living services to a young
11721172 adult receiving extended foster care services from the Department
11731173 of Family and Protective Services or the Health and Human Services
11741174 Commission, as applicable;
11751175 (M) a person 14 years of age or older who will be
11761176 regularly or frequently working or staying in a host home that is
11771177 providing supervised independent living services to a young adult
11781178 receiving extended foster care services from the Department of
11791179 Family and Protective Services or the Health and Human Services
11801180 Commission, as applicable;
11811181 (N) a volunteer or applicant volunteer with a
11821182 local affiliate in this state of Big Brothers Big Sisters of
11831183 America;
11841184 (O) a volunteer or applicant volunteer with an
11851185 organization that provides court-appointed volunteer advocates for
11861186 abused or neglected children; or
11871187 (P) an employee, volunteer, or applicant
11881188 volunteer of a children's advocacy center under Subchapter E,
11891189 Chapter 264, Family Code, including a member of the governing board
11901190 of a center.
11911191 (4) Subject to Section 411.087 and consistent with the
11921192 public policy of this state, the Department of Family and
11931193 Protective Services and the Health and Human Services Commission
11941194 are entitled to:
11951195 (A) obtain through the Federal Bureau of
11961196 Investigation criminal history record information maintained or
11971197 indexed by that bureau that pertains to a person who is required to
11981198 be fingerprinted and who is described by Subdivision (2) or (3); and
11991199 (B) obtain from any other criminal justice agency
12001200 in this state criminal history record information maintained by
12011201 that criminal justice agency that relates to a person described by
12021202 Subdivision (2) or (3). Law enforcement entities shall expedite the
12031203 furnishing of such information to Department of Family and
12041204 Protective Services workers or Health and Human Services Commission
12051205 workers, as applicable, to ensure prompt criminal background checks
12061206 for the safety of alleged victims and Department of Family and
12071207 Protective Services workers or Health and Human Services Commission
12081208 workers, as applicable.
12091209 (5) The Department of Family and Protective Services or
12101210 the Health and Human Services Commission may not use the authority
12111211 granted under this section to harass an employee or volunteer. The
12121212 commissioner of the Department of Family and Protective Services or
12131213 the executive commissioner of the Health and Human Services
12141214 Commission, as applicable, shall adopt rules to prevent the
12151215 harassment of an employee or volunteer through the request and use
12161216 of criminal records.
12171217 (6) Criminal history record information obtained by the
12181218 Department of Family and Protective Services or the Health and
12191219 Human Services Commission under this subsection may not be released
12201220 to any person except:
12211221 (A) on court order;
12221222 (B) with the consent of the person who is the
12231223 subject of the criminal history record information;
12241224 (C) for purposes of an administrative hearing held
12251225 by the Department of Family and Protective Services or the Health
12261226 and Human Services Commission, as applicable, concerning the person
12271227 who is the subject of the criminal history record information;
12281228 (D) as provided by Subdivision (7).
12291229 (7) Subject to Subdivision (8), the Department of
12301230 Family and Protective Services or the Health and Human Services
12311231 Commission, as applicable, is not prohibited from releasing
12321232 criminal history record information obtained under this subsection
12331233 to:
12341234 (A) the person who is the subject of the criminal
12351235 history record information;
12361236 (B) a child-placing agency listed in Subdivision
12371237 (2) that is seeking to verify or approve a foster or adoptive home
12381238 under procedures authorized by federal law;
12391239 (C) an adult who resides with an alleged victim of
12401240 abuse, neglect, or exploitation of a child, elderly person, or
12411241 person with a disability and who also resides with the alleged
12421242 perpetrator of that abuse, neglect, or exploitation if:
12431243 (i) the alleged perpetrator is the subject of
12441244 the criminal history record information; and
12451245 (ii) the Department of Family and Protective
12461246 Services or the Health and Human Services Commission, as
12471247 applicable, determines that the release of information to the adult
12481248 is necessary to ensure the safety or welfare of the alleged victim
12491249 or the adult; or
12501250 (D) an elderly person or a person with a
12511251 disability who is an alleged victim of abuse, neglect, or
12521252 exploitation and who resides with the alleged perpetrator of that
12531253 abuse, neglect, or exploitation if:
12541254 (i) the alleged perpetrator is the subject of
12551255 the criminal history record information; and
12561256 (ii) the Department of Family and Protective
12571257 Services or the Health and Human Services Commission, as
12581258 applicable, determines that the release of information to the
12591259 person is necessary to ensure the safety or welfare of the person.
12601260 (8) The Department of Family and Protective Services or
12611261 the Health and Human Services Commission may only release to a
12621262 person described by Subdivision (7)(B), (C), or (D) criminal
12631263 history record information that that department or commission
12641264 obtains from the Department of Public Safety's computerized
12651265 criminal history system.
12661266 (b) The failure or refusal to provide a complete set of
12671267 fingerprints or a complete name on request constitutes good cause
12681268 for dismissal or refusal to hire, as applicable, with regard to a
12691269 volunteer of or an employee or applicant for permanent or temporary
12701270 employment with the Department of Family and Protective Services or
12711271 the Health and Human Services Commission, as applicable, or a
12721272 facility, home, business, or other entity, if the volunteer
12731273 position, employment, or potential employment involves direct
12741274 interaction with or the opportunity to interact and associate with
12751275 children.
12761276 (c) The Department of Family and Protective Services or the
12771277 Health and Human Services Commission, as applicable, may charge an
12781278 organization or person that requests criminal history record
12791279 information under Subsection (a)(3) a fee in an amount necessary to
12801280 cover the costs of obtaining the information on the organization's
12811281 or person's behalf.
12821282 SECTION 15.07. Section 411.1142, Government Code, is amended
12831283 to read as follows:
12841284 Sec. 411.1142. ACCESS TO CRIMINAL HISTORY RECORD: EARLY
12851285 CHILDHOOD INTERVENTION PROGRAM WITHIN HEALTH AND HUMAN SERVICES
12861286 COMMISSION. (a) The Early Childhood Intervention program within the
12871287 Health and Human Services Commission, as established by Chapter 73,
12881288 Human Resources Code, is entitled to obtain criminal history record
12891289 information as provided by Subsection (b) [maintained by the
12901290 Department of Public Safety, the Federal Bureau of Investigation
12911291 identification division, or another law enforcement agency] that
12921292 relates to an employee or an applicant for permanent, temporary, or
12931293 consultative employment or for volunteer positions whose
12941294 employment or potential employment or volunteer position with the
12951295 program or a local provider involves the delivery of early
12961296 childhood intervention services or involves direct interactions
12971297 with or the opportunity to interact and associate with children.
12981298 (b) Subject to Section 411.087 and consistent with the public
12991299 policy of this state, the Health and Human Services Commission is
13001300 entitled to:
13011301 (1) obtain through the Federal Bureau of Investigation
13021302 criminal history record information maintained or indexed by that
13031303 bureau that pertains to a person described by Subsection (a) and who
13041304 is required to be fingerprinted; and
13051305 (2) obtain from any other criminal justice agency in
13061306 this state criminal history record information maintained by that
13071307 criminal justice agency that relates to a person described by
13081308 Subsection (a).
13091309 (c) Criminal history record information obtained by the
13101310 Health and Human Services Commission under Subsection (b)(1) may
13111311 not be released or disclosed to any other person or entity, public
13121312 or private. Criminal history record information obtained by the
13131313 Health and Human Services Commission under Subsection (b)(2) [(a)]
13141314 may not be released or disclosed to any person except:
13151315 (1) on court order; [,]
13161316 (2) with the consent of the person who is the subject of
13171317 the criminal history record information;
13181318 (3) as provided by Subsection (e) [(d)].
13191319 (d) [(c)] The Health and Human Services Commission shall
13201320 destroy criminal history record information that relates to a
13211321 person after the information is used for its authorized purpose.
13221322 (e) [(d)] The Health and Human Services Commission may
13231323 provide the applicant, employee, professional consultant, or
13241324 volunteer with a copy of the person's criminal history record
13251325 information obtained from the Department of Public Safety[, Federal
13261326 Bureau of Investigation identification division,] or another law
13271327 enforcement agency.
13281328 (f) [(e)] The failure or refusal to provide a complete set of
13291329 fingerprints or a complete name on request constitutes good cause
13301330 for dismissal or refusal to hire, as applicable, with regard to
13311331 program employees, professional consultants, and applicants for
13321332 permanent, temporary, or consultative employment or for volunteer
13331333 positions whose employment or potential employment or volunteer
13341334 position with the Health and Human Services Commission or a local
13351335 provider involves the delivery of early childhood intervention
13361336 services or involves direct interactions with or the opportunity to
13371337 interact and associate with children.
13381338 SECTION 15.08. Section 411.1143, Government Code is amended
13391339 to read as follows:
13401340 Sec. 411.1143. ACCESS TO CRIMINAL HISTORY RECORD
13411341 INFORMATION; AGENCIES OPERATING PART OF MEDICAL ASSISTANCE
13421342 PROGRAM. (a) The Health and Human Services Commission, an agency
13431343 operating part of the medical assistance program under Chapter 32,
13441344 Human Resources Code, or the office of inspector general
13451345 established under Chapter 531, Government Code, is entitled to
13461346 obtain from the department the criminal history record information
13471347 maintained by the department that relates to a provider under the
13481348 medical assistance program or a person applying to enroll as a
13491349 provider under the medical assistance program.
13501350 (b) Subject to Section 411.087 and consistent with the public
13511351 policy of this state, the Health and Human Services Commission and
13521352 the office of inspector general are entitled to:
13531353 (1) obtain through the Federal Bureau of Investigation
13541354 criminal history record information maintained or indexed by that
13551355 bureau that pertains to a person described Subsection (a) and who is
13561356 required to be fingerprinted; and
13571357 (2) obtain from any other criminal justice agency in
13581358 this state criminal history record information maintained by that
13591359 criminal justice agency that relates to a person described by
13601360 Subsection (a).
13611361 (c) [(a-1)] Criminal history record information the Health
13621362 and Human Services Commission [an agency] or the office of
13631363 inspector general is authorized to obtain under Subsection (a)
13641364 includes criminal history record information relating to:
13651365 (1) a person with a direct or indirect ownership or
13661366 control interest, as defined by 42 C.F.R. Section 455.101, in a
13671367 provider of five percent or more; and
13681368 (2) a person whose information is required to be
13691369 disclosed in accordance with 42 C.F.R. Part 1001.
13701370 (d) ([b]) Criminal history record information obtained by the
13711371 Health and Human Services Commission or the office of inspector
13721372 general under Subsection (b)(1) may not be released or disclosed to
13731373 any other person or entity, public or private. Criminal history
13741374 record information obtained by the Health and Human Services
13751375 Commission or the office of inspector general commission or an
13761376 agency under Subsection (b)(2) [(a)] may not be released or
13771377 disclosed to any person except in a criminal proceeding, in an
13781378 administrative proceeding, on court order, or with the consent of
13791379 the provider or applicant.
13801380 (e) The Health and Human Services Commission and the office
13811381 of inspector general shall destroy criminal history record
13821382 information obtained under this section after the information is
13831383 used for its authorized purpose.
13841384 (f) This section does not prohibit the Health and Human
13851385 Services Commission or the office of inspector general from
13861386 obtaining and using criminal history record information as provided
13871387 by other law.
13881388 SECTION 15.09. Section 411.1144, Government Code, is amended
13891389 to read as follows:
13901390 Sec. 411.1144 ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
13911391 HEALTH AND HUMAN SERVICES COMMISSION AND [AGENCIES WITH] EMPLOYEES,
13921392 CONTRACTORS, OR VOLUNTEERS AT STATE SUPPORTED LIVING CENTERS. (a)
13931393 The [Department of State Health Services and the] Health and Human
13941394 Services Commission is [are] entitled to obtain from the department
13951395 as provided by Subsection (b) criminal history record information
13961396 maintained by the department that relates to a person:
13971397 (1) who is required to be fingerprinted and who is:
13981398 (A) an applicant for employment with the Health
13991399 and Human Services Commission [agency];
14001400 (B) an employee of the Health and Human Services
14011401 Commission [agency];
14021402 (C) a volunteer with the Health and Human Services
14031403 Commission [agency];
14041404 (D) an applicant for a volunteer position with the
14051405 Health and Human Services Commission [agency];
14061406 (E) an applicant for a contract with the Health
14071407 and Human Services Commission [agency]; or
14081408 (F) a contractor of the Health and Human Services
14091409 Commission [agency]; and
14101410 (2) who is required to be fingerprinted and who would be
14111411 placed in direct contact with a resident or client of a state
14121412 supported living center, as defined by Section 555.001, Health and
14131413 Safety Code.
14141414 (b) [(d)] Subject to Section 411.087 and consistent with the
14151415 public policy of this state, the [Department of State Health
14161416 Services and the] Health and Human Services Commission is [are]
14171417 entitled to:
14181418 (1) obtain through the Federal Bureau of Investigation
14191419 criminal history record information maintained or indexed by that
14201420 bureau that pertains to a person described by Subsection (a); and
14211421 (2) obtain from any other criminal justice agency in
14221422 this state criminal history record information maintained by
14231423 that criminal justice agency that relates to a person
14241424 described by Subsection (a).
14251425 (c) [(b)] Criminal history record information obtained by the
14261426 Health and Human Services Commission under Subsection (b)(1) may
14271427 not be released or disclosed to any other person or entity, public
14281428 or private. Criminal history record information obtained by the
14291429 Health and Human Services Commission [an agency] under Subsection
14301430 (b)(2) [(a)] may not be released or disclosed to any person except:
14311431 (1) on court order;
14321432 (2) with the consent of the person who is the subject of
14331433 the criminal history record information;
14341434 (3) for purposes of an administrative hearing held by
14351435 the agency concerning the person who is the subject of the criminal
14361436 history record information;
14371437 (4) as provided by Subsection (d) [(c)].
14381438 (d) [(c)] The Health and Human Services Commission is
14391439 prohibited from releasing criminal history record information
14401440 obtained under Subsection (b)(1) to the person who is the subject of
14411441 the criminal history record information. The Health and Human
14421442 Services Commission [An agency] is not prohibited from releasing
14431443 criminal history record information obtained under Subsection
14441444 (b)(2) [(a) or (d)] to the person who is the subject of the criminal
14451445 history record information.
14461446 (e) The Health and Human Services Commission shall destroy
14471447 criminal history record information that is obtained under this
14481448 section after the information is used for its authorized purpose.
14491449 (f) [(e)] This section does not prohibit an agency from
14501450 obtaining and using criminal history record information as provided
14511451 by other law.
14521452 SECTION 15.10. Sec. 411.115. ACCESS TO CRIMINAL HISTORY
14531453 RECORD INFORMATION: DEPARTMENT OF STATE HEALTH SERVICES AND HEALTH
14541454 AND HUMAN SERVICES COMMISSION; LOCAL AUTHORITIES; COMMUNITY
14551455 CENTERS. (a) In this section, "local mental health authority,"
14561456 "local intellectual and developmental disability authority," and
14571457 "community center" have the meanings assigned by Section 531.002,
14581458 Health and Safety Code.
14591459 (b) The Department of State Health Services, the Health and
14601460 Human Services Commission, a local mental health or intellectual
14611461 and developmental disability authority, or a community center, as
14621462 applicable, is entitled to obtain from the department as provided
14631463 by Subsection (c) criminal history record information maintained by
14641464 the department that relates to a person:
14651465 (1) who is:
14661466 (A) an applicant for employment with the
14671467 Department of State Health Services, the Health and Human Services
14681468 Commission, a local mental health or intellectual and developmental
14691469 disability authority, or a community center;
14701470 (B) an employee of the Department of State Health
14711471 Services, the Health and Human Services Commission, a local mental
14721472 health or intellectual and developmental disability authority, or a
14731473 community center;
14741474 (C) an applicant for employment with or an
14751475 employee of a business or person that contracts with the Department
14761476 of State Health Services, the Health and Human Services Commission,
14771477 a local mental health or intellectual and
14781478 developmental disability authority, or a
14791479 community center to provide residential services to patients with
14801480 mental illness or clients with an intellectual or developmental
14811481 disability who were furloughed or discharged from a Department of
14821482 State Health Services facility, a Health and Human Services
14831483 Commission facility, or a community center, as applicable;
14841484 (D) a volunteer with the Department of State Health
14851485 Services, the Health and Human Services Commission, a local mental
14861486 health or intellectual and developmental disability authority, or a
14871487 community center; or
14881488 (E) a volunteer applicant; and
14891489 (2) who would be placed in direct contact with patients
14901490 with mental illness or clients with an intellectual or
14911491 developmental disability.
14921492 (c) Subject to Section 411.087 and consistent with the public
14931493 policy of this state, the Department of State Health Services, the
14941494 Health and Human Services Commission, a local mental health or
14951495 intellectual and developmental disability authority, or a
14961496 community center, as applicable, is entitled to:
14971497 (1) obtain through the Federal Bureau of Investigation
14981498 criminal history record information maintained or indexed by that
14991499 bureau that pertains to a person described Subsection (b) and who is
15001500 required to be fingerprinted; and
15011501 (2) obtain from any other criminal justice agency in
15021502 this state criminal history record information maintained by that
15031503 criminal justice agency that relates to a person described by
15041504 Subsection (b).
15051505 (d) Criminal history record information obtained by the
15061506 Department of State Health Services, the Health and Human Services
15071507 Commission, a local mental health or intellectual and
15081508 developmental disability authority, or a community center, as
15091509 applicable, under Subsection (c)(1) may not be released or
15101510 disclosed to any other person or entity, public or private.
15111511 Criminal history record information obtained by the Department of
15121512 State Health Services, the Health and Human Services Commission, a
15131513 local mental health or intellectual and developmental disability
15141514 authority, or a community center under Subsection (c)(2) [(b)] may
15151515 not be released or disclosed to a person, other than the contractor
15161516 that employs the person who is the subject of the criminal history
15171517 record information, except on court order or with the consent of the
15181518 person who is the subject of the criminal history record
15191519 information.
15201520 (e) The Department of State Health Services, the Health and
15211521 Human Services Commission, a local mental health or intellectual
15221522 and developmental disability authority, or a community center, as
15231523 applicable, shall collect and destroy criminal history record
15241524 information that relates to a person immediately after making an
15251525 employment decision or taking a personnel action relating to the
15261526 person who is the subject of the criminal history record
15271527 information.
15281528 (f) This section does not prohibit the Department of State
15291529 Health Services, the Health and Human Services Commission, a local
15301530 mental health or intellectual and developmental disability
15311531 authority, or a community center, as applicable, from obtaining and
15321532 using criminal history record information as provided by other law.
15331533 SECTION 15.11. Subchapter F, Chapter 411, Government Code, is
15341534 amended by adding Section 411.1161 to read as follows:
15351535 Section 411.1161. ACCESS TO CRIMINAL HISTORY RECORD
15361536 INFORMATION: HEALTH AND HUMAN SERVICES COMMISSION AND NURSE AIDE
15371537 CERTIFICATION, MEDICATION AIDE PERMIT, AND NURSING FACILITY
15381538 ADMINISTRATOR LICENSE. (a) The Health and Human Services Commission
15391539 is entitled to obtain as provided by Subsection (d) criminal
15401540 history record information that relates to a person who is required
15411541 to be fingerprinted and who is an initial or renewal applicant for:
15421542 (1) a nurse aide certification with inclusion in the
15431543 nurse aide registry established under Chapter 250, Health and
15441544 Safety Code;
15451545 (2) a medication aide permit issued under Chapter 142,
15461546 Health and Safety Code; or
15471547 (3) a nursing facility administrator license issued
15481548 under Chapter 242, Health and Safety Code.
15491549 (b) Subject to Section 411.087 and consistent with the public
15501550 policy of this state, the Health and Human Services Commission is
15511551 entitled to:
15521552 (1) obtain through the Federal Bureau of Investigation
15531553 criminal history record information maintained or indexed by that
15541554 bureau that pertains to a person described by Subsection (a); and
15551555 (2) obtain from any other criminal justice agency in
15561556 this state criminal history record information maintained by that
15571557 criminal justice agency that relates to a person described by
15581558 Subsection (a).
15591559 (c) Criminal history record information obtained by the
15601560 Health and Human Services Commission under Subsection (b)(1) may
15611561 not be released or disclosed to any other person or entity, public
15621562 or private. Criminal history record information obtained
15631563 by the Health and Human Services Commission under Subsection (b)(2)
15641564 may not be released or disclosed to any person except:
15651565 (1) on court order;
15661566 (2) with the consent of the person who is the subject of
15671567 the criminal history record information;
15681568 (3) for purposes of an administrative hearing held by
15691569 the Health and Human Services Commission concerning the person who
15701570 is the subject of the criminal history record information;
15711571 (4) as provided by Subsection (d).
15721572 (d) The Health and Human Services Commission is prohibited
15731573 from releasing criminal history record information obtained under
15741574 Subsection (b)(1) to the person who is the subject of the criminal
15751575 history record information. The Health and Human Services
15761576 Commission is not prohibited from releasing criminal history record
15771577 information obtained under Subsection (b)(2) to the person who is
15781578 the subject of the criminal history record information.
15791579 (f) The Health and Human Services Commission shall destroy
15801580 criminal history record information that is obtained under this
15811581 section after the information is used for its authorized purpose.
15821582 (g) This section does not prohibit the Health and Human
15831583 Services Commission from obtaining and using criminal history
15841584 record information as provided by other law.
15851585 SECTION 12. Sec. 411.13861. ACCESS TO CRIMINAL HISTORY RECORD
15861586 INFORMATION: HEALTH AND HUMAN SERVICES COMMISSION. (a) The Health
15871587 and Human Services Commission is entitled to obtain from the
15881588 Department of Public Safety as provided by
15891589 Subsection (b) criminal history record information maintained by
15901590 the Department of Public Safety that relates to a person:
15911591 (1) required to undergo a background and criminal
15921592 history check under Chapter 248A, Health and Safety Code;
15931593 (2) who seeks unsupervised visits with a ward of the
15941594 Health and Human Services Commission, including a relative of the
15951595 ward;
15961596 (3) who is an applicant for employment with the Health
15971597 and Human Services Commission for a position in which the person, as
15981598 an employee, would have direct access to residents or clients of a
15991599 facility regulated by the Health and Human Services Commission, as
16001600 determined by the executive commissioner of that commission; or
16011601 (4) who is an employee of the Health and Human Services
16021602 Commission and who has direct access to residents or clients of a
16031603 facility regulated by that commission, as determined by the
16041604 executive commissioner of that commission.
16051605 (b) Subject to Section 411.087 and consistent with the public
16061606 policy of this state, the Health and Human Services Commission is
16071607 entitled to:
16081608 (1) obtain through the Federal Bureau of Investigation
16091609 criminal history record information maintained or indexed by that
16101610 bureau that pertains to a person described by Subsection (a) and who
16111611 is required to be fingerprinted; and
16121612 (2) obtain from any other criminal justice agency in
16131613 this state criminal history record information maintained by that
16141614 criminal justice agency that relates to a person described by
16151615 Subsection (a).
16161616 (c) [(b)] Criminal history record information obtained under
16171617 Subsection (a) is for the exclusive use of the Health and Human
16181618 Services Commission and is privileged and confidential.
16191619 (d) [(c)] Criminal history record information obtained by the
16201620 Health and Human Services Commission under Subsection (b)(1) may
16211621 not be released or disclosed to any other person or entity, public
16221622 or private. Criminal history record information obtained by the
16231623 Health and Human Services Commission under Subsection (b)(2) [(a)]
16241624 may not be released or disclosed to any person or agency except on
16251625 court order or with the consent of the person who is the subject of
16261626 the information. The Health and Human Services Commission may
16271627 destroy the criminal history record information after the
16281628 information is used for the purposes authorized by this section.
16291629 (e) [(d)] This section does not prohibit the Health and Human
16301630 Services Commission from obtaining and using criminal history
16311631 record information as provided by other law.
16321632 (f) [(e)] In this section, "ward" has the meaning assigned by
16331633 Section 1002.030, Estates Code.
16341634 (g) [(f)] Notwithstanding Subsection (d) [(c)], the Health
16351635 and Human Services Commission shall destroy information obtained
16361636 under Subsection (a)(3) or (4) after the information is used for the
16371637 purposes authorized by this section.
16381638 SECTION 13. Sec. 411.1387. ACCESS TO CRIMINAL HISTORY RECORD
16391639 INFORMATION: FACILITY, REGULATORY AGENCY, OR PRIVATE AGENCY. (a) In
16401640 this section, "facility," "regulatory agency," and "private
16411641 agency" have the meanings assigned by Section 250.001, Health and
16421642 Safety Code.
16431643 (b) A regulatory agency is entitled to obtain from the
16441644 department as provided by Subsection (c) criminal history record
16451645 information maintained by the department that relates to a person
16461646 who is:
16471647 (1) an applicant for employment at or an employee
16481648 of a facility other than a facility licensed under Chapter
16491649 142, Health and Safety Code; or
16501650 (2) an applicant for employment at or an employee
16511651 of a facility licensed under Chapter 142, Health and Safety
16521652 Code, if the duties of employment involve direct contact with
16531653 a consumer in the facility.
16541654 (c) Subject to Section 411.087 and consistent with the public
16551655 policy of this state, a regulatory agency is entitled to:
16561656 (1) obtain through the Federal Bureau of Investigation
16571657 criminal history record information maintained or indexed by that
16581658 bureau that pertains to a person described by Subsection (a) and who
16591659 is required to be fingerprinted; and
16601660 (2) obtain from any other criminal justice agency in
16611661 this state criminal history record information maintained by that
16621662 criminal justice agency that relates to a person described by
16631663 Subsection (a).
16641664 (d) [(b-1)] A facility or a private agency on behalf of a
16651665 facility is entitled to obtain from the department as provided by
16661666 Subsection (e) criminal history record information maintained by
16671667 the department that relates to a person who is:
16681668 (1) an applicant for employment with, an employee of, or
16691669 a volunteer with the facility;
16701670 (2) an applicant for employment with or an employee of a
16711671 person or business that contracts with the facility; or
16721672 (3) a student enrolled in an educational program or
16731673 course of study who is at the facility for educational purposes.
16741674 (e) Subject to Section 411.087 and consistent with the public
16751675 policy of this state, a facility or a private agency on behalf of a
16761676 facility is entitled to:
16771677 (1) obtain through the Federal Bureau of Investigation
16781678 criminal history record information maintained or indexed by that
16791679 bureau that pertains to a person described by Subsection (a) and who
16801680 is required to be fingerprinted; and
16811681 (2) obtain from any other criminal justice agency in
16821682 this state criminal history record information maintained by that
16831683 criminal justice agency that relates to a person described by
16841684 Subsection (a).
16851685 (f) [(c)] A facility may:
16861686 (1) obtain directly from the department criminal history
16871687 record information on a person described by Subsection (d) [(b-1)];
16881688 or
16891689 (2) authorize a private agency to obtain that information
16901690 from the department.
16911691 (g) [(d)] A private agency obtaining criminal history record
16921692 information on behalf of a facility under Subsection (c) shall
16931693 forward the information received to the facility requesting the
16941694 information.
16951695 (h) [(e)] Criminal history record information obtained by a
16961696 facility or regulatory agency under Subsections (c)(1) and (e)(1)
16971697 may not be released or disclosed to any other person or entity,
16981698 public or private. Criminal history record information obtained by
16991699 a facility, regulatory agency, or private agency on behalf of a
17001700 facility under Subsections (c)(2) and (e)(2) [(b) or (b-1)] may not
17011701 be released or disclosed to any person or agency except on court
17021702 order or with the consent of the person who is the subject of the
17031703 information.
17041704 (i) Criminal history record information obtained by a
17051705 facility, regulatory agency, or private agency on behalf of a
17061706 facility under this section shall be destroyed after the
17071707 information is used for its authorized purpose.
17081708 (j) This section does not prohibit a facility, regulatory
17091709 agency, or private agency on behalf of a facility from obtaining and
17101710 using criminal history record information as provided by other law.
17111711 SECTION 15.14. To the extent of any conflict, this Act
17121712 prevails over another Act of the 86th Legislature, Regular Session,
17131713 2019, relating to nonsubstantive additions to and corrections in
17141714 enacted codes.
17151715 ARTICLE 16. TEXAS BOARD OF NURSING
17161716 Sec. 411.125. ACCESS TO CRIMINAL HISTORY RECORD
17171717 INFORMATION: TEXAS BOARD OF NURSING. The Texas Board of Nursing is
17181718 entitled to obtain from the department criminal history record
17191719 information maintained by the department that relates to a person
17201720 who:
17211721 (1) is an applicant for vocational, registered, or
17221722 advanced practice registered nurse licensure, or the holder of a
17231723 license issued by the board;
17241724 (2) has requested a determination of eligibility for a
17251725 license from the board; [or]
17261726 (3) is accepted for enrollment in a nursing educational
17271727 program that prepares the person for licensure as a vocational,
17281728 registered, or advanced practice registered nurse; or
17291729 (4) [(3)] is subject to investigation by the board in
17301730 connection with a complaint or formal charge against the person.
17311731 (b) Texas criminal history record information obtained by
17321732 the Texas Board of Nursing under Subsection (a) may not be released
17331733 or disclosed to any person except:
17341734 (1) as required under a court order;
17351735 (2) to a nursing board that is a member of the nurse
17361736 licensure compact under the Occupations Code Chapter 304;
17371737 (3) with the written consent of the person or entity
17381738 that is the subject of the criminal history record information; or
17391739 (4) as provided by Subsection (d).
17401740 (c) Criminal history record information obtained by the Texas
17411741 Board of Nursing shall be destroyed by the agency after a final
17421742 determination is made and all appeals are concluded in the matter
17431743 for which the information was obtained.
17441744 (d) The Texas Board of Nursing is not prohibited from
17451745 disclosing Texas criminal history record information obtained
17461746 under Subsection (a) in a criminal proceeding, a contested case
17471747 proceeding conducted by the State Office of Administrative
17481748 Hearings, or as part of an appeal of a contested case proceeding.
17491749 (e) In addition to the information to which the board is
17501750 entitled under Section 411.125 and this section, the board may
17511751 request and receive criminal history record information from the
17521752 Federal Bureau of Investigation in accordance with Section 411.087.
17531753 (f) Criminal history record information obtained by the
17541754 Federal Bureau of Investigation shall not be disseminated.
17551755 Sec. 301.2511. CRIMINAL HISTORY RECORD INFORMATION FOR
17561756 LICENSE APPLICANTS.
17571757 (a) An applicant for a vocational, registered, or advanced
17581758 practice registered nurse license must submit to the board, in
17591759 addition to satisfying the other requirements of this subchapter, a
17601760 complete and legible set of fingerprints, on a form prescribed by
17611761 the board, for the purpose of obtaining criminal history record
17621762 information from the Department of Public Safety and the Federal
17631763 Bureau of Investigation.
17641764 (b) The board may deny a license to an applicant who does not
17651765 comply with the requirement of Subsection (a). Issuance of a
17661766 license by the board is conditioned on the board obtaining the
17671767 applicant's criminal history record information under this
17681768 section.
17691769 (c) The board by rule shall develop a system for obtaining
17701770 criminal history record information for a person accepted for
17711771 enrollment in a nursing educational program that prepares the
17721772 person for [initial] licenas a vocational, registered, or advanced
17731773 practice registered [or vocational] nurse by requiring the person
17741774 to submit to the board a set of fingerprints that meets the
17751775 requirements of Subsection (a). The board may develop a similar
17761776 system for an applicant for enrollment in a nursing educational
17771777 program. The board may require payment of a fee by a person who is
17781778 required to submit a set of fingerprints under this subsection.
17791779 ARTICLE 17. TEXAS BOARD OF VETERINARY MEDICAL EXAMINERS
17801780 Sec. 411.0995. ACCESS TO CRIMINAL HISTORY RECORD
17811781 INFORMATION: STATETEXAS BOARD OF VETERINARY MEDICAL EXAMINERS.
17821782 (a) The StateTexas Board of Veterinary Medical Examiners is
17831783 entitled to obtain from the department criminal history record
17841784 information maintained by the department that relates to a person
17851785 who is:
17861786 (1) an applicant for a license or certificate under the
17871787 Veterinary Licensing Act, Chapter 801 of the Texas Occupations
17881788 Code; or
17891789 (2) the holder of a license or certificate under that
17901790 chapterAct;
17911791 (3) an applicant for employment after that applicant is
17921792 employed or, for an applicant who is not employed, after the check
17931793 of the criminal history record information on that applicant is
17941794 completed; or
17951795 (4) an employee or contractor after the check of the
17961796 criminal history record information on that employee or contractor
17971797 is completed.
17981798 (b) Texas criminal history record information obtained by
17991799 the StateTexas Board of Veterinary of Medical Examiners under
18001800 Subsection (a) may not be released or disclosed to any person except
18011801 on court order, with the written consent of the person or entity
18021802 that is the subject of the criminal history record information, or
18031803 as provided by Subsection (e).
18041804 (c) After an individual is licensed or certified, the Texas
18051805 Board of Veterinary Medical Examiners, shall destroy the criminal
18061806 history record information that relates to that individual. The
18071807 Texas Board of Veterinary Medical Examiners shall destroy the
18081808 criminal history record information that relates to:
18091809 (d) The Texas Board of Veterinary Medical Examiners shall
18101810 destroy criminal history record information that relates to an
18111811 applicant who is not certified or employed, as applicable.
18121812 (e) The Texas Board of Veterinary Medical Examiners is not
18131813 prohibited from disclosing Texas criminal history record
18141814 information obtained under Subsection (a) in a criminal proceeding
18151815 or in a hearing conducted by the Texas Board of Veterinary Medical
18161816 Examiners.
18171817 (g) In accordance with Section 411.087 the Texas Board of
18181818 Veterinary Medical Examiners may obtain criminal history record
18191819 information from the Federal Bureau of Investigation
18201820 identification division.
18211821 (h) Criminal history record information obtained by the
18221822 Federal Bureau of Investigation shall not be disseminated.
18231823 ARTICLE 18. TEXAS DEPARTMENT OF INSURANCE
18241824 SECTION 18.01. Section 411.106, Government Code, is amended
18251825 to read as follows:
18261826 Sec. 411.106. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
18271827 TEXAS DEPARTMENT OF INSURANCE. (a) The Texas Department of
18281828 Insurance [for good cause shown] is entitled to obtain from the
18291829 department criminal history record information maintained by the
18301830 department that relates to a person who is:
18311831 (1) an applicant for a license, permit, certificate of
18321832 authority, certificate of registration, or other authorization
18331833 issued by the Texas Department [State Board] of Insurance to engage
18341834 in an activity regulated under the Insurance Code; or
18351835 (2) a corporate officer or director of an
18361836 insurance company regulated by the Texas Department of Insurance.
18371837 (b) Texas Ccriminal history record information obtained by
18381838 the Texas Department of Insurance under Subsection (a) may not be
18391839 disclosed or released to any person except on court order, [or] with
18401840 the written consent of the person who is the subject of the criminal
18411841 history record information, or as provided by Subsection(d).
18421842 (c) After the Texas Department of Insurance makes a
18431843 determination as to the issuance of a license or certificate of
18441844 authority to an applicant or as otherwise authorized by statute,
18451845 the Texas Department of Insurance shall destroy [seal] the criminal
18461846 history record information in its possession regarding the
18471847 applicant and shall deliver the information to the commissioner of
18481848 insurance or the commissioner’s designee, who shall maintain the
18491849 information as provided by State Board of Insurance rule.
18501850 (d) The Texas Department of Insurance is not prohibited from
18511851 disclosing Texas criminal history record information obtained
18521852 under Subsection (a) in a criminal proceeding or in a hearing
18531853 conducted by the Texas Department of Insurance.
18541854 (e) In accordance with Section 411.087, the Texas Department
18551855 of Insurance may obtain criminal history record information from
18561856 the Federal Bureau of Investigation identification division.
18571857 (f) The Texas Department of Insurance mayshall not
18581858 disseminate criminal history record information obtained from the
18591859 Federal Bureau of Investigation.
18601860 SECTION 17.02. Section 411.107, Government Code, is amended
18611861 to read as follows:
18621862 Sec. 411.107. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
18631863 RECEIVER. (a) In this section, “receiver” has the meaning assigned
18641864 by Section 443.004Article 21.280, Insurance Code.
18651865 (b) A receiver is entitled to obtain from the department
18661866 criminal history record information maintained by the department
18671867 that relates to a person who:
18681868 (1) is a creditor or claimant of the receivership
18691869 estate; or
18701870 (2) the receivership estate has a claim against [the
18711871 receiver believes is necessary for the investigation of any
18721872 matter relating to a receivership estate].
18731873 (c) Texas criminal history record information obtained
18741874 by a receiver under Subsection (b) may not be released or disclosed
18751875 to any person except on court order or with the written consent of
18761876 the person who is the subject of the criminal history record
18771877 information.
18781878 (d) A receiver shallmay destroy criminal history
18791879 record information obtained by the receiver under Subsection (b)
18801880 before termination of the receivership and the receiver’s discharge
18811881 [after the purpose for which the information was obtained is
18821882 accomplished].
18831883 (e) In accordance with Section 411.087, the receiver may
18841884 obtain criminal history record information from the Federal Bureau
18851885 of Investigation identification division.
18861886 (f) The receiver may not disseminate criminal history record
18871887 information obtained from the Federal Bureau of Investigation.
18881888 SECTION 18.03. Subchapter F, Chapter 411, Government Code,
18891889 is amended by adding Section 411.### to read as follows:
18901890 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
18911891 STATE FIRE MARSHAL. (a) The state fire marshal is entitled to obtain
18921892 from the department criminal history record information maintained
18931893 by the department that relates to a person who is an applicant for a
18941894 license or other authorization issued by the state fire marshal to
18951895 engage in an activity regulated under the Insurance Code or the
18961896 Occupations Code.
18971897 (b) Texas criminal history record information obtained by
18981898 the state fire marshal under Subsection (a) may not be disclosed or
18991899 released to any person except on court order, with the written
19001900 consent of the person who is the subject of the criminal history
19011901 record information, or as provided by Subsection(d).
19021902 (c) After the state fire marshal makes a determination as to
19031903 the issuance of a license or other authorization to an applicant as
19041904 provided by statute, the state fire marshal shall destroy the
19051905 criminal history record information in its possession regarding the
19061906 applicant.
19071907 (d) The state fire marshal is not prohibited from disclosing
19081908 criminal history record information obtained under Subsection (a)
19091909 in a criminal proceeding or in a hearing conducted by the state fire
19101910 marshal.
19111911 (e) In accordance with Section 411.087, the state fire
19121912 marshal may obtain criminal history record information from the
19131913 Federal Bureau of Investigation identification division.
19141914 (f) The state fire marshal may shall not disseminate criminal
19151915 history record information obtained from the Federal Bureau of
19161916 Investigation.
19171917 ARTICLE 19. TEXAS FUNERAL SERVICE COMMISSION
19181918 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
19191919 Texas Funeral Service Commission. (a) The Texas Funeral Service
19201920 Commission is entitled to obtain from the department criminal
19211921 history record information maintained by the department that
19221922 relates to:
19231923 (1) a person who is:
19241924 (A) an applicant for a license or certificate
19251925 under Sections 651.259(e) and 651.302(d), Occupations Code;
19261926 (B) the holder of a license or certificate under
19271927 that Act;
19281928 (2) an applicant for a license or a license holder
19291929 under Chapter 651, Occupations Code;
19301930 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
19311931 TEXAS FUNERAL SERVICE COMMISSION. (a) Texas Funeral Service
19321932 Commission is entitled to obtain from the department criminal
19331933 history record information maintained by the department that
19341934 relates to:
19351935 (1) a person who is:
19361936 (A) an applicant for a license or certificate
19371937 under the Occupations Code, Subtitle L. Crematory Services, Funeral
19381938 Directing, And Embalming (Chapter 651, Crematory Services, Funeral
19391939 Directing, And Embalming);
19401940 (B) the holder of a license or certificate under
19411941 that Act;
19421942 (2) an applicant for a license or a license holder
19431943 under Subchapter D, Subchapter F, Subchapter G, Subchapter H,
19441944 Subchapter I, Subchapter J, Subchapter K, and Subchapter N, Chapter
19451945 651, Occupations Code;
19461946 (3) an applicant for employment at or current employee
19471947 of:
19481948 (A) the Texas Funeral Service Commission
19491949 (4) a person authorized to access vital records or the
19501950 vital records electronic registration system under Chapter 191,
19511951 Health and Safety Code, or a funeral director.
19521952 (b) Criminal history record information obtained by the
19531953 Texas Funeral Service Commission under Subsection (a) may not be
19541954 released or disclosed to any person except on court order, with the
19551955 written consent of the person or entity that is the subject of the
19561956 criminal history record information, or as provided by Subsection
19571957 (e).
19581958 (c) After an entity is licensed or certified, the Texas
19591959 Funeral Service Commission shall destroy the criminal history
19601960 record information that relates to that entity. The Texas Funeral
19611961 Service Commission shall destroy the criminal history record
19621962 information that relates to:
19631963 (1) an applicant for employment after that applicant is
19641964 employed or, for an applicant who is not employed, after the check
19651965 of the criminal history record information on that applicant is
19661966 completed; or
19671967 (2) an employee or contractor after the check of the
19681968 criminal history record information on that employee or contractor
19691969 is completed.
19701970 (d) The Texas Funeral Service Commission shall destroy
19711971 criminal history record information that relates to an applicant
19721972 who is not certified or employed, as applicable.
19731973 (e) The Texas Funeral Service Commission is not prohibited
19741974 from disclosing criminal history record information obtained under
19751975 Subsection (a) in a criminal proceeding or in a hearing conducted by
19761976 the Texas Funeral Service Commission.
19771977 (f) The Texas Funeral Service Commission may not consider
19781978 offenses described by Section 542.304, Transportation Code, to
19791979 determine whether to hire or retain an employee or to contract with
19801980 a person on whom criminal history record information is obtained
19811981 under this section.
19821982 (g) Texas criminal history record information obtained by the
19831983 Texas Funeral Service Commission under Subsection (a) may not be
19841984 released or disclosed to any person except on court order, with the
19851985 written consent of the person or entity that is the subject of the
19861986 criminal history record information, or as provided by Subsection
19871987 (e).
19881988 (h) After an entity is licensed or certified, the Texas
19891989 Funeral Service Commission, shall destroy the criminal history
19901990 record information that relates to that entity. The Texas Funeral
19911991 Service Commission shall destroy the criminal history record
19921992 information that relates to:
19931993 (1) an applicant for employment after that applicant is
19941994 employed or, for an applicant who is not employed, after the check
19951995 of the criminal history record information on that applicant is
19961996 completed; or
19971997 (2) an employee or contractor after the check of the
19981998 criminal history record information on that employee or contractor
19991999 is completed.
20002000 (i) The Texas Funeral Service Commission shall destroy
20012001 criminal history record information that relates to an applicant
20022002 who is not certified or employed, as applicable.
20032003 (j) The Texas Funeral Service Commission is not prohibited
20042004 from disclosing criminal history record information obtained under
20052005 Subsection (a) in a criminal proceeding or in a hearing conducted by
20062006 the Texas Funeral Service Commission.
20072007 (k) In accordance with Section 411.087, the Texas Funeral
20082008 Service Commission shall obtain criminal history record
20092009 information from the Federal Bureau of Investigation
20102010 identification division.
20112011 (l) Criminal history record information obtained by the
20122012 Federal Bureau of Investigation shall not be disseminated.
20132013 ARTICLE 20. STATE BOARD FOR EDUCATOR CERTIFICATION AND TEXAS
20142014 EDUCATION AGENCY
20152015 Sec. 411.090. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
20162016 STATE BOARD FOR EDUCATOR CERTIFICATION. (a) The State Board for
20172017 Educator Certification is entitled to obtain from the department
20182018 any criminal history record information maintained by the
20192019 department about a person who has applied to the board for, or who
20202020 currently holds, a certificate under Subchapter B, Chapter 21,
20212021 Education Code.
20222022 (b) Texas criminal history record information obtained by the
20232023 board in the original form or any subsequent form:
20242024 (1) may be used only for a purpose related to the
20252025 issuance, denial, reprimand, suspension, revocation, or
20262026 cancellation of a certificate issued by the board;
20272027 (2) may not be released to any person except:
20282028 (A) the person who is the subject of the
20292029 information;
20302030 (B) the Texas Education Agency;
20312031 (C) a local or regional educational entity as
20322032 provided by Section 411.097; or
20332033 (D) by court order;
20342034 (3) is not subject to disclosure as provided by Chapter
20352035 552; and
20362036 (4) shall be destroyed by the board after the
20372037 information is used for the authorized purposes.
20382038 (c) The department shall notify the State Board for Educator
20392039 Certification of the arrest of any educator, as defined by Section
20402040 5.001, Education Code, who has fingerprints on file with the
20412041 department. Any record of the notification and any information
20422042 contained in the notification is not subject to disclosure as
20432043 provided by Chapter 552.
20442044 (d) The State Board for Educator Certification is not
20452045 prohibited from disclosing Texas criminal history record
20462046 information obtained under Subsection (a) in a criminal proceeding
20472047 or in a hearing conducted by the Texas Education Agency or State
20482048 Board for Educator Certification.
20492049 (e) In accordance with Section 411.087 the State Board for
20502050 Educator Certification shall obtain criminal history record
20512051 information from the Federal Bureau of Investigation
20522052 identification division.
20532053 (f) Criminal history record information obtained by the
20542054 Federal Bureau of Investigation shall not be disseminated.
20552055 Sec. 411.0901. ACCESS TO CRIMINAL HISTORY RECORD
20562056 INFORMATION: TEXAS EDUCATION AGENCY. (a) The Texas Education
20572057 Agency is entitled to obtain criminal history record information
20582058 maintained by the department about a person who:
20592059 (1) is employed or is an applicant for employment by
20602060 the Texas Education Agency; or
20612061 (2[1]) is employed or is an applicant for employment by
20622062 a school district or open-enrollment charter school;
20632063 (3) is subject to placement on the Registry of Persons
20642064 Not Eligible for Employment in Public Schools under Section 22.092,
20652065 Subchapter C-1, Chapter 22, Texas Education Code;
20662066 (4 [2]) is employed or is an applicant for employment
20672067 by a shared services arrangement, if the employee's or applicant's
20682068 duties are or will be performed on school property or at another
20692069 location where students are regularly present; or
20702070 (5 [3]) is employed or is an applicant for employment
20712071 by an entity that contracts or subcontracts with a school district,
20722072 open-enrollment charter school, or shared services arrangement, if
20732073 the applicant or employee has or will have continuing duties
20742074 related to the contracted or subcontracted services, and has or
20752075 will have direct contact with students; orif
20762076 (6) provides services as a tutor on behalf of a service
20772077 provider that offers accelerated or supplemental instruction under
20782078 Section 28.0211, Education Code if the tutor has or will have
20792079 continuing duties related to the services provided and has or will
20802080 have direct contact with students.
20812081 (A) the employee or applicant person has or will
20822082 have continuing duties relating to the contracted services
20832083 provided; and
20842084 (B) the employee or applicant person has or will
20852085 have direct contact with students.
20862086 (b) Texas criminal history record information obtained by
20872087 the agency in the original form or any subsequent form:
20882088 (1) may be used only for a purpose authorized by the
20892089 Education Code;
20902090 (2) may not be released to any person except:
20912091 (A) the person who is the subject of the
20922092 information;
20932093 (B) the State Board for Educator Certification;
20942094 (C) a local or regional educational entity as
20952095 provided by Section 411.097; or
20962096 (D) by court order;
20972097 (3) is not subject to disclosure as provided by Chapter
20982098 552; and
20992099 (4) shall be destroyed by the agency after the
21002100 information is used for the authorized purposes.
21012101 (c) The Texas Education Agency is not prohibited from
21022102 disclosing Texas criminal history record information obtained
21032103 under Subsection (a) in a criminal proceeding or in a hearing
21042104 conducted by the Texas Education Agency or State Board for Educator
21052105 Certification.
21062106 (d) In accordance with Section 411.087, the Texas Education
21072107 Agency shall obtain criminal history record information from the
21082108 Federal Bureau of Investigation identification division.
21092109 (e) Criminal history record information obtained by the
21102110 Federal Bureau of Investigation shall not be disseminated.
21112111 Sec. 411.097. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
21122112 LOCAL AND REGIONAL EDUCATIONAL ENTITIES. (a) A school district,
21132113 charter school, private school, regional education service center,
21142114 commercial transportation company, or education shared services
21152115 arrangement is entitled to obtain from the department criminal
21162116 history record information maintained by the department that the
21172117 district, school, service center, shared services arrangement, or
21182118 entity is required or authorized to obtain under Subchapter C,
21192119 Chapter 22, Education Code, that relates to a person who is:
21202120 (1) an applicant for employment by the district,
21212121 school, service center, or shared services arrangement;
21222122 (2) an employee of or an applicant for employment with
21232123 a public or commercial transportation company that contracts with
21242124 the district, school, service center, or shared services
21252125 arrangement to provide transportation services if the employee
21262126 drives or the applicant will drive a bus in which students are
21272127 transported or is employed or is seeking employment as a bus monitor
21282128 or bus aide on a bus in which students are transported; or
21292129 (3) an employee of or applicant for employment by an
21302130 entity that contracts to provide services to a school district,
21312131 charter school, or shared services arrangement as provided by
21322132 Section 22.0834or 22.08341, Education Code.; or
21332133 (4) an employee of or applicant for employment by a
21342134 subcontractor of an entity that contracts to provide services to a
21352135 school district, charter school, or shared services arrangement as
21362136 provided by Section 22.0834 or 22.08341, Education Code; or
21372137 (5) a tutor who provides services on behalf of a service
21382138 provider that offers accelerated or supplemental instruction under
21392139 Section 28.0211, Education Code.
21402140 (b) A school district, charter school, private school,
21412141 regional education service center, or education shared services
21422142 arrangement is entitled to obtain from the department criminal
21432143 history record information maintained by the department that the
21442144 district, school, service center, or shared services arrangement is
21452145 required or authorized to obtain under Subchapter C, Chapter 22,
21462146 Education Code, that relates to a person who is a volunteer, student
21472147 teacher, or employee of the district, school, service center, or
21482148 shared services arrangement.
21492149 (c) An open-enrollment charter school is entitled to obtain
21502150 from the department criminal history record information maintained
21512151 by the department that relates to a person who:
21522152 (1) is a member of the governing body of the school, as
21532153 defined by Section 12.1012, Education Code; or
21542154 (2) has agreed to serve as a member of the governing
21552155 body of the school.
21562156 (d) Texas criminal history record information obtained by a
21572157 school district, charter school, private school, service center,
21582158 commercial transportation company, or shared services arrangement
21592159 in the original form or any subsequent form:
21602160 (1) may not be released to any person except:
21612161 (A) the individual who is the subject of the
21622162 information;
21632163 (B) the Texas Education Agency;
21642164 (C) the State Board for Educator Certification;
21652165 (D) the chief personnel officer of the
21662166 transportation company, if the information is obtained under
21672167 Subsection (a)(2); or
21682168 (E) by court order;
21692169 (2) is not subject to disclosure as provided by Chapter
21702170 552; and
21712171 (3) shall be destroyed by the school district, charter
21722172 school, private school, service center, commercial transportation
21732173 company, or shared services arrangement on the earlier of:
21742174 (A) the first anniversary of the date the
21752175 information was originally obtained; or
21762176 (B) the date the information is used for the
21772177 authorized purpose.
21782178 (e) If a regional education service center or
21792179 commercial transportation company that receives criminal history
21802180 record information from the department under this section requests
21812181 the information by providing to the department a list, including
21822182 the name, date of birth, and any other personal descriptive
21832183 information required by the department for each person, through
21842184 electronic means, magnetic tape, or disk, as specified by the
21852185 department, the department may not charge the service center or
21862186 commercial transportation company more than the lesser of:
21872187 (1) the department's cost for providing the
21882188 information; or
21892189 (2) the amount prescribed by another law.
21902190 (f) An employee of a school district, charter school,
21912191 private school, regional education service center, commercial
21922192 transportation company, or education shared services arrangement
21932193 or an entity that contracts to provide services to a school
21942194 district, charter school, or shared services arrangement may
21952195 request from the employer a copy of any criminal history record
21962196 information relating to that employee that the employer has
21972197 obtained as provided by Subchapter C, Chapter 22, Education Code.
21982198 The employer may charge a fee to an employee requesting a copy of
21992199 the information in an amount not to exceed the actual cost of
22002200 copying the requested criminal history record information.
22012201 (g) A school district, charter school, private school,
22022202 regional education service center, commercial transportation
22032203 company, or education shared services arrangement is not prohibited
22042204 from disclosing Texas criminal history record information obtained
22052205 under Subsection (a) in a criminal proceeding or in a hearing
22062206 conducted by the Texas Education Agency or State Board for Educator
22072207 Certification.
22082208 (h) In accordance with Section 411.087 a school district,
22092209 charter school, regional education service center, commercial
22102210 transportation company, or education shared services arrangement
22112211 shall obtain criminal history record information from the Federal
22122212 Bureau of Investigation identification division.
22132213 (i) Criminal history record information obtained by the
22142214 Federal Bureau of Investigation shall not be disseminated.
22152215 411.XXXX ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
22162216 QUALIFIED SCHOOL CONTRACTORS
22172217 (a) In this section:
22182218 (1) "Qualified school contractor" is an entity that
22192219 (A) contracts or subcontracts to provide services
22202220 to a school district, charter school, or shared services
22212221 arrangement; and
22222222 (B) is determined eligible authorized by the
22232223 department to obtain criminal history pursuant to the National
22242224 Child Protection Act for an employee, applicant for employment, or
22252225 volunteer of the qualified school contractor.
22262226 (b) Texas Criminal history record information obtained by a
22272227 qualified school contractor in the original form or any subsequent
22282228 form:
22292229 (1) may not be released to any person except:
22302230 (A) to the individual who is the subject of the
22312231 information;
22322232 (B) or by court order;
22332233 (2) is not subject to disclosure as provided by Chapter
22342234 552; and
22352235 (3) shall be destroyed by qualified school contractor
22362236 on the earlier of:
22372237 (A) the first anniversary of the date the
22382238 information was originally obtained; or
22392239 (B) the date the information is used for the
22402240 authorized purpose.
22412241 (c) Criminal history record information obtained by the
22422242 Federal Bureau of Investigation shall not be disseminated.
22432243 (d) A qualified school contractor may provide a fitness
22442244 determination based on criminal history obtained under this section
22452245 to a school district, charter school, or shared services
22462246 arrangement.
22472247 (e) The department in coordination with the Commissioner of
22482248 Education may adopt rules necessary to implement this section.
22492249 Sec. 411.1405. ACCESS TO CRIMINAL HISTORY RECORD
22502250 INFORMATION: STATE AGENCIES; INFORMATION TECHNOLOGY EMPLOYEES.
22512251 (a) In this section:
22522252 (1) "Information resources" and "information resources
22532253 technologies" have the meanings assigned by Section 2054.003.
22542254 (2) "State agency" means a department, commission,
22552255 board, office, council, authority, or other agency in the
22562256 executive, legislative, or judicial branch of state government that
22572257 is created by the constitution or a statute of this state, including
22582258 a university system or institution of higher education as defined
22592259 by Section 61.003, Education Code.
22602260 (b) To the extent consistent with Subsection (e), a state
22612261 agency is entitled to obtain from the department the criminal
22622262 history record information maintained by the department that
22632263 relates to a person who:
22642264 (1) is an employee, applicant for employment,
22652265 contractor, subcontractor, or intern or other volunteer with the
22662266 state agency or with a contractor or subcontractor for the state
22672267 agency; and
22682268 (2) has access to information resources or information
22692269 resources technologies, other than a desktop computer or telephone
22702270 station assigned to that person.
22712271 (c) A state agency that obtains Texas criminal history
22722272 record information under this section may not release or disclose
22732273 the information or any documents or other records derived from the
22742274 information except:
22752275 (1) by court order;
22762276 (2) with the consent of the person who is the subject of
22772277 the information; or
22782278 (3) to the affected contractor or subcontractor,
22792279 unless the information was obtained by the department from the
22802280 Federal Bureau of Investigation.
22812281 (d) A state agency and the affected contractor or
22822282 subcontractor shall destroy criminal history record information
22832283 obtained under this section that relates to a person after the
22842284 information is used to make an employment decision or to take a
22852285 personnel action relating to the person who is the subject of the
22862286 information.
22872287 (e) A state agency may not obtain criminal history record
22882288 information under this section unless the state agency first adopts
22892289 policies and procedures that provide that evidence of a criminal
22902290 conviction or other relevant information obtained from the criminal
22912291 history record information does not automatically disqualify an
22922292 individual from employment. The attorney general shall review the
22932293 policies and procedures for compliance with due process and other
22942294 legal requirements before adoption by the state agency. The
22952295 attorney general may charge the state agency a fee to cover the cost
22962296 of the review. The policies and procedures adopted under this
22972297 subsection must provide that the hiring official will determine, on
22982298 a case-by-case basis, whether the individual is qualified for
22992299 employment based on factors that include:
23002300 (1) the specific duties of the position;
23012301 (2) the number of offenses committed by the individual;
23022302 (3) the nature and seriousness of each offense;
23032303 (4) the length of time between the offense and the
23042304 employment decision;
23052305 (5) the efforts by the individual at rehabilitation;
23062306 and
23072307 (6) the accuracy of the information on the individual's
23082308 employment application.
23092309 (f) A criminal history record information provision in
23102310 another law that is more specific to a state agency, including
23112311 Section 411.089, prevails over this section to the extent of any
23122312 conflict.
23132313 (g) A state agency is not prohibited from disclosing Texas
23142314 criminal history record information obtained under Subsection (a)
23152315 in a criminal proceeding.
23162316 (h) In accordance with Section 411.087, a state agency shall
23172317 obtain criminal history record information from the Federal Bureau
23182318 of Investigation identification division.
23192319 (i) Criminal history record information obtained by the
23202320 Federal Bureau of Investigation shall not be disseminated.
23212321 Sec. 22.0834. CRIMINAL HISTORY RECORD INFORMATION REVIEW OF
23222322 CERTAIN CONTRACT EMPLOYEES. (a) Except as provided by Subsection
23232323 (a-1), this subsection applies to a person who is not an applicant
23242324 for or holder of a certificate under Subchapter B, Chapter 21, and
23252325 who on or after January 1, 2008, is offered employment by an entity
23262326 or a subcontractor of an entity that contracts with a school
23272327 district, open-enrollment charter school, or shared services
23282328 arrangement to provide services, if:
23292329 (1) the employee or applicant has or will have
23302330 continuing duties related to the contracted services; and
23312331 (2) the employee or applicant has or will have direct
23322332 contact with students.
23332333 (a-1) This section does not apply to an employee or
23342334 applicant of a public works contractor if: contracting entity,
23352335 subcontracting entity, or other person subject to Section 22.08341.
23362336 (1) the public work does not involve the
23372337 construction, alteration, or repair of an instructional facility as
23382338 defined in 46.001;
23392339 (2) for public work that involves
23402340 construction of a new instructional facility, the person's duties
23412341 related to the contracted services will be completed not later than
23422342 the seventh day before the first date the facility will be used for
23432343 instructional purposes; or
23442344 (3) for a public work that involves an
23452345 existing instructional facility:
23462346 (A) the public work area contains
23472347 sanitary facilities and is separated from all areas used by
23482348 students by a secure barrier fence that is not less than six feet in
23492349 height; and
23502350 (B) the contracting entity adopts a
23512351 policy prohibiting employees, including subcontracting entity
23522352 employees, from interacting with students or entering areas used by
23532353 students, informs employees of the policy, and enforces the policy
23542354 at the public work area.
23552355 (b) If the contracting entity is a qualified school
23562356 contractor as defined under TX Gov. Code 411.XXXX, a A person to
23572357 whom Subsection (a) applies must submit to a national criminal
23582358 history record information review under this sectionby the
23592359 qualified school contractor before being employed or serving in a
23602360 capacity described by that subsection.
23612361 (b-1) If the contracting entity or subcontracting entity is
23622362 not a qualified school contractor, a person to whom Subsection (a)
23632363 applies must submit to a national criminal history record
23642364 information review by the school district, charter school, regional
23652365 education service center, commercial transportation company, or
23662366 education shared services arrangement.
23672367 (c) Before or immediately after employing or securing the
23682368 services of a person to whom Subsection (a) applies, the entity
23692369 qualified school contractor or contracting with a school district,
23702370 open-enrollment charter school, or shared services arrangement
23712371 shall send or ensure that the person sends to the department
23722372 information that is required by the department for obtaining
23732373 national criminal history record information, which may include
23742374 fingerprints and photographs. The department shall obtain the
23752375 person's national criminal history record information and report
23762376 the results through the criminal history clearinghouse as provided
23772377 by Section 411.0845, Government Code.
23782378 (d) An entity contracting withA qualified school
23792379 contractor or a school district, open-enrollment charter school, or
23802380 shared services arrangement shall obtain all criminal history
23812381 record information that relates to a person to whom Subsection (a)
23822382 applies through the criminal history clearinghouse as provided by
23832383 Section 411.0845, Government Code. The entity shall certify to the
23842384 school district that the entity has received all criminal history
23852385 record information relating to a person to whom Subsection (a)
23862386 applies.
23872387 (d-1) A qualified school contractor contracting entity
23882388 shall require that any of its subcontracting entities obtain all
23892389 criminal history record information that relates to an employee to
23902390 whom Subsection (a) applies if the subcontracting entity is also a
23912391 qualified school contractor.
23922392 (d-2) A qualified school contractor shall require that
23932393 any of its subcontracting entities that are not qualified school
23942394 contractors comply with Subsection (b-1) as it relates to an
23952395 employee to whom Subsection (a) applies.
23962396 (e) The requirements of subsection (b),(d-1), and (d-2)
23972397 do not apply to a qualified school contractor ifAa school
23982398 district, open-enrollment charter school, or shared services
23992399 arrangement may obtains the criminal history record information of
24002400 a person to whom this section applies through the criminal history
24012401 clearinghouse as provided by Section 411.0845, Government Code.
24022402 (f) In the event of an emergency, a school district may
24032403 allow a person to whom Subsection (a) or (g) applies to enter school
24042404 district property if the person is accompanied by a district
24052405 employee. A school district may adopt rules regarding an emergency
24062406 situation under this subsection.
24072407 (g) An entity that contracts with a school district,
24082408 open-enrollment charter school, or shared services arrangement to
24092409 provide services shall obtain from any law enforcement or criminal
24102410 justice agency or a private entity that is a consumer reporting
24112411 agency governed by the Fair Credit Reporting Act (15 U.S.C. Section
24122412 1681 et seq.), all criminal history record information that relates
24132413 to an employee of the entity who is employed before January 1, 2008,
24142414 and who is not subject to a national criminal history record
24152415 information review under Subsection (b) if:
24162416 (1) the employee has continuing duties related to
24172417 the contracted services; and
24182418 (2) the employee has direct contact with
24192419 students.
24202420 (h) A school district, open-enrollment charter school,
24212421 or shared services arrangement, or qualified school contractor may
24222422 obtain from any law enforcement or criminal justice agency all
24232423 criminal history record information that relates to a person to
24242424 whom this section Subsection (g) applies.
24252425 (i) An entity shall certify to a school district that
24262426 it has received all criminal history record information required by
24272427 Subsection (g).
24282428 (j) The commissioner may adopt rules as necessary to
24292429 implement this section.
24302430 (k) The requirements of this section apply to an entity
24312431 that contracts directly with a school district, open-enrollment
24322432 charter school, or shared services arrangement and any
24332433 subcontractor of the entity.
24342434 (l) A contracting entity shall require that a
24352435 subcontracting entity obtain all criminal history record
24362436 information that relates to an employee to whom Subsection (a)
24372437 applies. If a contracting or subcontracting entity determines that
24382438 Subsection (a) does not apply to an employee, the contracting or
24392439 subcontracting entity shall make a reasonable effort to ensure that
24402440 the conditions or precautions that resulted in the determination
24412441 that Subsection (a) did not apply to the employee continue to exist
24422442 throughout the time that the contracted services are provided.
24432443 (m) A contracting entity complies with the
24442444 requirements of this section if the contracting entity obtains a
24452445 written statement from each subcontracting entity certifying that
24462446 the subcontracting entity has obtained the required criminal
24472447 history record information for employees of the subcontracting
24482448 entity and the subcontracting entity has obtained certification
24492449 from each of the subcontracting entity's subcontractors.
24502450 (n) A subcontracting entity must certify to the school
24512451 district, open-enrollment charter school, or shared services
24522452 arrangement and the contracting entity that the subcontracting
24532453 entity has obtained all criminal history record information that
24542454 relates to an employee to whom Subsection (a) applies and has
24552455 obtained similar written certifications from the subcontracting
24562456 entity's subcontractors.
24572457 (o) A school district, charter school, regional
24582458 education service center, commercial transportation company, or
24592459 education shared services arrangement, qualified school
24602460 contractor, contracting or subcontracting entity may not permit an
24612461 employee to whom Subsection (a) applies to provide services at a
24622462 school if the employee has been convicted of a felony or misdemeanor
24632463 offense that would prevent a person from being employed under
24642464 Section 22.085(a).
24652465 (p) A qualified school contractor shall certify to the
24662466 school district that the entity has received all criminal history
24672467 record information relating to a person to whom Subsection (a)
24682468 applies.
24692469 (pq) In this section:
24702470 (1) "Contracting entity" means an entity that
24712471 contracts directly with a school district, open-enrollment charter
24722472 school, or shared services arrangement to provide services to the
24732473 school district, open-enrollment charter school, or shared
24742474 services arrangement.
24752475 (2) "Subcontracting entity" means an entity that
24762476 contracts with another entity that is not a school district,
24772477 open-enrollment charter school, or shared services arrangement to
24782478 provide services to a school district, open-enrollment charter
24792479 school, or shared services arrangement.
24802480 (3) “Qualified school contractor” has the same meaning
24812481 as defined in Tx Gov Code 411.XXXX
24822482 (4) “Public works contractor” means an entity that
24832483 contracts directly or subcontracts with an entity that contracts
24842484 with a school district, open-enrollment charter school, or shared
24852485 services arrangement to provide services to the school district,
24862486 open-enrollment charter school, or shared services arrangement.
24872487 Sec. 22.08341 REPEALED
24882488 Sec. 22.08341. CRIMINAL HISTORY RECORD INFORMATION REVIEW BY
24892489 CERTAIN PUBLIC WORKS CONTRACTORS. (a) In this section:
24902490 (1) "Contracting entity" means an entity that
24912491 contracts directly with a school district, open-enrollment charter
24922492 school, or shared services arrangement to provide engineering,
24932493 architectural, or construction services to the district, school, or
24942494 arrangement.
24952495 (2) "Instructional facility" has the meaning assigned
24962496 by Section 46.001.
24972497 (3) "Subcontracting entity" means an entity that
24982498 contracts with another entity that is not a school district,
24992499 open-enrollment charter school, or shared services arrangement to
25002500 provide engineering, architectural, or construction services to a
25012501 school district, open-enrollment charter school, or shared
25022502 services arrangement.
25032503 (b) This subsection applies to a person who is not an
25042504 applicant for or holder of a certificate under Subchapter B,
25052505 Chapter 21, and who is employed by a contracting or subcontracting
25062506 entity on a project to design, construct, alter, or repair a public
25072507 work if the person has or will have:
25082508 (1) continuing duties related to the contracted
25092509 services; and
25102510 (2) the opportunity for direct contact with students in
25112511 connection with the person's continuing duties.
25122512 (c) For purposes of Subsection (b), a person does not have
25132513 the opportunity for direct contact with students if:
25142514 (1) the public work does not involve the construction,
25152515 alteration, or repair of an instructional facility;
25162516 (2) for a public work that involves construction of a
25172517 new instructional facility, the person's duties related to the
25182518 contracted services will be completed not later than the seventh
25192519 day before the first date the facility will be used for
25202520 instructional purposes; or
25212521 (3) for a public work that involves an existing
25222522 instructional facility:
25232523 (A) the public work area contains sanitary
25242524 facilities and is separated from all areas used by students by a
25252525 secure barrier fence that is not less than six feet in height; and
25262526 (B) the contracting entity adopts a policy
25272527 prohibiting employees, including subcontracting entity employees,
25282528 from interacting with students or entering areas used by students,
25292529 informs employees of the policy, and enforces the policy at the
25302530 public work area.
25312531 (d) A contracting entity or subcontracting entity may not
25322532 permit an employee to whom Subsection (b) applies to provide
25332533 services at an instructional facility if the employee, during the
25342534 preceding 30 years, was convicted of any of the following offenses
25352535 and the victim was under 18 years of age or was enrolled in a public
25362536 school:
25372537 (1) a felony offense under Title 5, Penal Code;
25382538 (2) an offense on conviction of which a defendant is
25392539 required to register as a sex offender under Chapter 62, Code of
25402540 Criminal Procedure; or
25412541 (3) an offense under the laws of another state or
25422542 federal law that is equivalent to an offense under Subdivision (1)
25432543 or (2).
25442544 (e) For a person to whom Subsection (b) applies, the
25452545 contracting entity or subcontracting entity that employs the person
25462546 shall:
25472547 (1) send or ensure that the person sends to the
25482548 department information that is required by the department for
25492549 obtaining national criminal history record information, which may
25502550 include fingerprints and photographs;
25512551 (2) obtain all criminal history record information
25522552 that relates to the person through the criminal history
25532553 clearinghouse as provided by Section 411.0845, Government Code; and
25542554 (3) certify to the school district, open-enrollment
25552555 charter school, shared services arrangement, or contracting
25562556 entity, as applicable, that the contracting entity or
25572557 subcontracting entity that employs the person has received all
25582558 criminal history record information relating to the person.
25592559 (f) A contracting entity shall certify to the school
25602560 district, open-enrollment charter school, or shared services
25612561 arrangement, as applicable, that the contracting entity has
25622562 obtained written certifications from any subcontracting entity
25632563 that the subcontracting entity has complied with Subsection (e) as
25642564 it relates to the subcontracting entity's employees.
25652565 (g) On receipt of information described by Subsection
25662566 (e)(1), the department shall obtain the person's national criminal
25672567 history record information and report the results through the
25682568 criminal history clearinghouse as provided by Section 411.0845,
25692569 Government Code.
25702570 (h) A school district, open-enrollment charter school, or
25712571 shared services arrangement may directly obtain the criminal
25722572 history record information of a person to whom Subsection (b)
25732573 applies through the criminal history clearinghouse as provided by
25742574 Section 411.0845, Government Code.
25752575 (i) If a contracting entity or subcontracting entity
25762576 determines that Subsection (b) does not apply to an employee, the
25772577 contracting or subcontracting entity shall make a reasonable effort
25782578 to ensure that the conditions or precautions that resulted in the
25792579 determination that Subsection (b) does not apply to the employee
25802580 continue to exist throughout the time that the contracted services
25812581 are provided.
25822582 (j) In the event of an emergency, a school district,
25832583 open-enrollment charter school, or shared services arrangement may
25842584 allow a person to whom Subsection (b) applies to enter an
25852585 instructional facility if the person is accompanied by an employee
25862586 of the district, school, or arrangement. A school district,
25872587 open-enrollment charter school, or shared services arrangement may
25882588 adopt a policy regarding an emergency for purposes of this
25892589 subsection.
25902590 (k) The commissioner may adopt rules necessary to implement
25912591 this section.

25942594 Sec. 22.0835. ACCESS TO CRIMINAL HISTORY RECORDS OF STUDENT
25952595 TEACHERS AND VOLUNTEERS BY LOCAL AND REGIONAL EDUCATION
25962596 AUTHORITIES. (a) A school district, open-enrollment charter
25972597 school, or shared services arrangement shall obtain from the
25982598 department and may obtain from any other law enforcement or
25992599 criminal justice agency or a private entity that is a consumer
26002600 reporting agency governed by the Fair Credit Reporting Act (15
26012601 U.S.C. Section 1681 et seq.), all criminal history record
26022602 information that relates to:
26032603 (1) a person participating in an internship consisting
26042604 of student teaching to receive a teaching certificate; or
26052605 (2) a volunteer or person who has indicated, in
26062606 writing, an intention to serve as a volunteer with the district,
26072607 school, or shared services arrangement.
26082608 (b) A private school or regional education service center may
26092609 obtain from any law enforcement or criminal justice agency all
26102610 criminal history record information that relates to a person who
26112611 volunteers or has indicated, in writing, an intention to serve as a
26122612 volunteer with the school or service center.
26132613 (c) A person to whom Subsection (a) or (b) applies must
26142614 provide to the school district, open-enrollment charter school,
26152615 private school, regional education service center, or shared
26162616 services arrangement a driver's license or another form of
26172617 identification containing the person's photograph issued by an
26182618 entity of the United States government.
26192619 (d) A person to whom Subsection (a) applies may not perform
26202620 any student teaching or volunteer duties until all requirements
26212621 under Subsections (a) and (c) have been satisfied.
26222622 (e) Subsections (a) and (c) do not apply to a person who
26232623 volunteers or is applying to volunteer with a school district,
26242624 open-enrollment charter school, or shared services arrangement if
26252625 the person:
26262626 (1) is the parent, guardian, or grandparent of a child
26272627 who is enrolled in the district or school for which the person
26282628 volunteers or is applying to volunteer;
26292629 (2) will be accompanied by a school district employee
26302630 while on a school campus; or
26312631 (3) is volunteering for a single event on the school
26322632 campus.
26332633 (f) A school district, open-enrollment charter school, or
26342634 shared services arrangement may obtain from the department or any
26352635 law enforcement or criminal justice agency all criminal history
26362636 record information that relates to a person to whom Subsection (e)
26372637 applies.
26382638 (g) A school district, open-enrollment charter school,
26392639 private school, regional education service center, or shared
26402640 services arrangement may require a student teacher, volunteer, or
26412641 volunteer applicant to pay any costs related to obtaining criminal
26422642 history record information under this section.
26432643 Sec. 22.085. EMPLOYEES AND APPLICANTS CONVICTED OF OR PLACED
26442644 ON DEFERRED ADJUDICATION COMMUNITY SUPERVISION FOR CERTAIN
26452645 OFFENSES. (a) A school district, open-enrollment charter school,
26462646 or shared services arrangement shall discharge or refuse to hire an
26472647 employee or applicant for employment if the district, school, or
26482648 shared services arrangement obtains information through a criminal
26492649 history record information review that the employee or applicant
26502650 has been:
26512651 (1) convicted of or placed on deferred adjudication
26522652 community supervision for an offense for which a defendant is
26532653 required to register as a sex offender under Chapter 62, Code of
26542654 Criminal Procedure; or
26552655 (2) convicted of:
26562656 (A) a felony offense under Title 5, Penal Code, if
26572657 the victim of the offense was under 18 years of age at the time the
26582658 offense was committed; or
26592659 (B) an offense under the laws of another state or
26602660 federal law that is equivalent to an offense under Subdivision (1)
26612661 or Paragraph (A).
26622662 (b) Subsection (a) does not apply if the employee or
26632663 applicant for employment committed an offense under Title 5, Penal
26642664 Code and:
26652665 (1) the date of the offense is more than 30 years
26662666 before:
26672667 (A) the effective date of S.B. No. 9, Acts of the
26682668 80th Legislature, Regular Session, 2007, in the case of a person
26692669 employed by a school district, open-enrollment charter school, or
26702670 shared services arrangement as of that date; or
26712671 (B) the date the person's employment will begin,
26722672 in the case of a person applying for employment with a school
26732673 district, open-enrollment charter school, or shared services
26742674 arrangement after the effective date of S.B. No. 9, Acts of the 80th
26752675 Legislature, Regular Session, 2007; and
26762676 (2) the employee or applicant for employment satisfied
26772677 all terms of the court order entered on conviction.
26782678 (c) A school district, open-enrollment charter school, or
26792679 shared services arrangement may not allow a person who is an
26802680 employee of or applicant for employment by a qualified school
26812681 contractor or an entity that contracts with the district, school,
26822682 or shared services arrangement to serve at the district or school or
26832683 for the shared services arrangement if the district, school, or
26842684 shared services arrangement obtains information described by
26852685 Subsection (a) through a criminal history record information review
26862686 concerning the employee or applicant. A school district,
26872687 open-enrollment charter school, or shared services arrangement
26882688 must ensure that an entity that the district, school, or shared
26892689 services arrangement contracts with for services has obtained all
26902690 criminal history record information as required by Section 22.0834
26912691 or 22.08341.
26922692 (d) A school district, open-enrollment charter school,
26932693 private school, regional education service center, or shared
26942694 services arrangement may discharge an employee if the district or
26952695 school obtains information of the employee's conviction of a felony
26962696 or of a misdemeanor involving moral turpitude that the employee did
26972697 not disclose to the State Board for Educator Certification or the
26982698 district, school, service center, or shared services arrangement.
26992699 An employee discharged under this section is considered to have
27002700 been discharged for misconduct for purposes of Section 207.044,
27012701 Labor Code.
27022702 (e) The State Board for Educator Certification may impose a
27032703 sanction on an educator who does not discharge an employee or refuse
27042704 to hire an applicant for employment if the educator knows or should
27052705 have known, through a criminal history record information review,
27062706 that the employee or applicant has been:
27072707 (1) convicted of or placed on deferred adjudication
27082708 community supervision for an offense described by Subsection
27092709 (a)(1); or
27102710 (2) convicted of an offense described by Subsection
27112711 (a)(2).
27122712 (f) Each school year, the superintendent of a school
27132713 district or chief operating officer of an open-enrollment charter
27142714 school shall certify to the commissioner that the district or
27152715 school has complied with this section.
27162716 ARTICLE 21. TEXAS COMMISSION ON ENVIRONMENTAL QUALITY
27172717 SEC. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
27182718 TEXAS COMMISSION ON ENVIRONMENTAL QUALITY. (a) The Texas
27192719 Commission on Environmental Quality is entitled to obtain from the
27202720 Department criminal history record information maintained by the
27212721 department that relates to:
27222722 (1) a person who:
27232723 (A) is an applicant for a license or registration
27242724 under:
27252725 (i) Health and Safety Code Chapters 341, 361,
27262726 and 366;
27272727 (ii) Occupations Code Chapter 1903; or
27282728 (iii) Texas Water Code Chapters 37 and 26;
27292729 (B) is the holder of a license or registration
27302730 under the statutes listed in 411.###(1)(A); or
27312731 (C) requests a determination of eligibility for a
27322732 license or registration from the agency under the statutes listed
27332733 in 411.###(1)(A).
27342734 (b) Texas criminal history record information obtained by the
27352735 Texas Commission on Environmental Quality under Subsection (a) may
27362736 not be released or disclosed to any person except on court order,
27372737 with the written consent of the person that is the subject of the
27382738 criminal history record information, or as provided by Subsection
27392739 (d).
27402740 (c) After completion of the criminal history review or
27412741 proceeding for a person, for the purposes of a licensure or
27422742 registration, the Texas Commission on Environmental Quality shall
27432743 destroy the criminal history record information that relates to
27442744 that person.
27452745 (d) The Texas Commission on Environmental Quality is not
27462746 prohibited from disclosing criminal history record information
27472747 obtained under Subsection (a) in a criminal proceeding or in an
27482748 administrative proceeding conducted by:
27492749 (i) the Texas Commission on Environmental
27502750 Quality; or
27512751 (ii) the State Office of Administrative
27522752 Hearings.
27532753 (e) In accordance with Section 411.087, the Texas Commission
27542754 on Environmental Quality may obtain criminal history record
27552755 information from the Federal Bureau of Investigation
27562756 identification division.
27572757 (f) Criminal history record information obtained by the
27582758 Federal Bureau of Investigation shall not be disseminated.
27592759 ARTICLE 22. TEXAS RACING COMMISSION
27602760 SECTION 1. Section 411.096, Government Code, is amended to
27612761 read as follows:
27622762 Sec. 411.096. ACCESS TO CRIMINAL HISTORY RECORD
27632763 INFORMATION: TEXAS RACING COMMISSION. (a) The Texas Racing
27642764 Commission is entitled to obtain from the department criminal
27652765 history record information maintained by the department that
27662766 relates to [a person who is]:
27672767 (1) a person who is:
27682768 (A) an applicant for or the holder of a license
27692769 under Chapter 2025 of the Texas Occupations Code; or
27702770 (B) a controlling person, as defined in Chapter
27712771 2025 of the Texas Occupations Code, of an entity described therein;
27722772 (C) an owner or manager of an applicant for any
27732773 license promulgated under Chapter 2025 of the Texas Occupations
27742774 Code license under (A); or
27752775 (D) the holder of a license or certificate under
27762776 that Act; or
27772777 (2) a person who:
27782778 (A) is an applicant for or the holder of a license
27792779 under Chapter 2025 of the Texas Occupations Code; or
27802780 (B) has an interest described under Section
27812781 Chapter 2025 of the Texas Occupations Code, in an entity described
27822782 therein.
27832783 (3) an applicant for employment at or current
27842784 employee of:
27852785 (A) The Texas Racing Commissions defined by
27862786 Texas Occupations Code 2022; or
27872787 (B) employment within the Texas Racing
27882788 industry.
27892789 (4) an applicant for employment at, current
27902790 employee of, or person who contracts or may contract to provide
27912791 goods or services with the Texas Racing Commission that monitors
27922792 racing in Texasas described byTexas Occupations Code Chapter 2022.
27932793 (b) Texas criminal history record information obtained by
27942794 the Texas Racing Commission under Subsection (a) may not be
27952795 released or disclosed to any person except on court order, with the
27962796 written consent of the person or entity that is the subject of the
27972797 criminal history record information, or as provided by Subsection
27982798 (c).
27992799 (c) After an entity is licensed or certified, the Texas
28002800 Racing Commission shall destroy the criminal history record
28012801 information that relates to that entity. The Texas Racing
28022802 Commission shall destroy the criminal history record information
28032803 that relates to:
28042804 (1) an applicant for employment after that applicant is
28052805 employed or, for an applicant who is not employed, after the check
28062806 of the criminal history record information on that applicant is
28072807 completed; or
28082808 (2) an employee or contractor after the check of the
28092809 criminal history record information on that employee or contractor
28102810 is completed.
28112811 (d) The Texas Racing Commission shall destroy criminal
28122812 history record information that relates to an applicant who is not
28132813 certified or employed, as applicable.
28142814 (e) The Texas Racing Commission is not prohibited from
28152815 disclosing Texas criminal history record information obtained
28162816 under Subsection (a) in a criminal proceeding or in a hearing
28172817 conducted by the Texas Racing Commission or the State Office of
28182818 Administrative Hearings, as applicable.
28192819 (f) In accordance with Section 411.087, the Texas Racing
28202820 Commission shall obtain criminal history record information from
28212821 the Federal Bureau of Investigation identification division.
28222822 (g) Criminal history record information obtained by the
28232823 Federal Bureau of Investigation shall not be disseminated.
28242824 SECTION 2. Section 2025.251, Occupations Code, is amended to
28252825 read as follows:
28262826 Sec. 2025.251. OCCUPATIONAL LICENSE REQUIRED. (a) Except as
28272827 provided by this section, a person, other than as a spectator or as
28282828 a person placing a wager, may not participate in racing with
28292829 pari-mutuel racing activities or wagering without first obtaining a
28302830 license from the commission. A person may not engage in any
28312831 occupation for which commission rules require a license under this
28322832 subtitle without first obtaining a license from the commission.
28332833 (b) The commission by rule shall categorize the occupations
28342834 of racetrack employees and determine the occupations that afford
28352835 the employee an opportunity to influence racing with pari-mutuel
28362836 wagering, including individuals who:The rules must require an
28372837 employee to be licensed under this subtitle if the employee.
28382838 (1) works in an occupation as an employee, contractor,
28392839 or volunteer,determined by the commission to afford the individual
28402840 the employee an opportunity to influence racing with pari-mutuel
28412841 wagering;
28422842 or (2) will likely have significant access to the backside of
28432843 a racetrack or to restricted areas of the frontside of a racetrack
28442844 (3) Notwithstanding section (b) above, the following
28452845 individuals require a criminal history background check before an
28462846 occupational license is issued: commissioners, racing commission
28472847 employees, racing association employees, owners or employees of
28482848 race horses.
28492849 ARTICLE 23. TEXAS STATE BOARD OF DENTAL EXAMINERS
28502850 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
28512851 STATE BOARD OF DENTAL EXAMINERS. (a) The State Board of Dental
28522852 Examiners is entitled to obtain from the department criminal
28532853 history record information maintained by the department that
28542854 relates to a person who:
28552855 (1) is an applicant for a license, certificate,
28562856 registration, permit, or other authorization under Title 3,
28572857 Subtitle D, Occupations Code (Dental Practice Act);
28582858 (2) is the holder of a license, certificate,
28592859 registration, permit, or other authorization under that Act;
28602860 (3) requests a determination of eligibility for a
28612861 license, certificate, registration, permit, or other authorization
28622862 from the State Board of Dental Examiners; or
28632863 (4) is an applicant for employment at or current
28642864 employee of the State Board of Dental Examiners.
28652865 (b) Texas Ccriminal history record information obtained by
28662866 the State Board of Dental Examiners under Subsection (a) may not be
28672867 released or disclosed to any person except on court order, with the
28682868 written consent of the person who is the subject of the criminal
28692869 history record information, or as provided by Subsection (d).
28702870 (c) The State Board of Dental Examiners shall destroy
28712871 criminal history record information obtained under this section
28722872 after a final determination is made in the matter for which the
28732873 information was obtained.
28742874 (d) The State Board of Dental Examiners is not prohibited
28752875 from disclosing Texas criminal history record information obtained
28762876 under Subsection (a) in a criminal proceeding or in a hearing
28772877 conducted by the State Board of Dental Examiners or State Office of
28782878 Administrative Hearings.
28792879 (e) In accordance with Section 411.087, the State Board of
28802880 Dental Examiners shall obtain criminal history record information
28812881 from the Federal Bureau of Investigation identification division.
28822882 (f) Criminal history record information obtained by the
28832883 Federal Bureau of Investigation shall not be disseminated.
28842884 ARTICLE 24. CONSUMER CREDIT COMMISSIONER
28852885 SECTION 24.01. Section 411.095, Government Code, is amended
28862886 to read as follows:
28872887 Sec. 411.095. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
28882888 CONSUMER CREDIT COMMISSIONER. (a) The consumer credit
28892889 commissioner is entitled to obtain from the department criminal
28902890 history record information maintained by the department that
28912891 relates to a person who is:
28922892 (1) an applicant for or holder of a license or
28932893 registration under Chapter 180, 342, 347, 348, 351, 353, 371, 393,
28942894 or 394, Finance Code;
28952895 (2) an officer, director, owner, or employee of the
28962896 entity or another person having a substantial relationship with the
28972897 entity under Chapter 180, 342, 347, 348, 351, 353, 371, 393, or 394,
28982898 Finance Code;
28992899 (3) an employee of or volunteer with the Office of
29002900 Consumer Credit Commissioner;
29012901 (4) [(3)] an applicant for employment with the Office
29022902 of Consumer Credit Commissioner; or
29032903 (5) [(4)] a contractor or subcontractor of the Office
29042904 of Consumer Credit Commissioner.
29052905 (b) Texas criminal history record information obtained by
29062906 the Office of Consumer Credit Commissioner under Subsection (a) may

29162916 (3) [(C)] with the consent of the person who is the
29172917 subject of the criminal history record information; or
29182918 (4) in a hearing where the Office of Consumer Credit
29192919 Commissioner is a party.
29202920 (c) In accordance with Section 411.087, the consumer credit
29212921 commissioner may obtain criminal history record information from
29222922 the Federal Bureau of Investigation identification division
29232923 regarding a person described by subsection (a).
29242924 (d) Criminal history record information obtained by the
29252925 Federal Bureau of Investigation shall not be disseminated except to
29262926 the person who is the subject of the criminal history record
29272927 information.
29282928 SECTION 24.02. Section 14.151(a), Finance Code, is amended
29292929 to read as follows:
29302930 (a) The commissioner or an assistant commissioner, examiner,
29312931 or other employee of the office shall obtain criminal history
29322932 record information maintained by the Department of Public Safety,
29332933 the Federal Bureau of Investigation Identification Division, or
29342934 another law enforcement agency relating to a person described by
29352935 Section 411.095(a)(1) or (2) [411.095(a)(1)], Government Code.
29362936 ARTICLE 25. TEXAS COMPTROLLER OF PUBLIC ACCOUNTS
29372937 SECTION 25.01. Section 411.109, Government Code, is amended
29382938 by amending Subsection (d) and adding Subsections (f), (g), and (h)
29392939 to read as follows:
29402940 (d) Texas Criminal history record information obtained by the
29412941 comptroller under Subsections (a), (b), and (c) may not be released
29422942 or disclosed to any person except on court order, with the written
29432943 consent of the person or entity that is the subject of the criminal
29442944 history record information, or as provided by Subsections
29452945 [Subsection] (e) or (f).
29462946 (f) The comptroller is not prohibited from disclosing
29472947 criminal history record information obtained under Subsection (a)
29482948 in a criminal proceeding or in a hearing conducted by the
29492949 comptroller.
29502950 (g) In accordance with Section 411.087, the comptroller may
29512951 obtain criminal history record information from the Federal Bureau
29522952 of Investigation identification division.
29532953 (h) Criminal history record information obtained by the
29542954 Federal Bureau of Investigation shall not be disseminated.
29552955 ARTICLE 26. TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS:
29562956 MANUFACTURED HOUSING DIVISION
29572957 Tex. Occ. Code 1201.1031(f) the department is entitled to obtain
29582958 criminal history record information maintained by the Department of
29592959 Public Safety that relates to:
29602960 (1) a person who is:
29612961 (A) an applicant for a license under Chapter 1201
29622962 of the Texas Occupations Code;
29632963 (B) an owner, officer, related person or manager
29642964 of an applicant for manufacturer, retailer, broker, installer, or
29652965 salesperson license under (A); or
29662966 (C) the holder of a license under that Act; or
29672967 (2) an applicant for a license or a license holder
29682968 under Chapter 1201 of the Texas Occupations Code;
29692969 (g) Texas criminal history record information obtained by
29702970 the Manufactured Housing Division under Subsection (a) may not be
29712971 released or disclosed to any person except on court order, with the
29722972 written consent of the person or entity that is the subject of the
29732973 criminal history record information, or as provided by Subsection
29742974 (e).
29752975 (h) Texas criminal history record information obtained by the
29762976 department under Subsection (a) may not be released or disclosed to
29772977 any person except on court order, with the written consent of the
29782978 person or entity that is the subject of the criminal history record
29792979 information, or as provided by Subsection (e).
29802980 (i) The department shall destroy the criminal history record
29812981 information that relates toan applicant for licensure after that
29822982 applicant is licensed or, for an applicant who is not licensed,
29832983 after the check of the criminal history record information on that
29842984 applicant is completed;
29852985 (j) the department is not prohibited from disclosing criminal
29862986 history record information obtained under Subsection (f) in a
29872987 criminal proceeding or in a hearing conducted by the department.
29882988 (k) In accordance with Section 411.087 and Tex. Occ. Code §
29892989 1201.1031, the department shall obtain criminal history record
29902990 information from the Federal Bureau of Investigation
29912991 identification division.
29922992 (l) Criminal history record information obtained by the
29932993 Federal Bureau of Investigation shall not be disseminated.
29942994 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION: The
29952995 Manufactured Housing Division. (a) The Manufactured Housing
29962996 Division is entitled to obtain from the department criminal history
29972997 record information maintained by the department that relates to:
29982998 (1) a person who is:
29992999 (A) an applicant for a license under Chapter 1201
30003000 of the Texas Occupations Code;
30013001 (B) an owner, officer, related person or manager
30023002 of an applicant for manufacturer, retailer, broker, installer, or
30033003 salesperson license under (A); or
30043004 (C) the holder of a license under that Act;
30053005 (2) an applicant for a license or a license holder under
30063006 Chapter 1201 of the Texas Occupations Code;
30073007 (b) Texas criminal history record information obtained by the
30083008 Manufactured Housing Division under Subsection (a) may not be
30093009 released or disclosed to any person except on court order, with the
30103010 written consent of the person or entity that is the subject of the
30113011 criminal history record information, or as provided by Subsection
30123012 (e).
30133013 (c) After an entity is licensed, the Manufactured Housing
30143014 Division, shall destroy the criminal history record information
30153015 that relates to that entity. The Manufactured Housing Division
30163016 shall destroy the criminal history record information that relates
30173017 to:
30183018 (1) an applicant for licensure after that applicant is
30193019 licensed or, for an applicant who is not licensed, after the check
30203020 of the criminal history record information on that applicant is
30213021 completed; or
30223022 (2) a licensee after the check of the criminal history
30233023 record information on that licensee is completed.
30243024 (d) The Manufactured Housing Division shall destroy criminal
30253025 history record information that relates to an applicant who is not
30263026 licensed, as applicable.
30273027 (e) The Manufactured Housing Division is not prohibited from
30283028 disclosing criminal history record information obtained under
30293029 Subsection (a) in a criminal proceeding or in a hearing conducted by
30303030 the Manufactured Housing Division.
30313031 (g) In accordance with Section 411.087 or Chapter 1201 of the
30323032 Texas Occupations Code, the Manufactured Housing Division shall
30333033 obtain criminal history record information from the Federal Bureau
30343034 of Investigation identification division.
30353035 (h) Criminal history record information obtained by the
30363036 Federal Bureau of Investigation shall not be disseminated.
30373037 ARTICLE 27. TEXAS DEPARTMENT OF LICENSING AND REGULATION
30383038 SECTION 27.01. Section 411.093, Government Code, is amended

30743074 (c) The Texas Department of Licensing and Regulation is not
30753075 prohibited from disclosing criminal history record information
30763076 obtained under Subsection (a) in a criminal proceeding or in a
30773077 hearing conducted by the Texas Department of Licensing and
30783078 Regulation or the State Office of Administrative Hearings, as
30793079 applicable.
30803080 (d) In accordance with Section 411.087, the Texas Department
30813081 of Licensing and Regulation shall obtain criminal history record
30823082 information from the Federal Bureau of Investigation
30833083 identification division.
30843084 (e) Criminal history record information obtained by the

32003200 Commission is entitled to obtain from the department criminal
32013201 history record information maintained by the department that
32023202 relates to a person who, under Chapter 466, is:
32033203 (1) a sales agent or an applicant for a sales agent
32043204 license;
32053205 (2) a person required to be named in a license
32063206 application;
32073207 (3) a lottery operator or prospective lottery operator;
32083208 (4) an employee of a lottery operator or prospective
32093209 lottery operator, if the employee is or will be directly involved in
32103210 lottery operations;
32113211 (5) a person who manufactures or distributes lottery
32123212 equipment or supplies or a representative of a person who
32133213 manufactures or distributes lottery equipment or supplies offered
32143214 to the lottery;
32153215 (6) a person who has submitted a written bid or proposal
32163216 to the commission in connection with the procurement of goods or
32173217 services by the commission, if the amount of the bid or proposal
32183218 exceeds $500;
32193219 (7) an employee or other person who works for or will
32203220 work for a sales agent or an applicant for a sales agent license;
32213221 (8) a person who proposes to enter into or who has a
32223222 contract with the commission to supply goods or services to the
32233223 commission;
32243224 (9) if a person described in Subdivisions (1) through
32253225 (8) of this section is not an individual, an individual who:
32263226 (A) is an officer or director of the person;
32273227 (B) holds more than 10 percent of the stock in the
32283228 person;
32293229 (C) holds an equitable interest greater than 10
32303230 percent in the person;
32313231 (D) is a creditor of the person who holds more than
32323232 10 percent of the person's outstanding debt;
32333233 (E) is the owner or lessee of a business that the
32343234 person conducts or through which the person will conduct
32353235 lottery-related activities;
32363236 (F) shares or will share in the profits, other
32373237 than stock dividends, of the person;
32383238 (G) participates in managing the affairs of the
32393239 person; or
32403240 (H) is an employee of the person who is or will be
32413241 involved in:
32423242 (i) selling tickets; or
32433243 (ii) handling money from the sale of tickets;
32443244 (10) the executive director or a prospective executive
32453245 director of the commission;
32463246 (11) an employee or prospective employee of the
32473247 commission; or
32483248 (12) a sales agent whose license is renewed under
32493249 Section 466.158.
32503250 (a-1) The Texas Lottery Commission is entitled to obtain from
32513251 the department criminal history record information maintained by
32523252 the department that relates to a person licensed under Chapter
32533253 2001, Occupations Code, or described by Section 2001.3025,
32543254 Occupations Code.
32553255 (b) Texas Criminal history record information obtained by the
32563256 commission under Subsection (a) or (a-1) may not be released or
32573257 disclosed to any person except on court order, with the written
32583258 consent of the person or entity that is the subject of the criminal
32593259 history record information, or as provided by Subsection (ec).
32603260 (c) After an entity is licensed or certified, the commission
32613261 shall destroy the criminal history record information that relates
32623262 to that entity. The commission shall destroy the criminal history
32633263 record information that relates to:
32643264 (1) an applicant for employment after that applicant is
32653265 employed or, for an applicant who is not employed, after the check
32663266 of the criminal history record information on that applicant is
32673267 completed; or
32683268 (2) an employee or contractor after the check of the
32693269 criminal history record information on that employee or contractor
32703270 is completed.
32713271 (d) The Texas Lottery Commission shall destroy criminal
32723272 history record information that relates to an applicant who is not
32733273 certified or employed, as applicable.
32743274 (e) The Texas Lottery Commission is not prohibited from
32753275 disclosing criminal history record information obtained under
32763276 Subsection (a) in a criminal proceeding or in a hearing conducted by
32773277 the State Office of Administrative HearingsTexas Lottery
32783278 Commission.
32793279 (g) In accordance with Government Code Sections 411.087,
32803280 466.201, and 467.036(b), and Occupations Code Section 2001.3025,
32813281 the Texas Lottery Commission shall obtain criminal history record
32823282 information from the Federal Bureau of Investigation
32833283 identification division.
32843284 (h) Criminal history record information obtained by the
32853285 Federal Bureau of Investigation shall not be disseminated.
32863286 (c) The commission is not prohibited from disclosing to the
32873287 person who is the subject of the criminal history record
32883288 information the dates and places of arrests, offenses, and
32893289 dispositions contained in the criminal history record information.
32903290 ARTICLE 29. TEXAS MEDICAL BOARD
32913291 Sec. 411.###. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
32923292 TEXAS MEDICAL BOARD. (a) The Texas Medical Board is entitled to
32933293 obtain from the department criminal history record information
32943294 maintained by the department that relates to:
32953295 (1) a person who is:
32963296 (A) an applicant for or holder of a license to
32973297 practice medicine;
32983298 (B) an applicant for or holder of a license to
32993299 practice as a physician assistant;
33003300 (C) an applicant for or holder of a license to
33013301 practice as an acupuncturist;
33023302 (D) an applicant for or holder of a certificate to
33033303 practice as an acudetox specialist;
33043304 (E) an applicant for or holder of a license to
33053305 practice as a surgical assistant;
33063306 (F) an applicant for or holder of a general
33073307 certificate to perform radiologic procedures, limited certificate
33083308 to perform radiologic procedures only on specific parts of the
33093309 body, or radiologist assistant certificate;;
33103310 (G) an applicant for or holder of a placement on
33113311 the registry of non-certified technicians;
33123312 (H) an employee of an applicant for a hardship
33133313 exemption;
33143314 (I) an applicant for or holder of a license to
33153315 practice as a medical physicist;
33163316 (J) an applicant for or holder of a license to
33173317 practice as a perfusionist;
33183318 (K) an applicant for or holder of a license to
33193319 practice as a respiratory care practitioner; and
33203320 (L) an applicant for or holder of a pain
33213321 management clinic certificate.
33223322 (b) Texas criminal history record information obtained by the
33233323 Texas Medical Board under Subsection (a) may not be released or
33243324 disclosed to any person, except as provided by subsection (c).
33253325 (c) The Texas Medical Board is not prohibited from disclosing
33263326 criminal history record information obtained under Subsection (a)
33273327 in a hearing conducted by the Medical Board or its advisory boards.
33283328 (d) In accordance with Section 411.087, the Texas Medical
33293329 Board may obtain criminal history record information from the
33303330 Federal Bureau of Investigation identification division.
33313331 (e) Criminal history record information obtained by the
33323332 Federal Bureau of Investigation shall not be disseminated.
33333333 ARTICLE 30. JUDICIAL BRANCH CERTIFICATION COMMISSION
33343334 SECTION 30.01. Chapter 1104, Estates Code, is amended to
33353335 read as follows:
33363336 Sec. 1104.402. COURT CLERK'S DUTY TO OBTAIN CRIMINAL HISTORY
33373337 RECORD INFORMATION; AUTHORITY TO CHARGE FEE. (a) Except as
33383338 provided by Section [1104.403,] 1104.404, or 1104.406(a), the clerk
33393339 of the county having venue of the proceeding for the appointment of
33403340 a guardian shall obtain criminal history record information that is
33413341 maintained by the Department of Public Safety or the Federal Bureau
33423342 of Investigation identification division relating to:
33433343 (1) a private professional guardian;
33443344 (2) each person who represents or plans to represent
33453345 the interests of a ward as a guardian on behalf of the private
33463346 professional guardian;
33473347 (3) each person employed by a private professional
33483348 guardian who will:
33493349 (A) have personal contact with a ward or proposed
33503350 ward;
33513351 (B) exercise control over and manage a ward's
33523352 estate; or
33533353 (C) perform any duties with respect to the
33543354 management of a ward's estate;
33553355 (4) each person employed by or volunteering or
33563356 contracting with a guardianship program to provide
33573357 guardianship services to a ward of the program on the
33583358 program's behalf; or
33593359 (5) any other person proposed to serve as a guardian
33603360 under this title, including a proposed temporary guardian and
33613361 a proposed successor guardian, other than an attorney.
33623362 (b) The clerk may charge a $10 fee to recover the costs of
33633363 obtaining criminal history record information under Subsection
33643364 (a).
33653365 (c) A clerk is liable to those damaged if damage or loss
33663366 results to a guardianship or ward because of the neglect or failure
33673367 of the clerk to obtain criminal history record information as
33683368 required by Subsection (a).
33693369 SECTION 30.02. Chapter 1104, Estates Code, is amended to read
33703370 as follows:
33713371 Sec. 1104.404. EXCEPTION FOR INFORMATION CONCERNING CERTAIN
33723372 PERSONS. (a) The clerk described by Section 1104.402 is not
33733373 required to obtain criminal history record information from the
33743374 Department of Public Safety for a person if the Judicial Branch
33753375 Certification Commission conducted a criminal history check on the
33763376 person under Section 155.203 and Section 155.207[ Chapter 155],
33773377 Government Code. However, the clerk shall obtain criminal history
33783378 record information from the Federal Bureau of Investigation
33793379 identification division relating to each person described in
33803380 Section 1104.402 regardless of whether the Judicial Branch
33813381 Certification Commission obtained information on such a person.
33823382 (b) The commission [board] shall provide to the clerk [at the
33833383 court's request] the criminal history record information that was
33843384 obtained from the Department of Public Safety[ or the Federal
33853385 Bureau of Investigation]. The commission is prohibited from
33863386 disseminating criminal history record information that was
33873387 obtained from the Federal Bureau of Investigation pursuant to
33883388 Section 411.1408, Government Code, for purposes of determining
33893389 whether an applicant is ineligible for certification as a guardian.
33903390 SECTION 30.03. Chapter 1104, Estates Code, is amended to

33923392 Sec. 1104.405. INFORMATION FOR EXCLUSIVE USE OF COURT. (a)
33933393 Criminal history record information obtained or provided under
33943394 Section 1104.402, [1104.403, ]or 1104.404 is privileged and
33953395 confidential and is for the exclusive use of the court. The
33963396 criminal history record information may not be released or
33973397 otherwise disclosed to any person or agency except on court order
33983398 [or consent of the person being investigated]. The court may use
33993399 the criminal history record information only in order to determine
34003400 whether to:
34013401 (1) appoint, remove, or continue the appointment of a
34023402 private professional guardian, a guardianship program, or the
34033403 Health and Human Services Commission; or
34043404 (2) appoint any other person proposed to serve as a
34053405 guardian under Title 3, Estates Code, including a proposed
34063406 temporary guardian and a proposed successor guardian, other than an
34073407 attorney.
34083408 (b) The county clerk may destroy the criminal history record
34093409 information after the information is used for the purposes
34103410 authorized by this subchapter.
34113411 SECTION 30.04. Chapter 152, Government Code, is amended to
34123412 read as follows:
34133413 Sec. 152.203. RULES ON INELIGIBILITY. The supreme court
34143414 shall by order adopt rules on applicants' ineligibility for
34153415 certification, registration, or licensing under this subtitle
34163416 based on the applicant’s[person's] criminal history or other
34173417 information that indicates the applicant[person] lacks the
34183418 honesty, trustworthiness, or integrity to hold the certification,
34193419 registration, or license. The commission shall, in accordance with
34203420 this Section and rules adopted by order of the supreme court, obtain
34213421 criminal history record information that is maintained by the
34223422 Department of Public Safety or the Federal Bureau of Investigation
34233423 identification division on each applicant for certification,
34243424 registration, or licensing under this subtitle to be used solely
34253425 for the determination of each applicant’s ineligibility pursuant to
34263426 rules adopted by supreme court order under this Section. The
34273427 commission may not use criminal history record information obtained
34283428 from the Federal Bureau of Investigation identification division
34293429 under the this Section for any other purpose. The commission may
34303430 not transfer criminal history record information obtained from the
34313431 Federal Bureau of Investigation identification division under this
34323432 Section to any other state agency, entity, or person, other than the
34333433 person who is the subject of the criminal history record
34343434 information. The commission shall dispose of criminal history
34353435 record information immediately after each determination of
34363436 ineligibility is made.
34373437 SECTION 30.05. Chapter 155, Government Code, is amended to
34383438 read as follows:
34393439 Sec. 155.205. DUTY TO OBTAIN CRIMINAL HISTORY RECORD
34403440 INFORMATION. (a) In accordance with the rules adopted by the
34413441 supreme court under Section 155.203, the commission shall obtain-
34423442 criminal history record information that is maintained by the
34433443 Department of Public Safety. The clerk shall obtain criminal
34443444 history record information from [or] the Federal Bureau of
34453445 Investigation identification division relating to an individual
34463446 seeking appointment as a guardian or temporary guardian in
34473447 accordance with Subsection (b).
34483448 (b) The clerkcommission shall obtain[:
34493449 (1)] fingerprint-based criminal history record information
34503450 of a proposed guardian if:
34513451 (1)[(A)] the liquid assets of the estate of a ward
34523452 exceed $50,000; or
34533453 (2)[(B)] the proposed guardian is not a resident of
34543454 this state.[; or]
34553455 (c)[(2)] The commission shall obtain name-based criminal
34563456 history record information of a proposed guardian, including
34573457 any criminal history record information under the current
34583458 name and all former names of the proposed guardian, if:
34593459 (1)[(A)] the liquid assets of the estate of a ward are
34603460 $50,000 or less; and
34613461 (2)[(B)] the proposed guardian is a resident of this
34623462 state.
34633463 (d) Each proposed guardian described in Subsection (b) shall
34643464 file with the commission proof of having submitted to a
34653465 fingerprint-based criminal history search.
34663466 SECTION 30.06. Chapter 155, Government Code, is amended to
34673467 read as follows:
34683468 Sec. 155.207. USE OF CRIMINAL HISTORY RECORD INFORMATION.
34693469 (a) The commission shall use the criminal history record
34703470 information obtained under this subchapter only for a purpose
34713471 authorized by this subchapter [or to maintain the registration of a
34723472 guardianship under Subchapter D].
34733473 (b) A court may use Texas [the] criminal history record
34743474 information obtained under this subchapter only in the same manner
34753475 and only to the same extent a court is authorized to use the
34763476 information under Section 1104.409, Estates Code.
34773477 SECTION 30.07. Chapter 411, Government Code, is amended to
34783478 read as follows:
34793479 Sec. 411.1386. ACCESS TO CRIMINAL HISTORY RECORD
34803480 INFORMATION: COURT CLERK; HEALTH AND HUMAN SERVICES COMMISSION;
34813481 GUARDIANSHIPS. (a) Except as provided by Subsections (a-1)[,
34823482 (a-5),] and (a-4) [(a-6)], the clerk of the county having venue over
34833483 a proceeding for the appointment of a guardian under Title 3,
34843484 Estates Code, shall in accordance with Section 411.087 obtain from
34853485 the department criminal history record information maintained by
34863486 the department that relates to:
34873487 (1) a private professional guardian;
34883488 (2) each person who represents or plans to represent
34893489 the interests of a ward as a guardian on behalf of the private
34903490 professional guardian;
34913491 (3) each person employed by a private professional
34923492 guardian who will:
34933493 (A) have personal contact with a ward or proposed
34943494 ward;
34953495 (B) exercise control over and manage a ward's
34963496 estate; or
34973497 (C) perform any duties with respect to the
34983498 management of a ward's estate;
34993499 (4) each person employed by or volunteering or contracting
35003500 with a guardianship program to provide guardianship services to a
35013501 ward of the program on the program's behalf; or
35023502 (5) any other person proposed to serve as a guardian
35033503 under Title 3, Estates Code, including a proposed temporary
35043504 guardian and a proposed successor guardian, other than an attorney.
35053505 (a-1) The Health and Human Services Commission shall obtain
35063506 from the Department of Public Safety criminal history record
35073507 information maintained by the Department of Public Safety that
35083508 relates to each individual who is or will be providing guardianship
35093509 services to a ward of or referred by the Health and Human Services
35103510 Commission, including:
35113511 (1) an employee of or an applicant selected for an
35123512 employment position with the Health and Human Services Commission;
35133513 (2) a volunteer or an applicant selected to volunteer
35143514 with the Health and Human Services Commission;
35153515 (3) an employee of or an applicant selected for an
35163516 employment position with a business entity or other person that
35173517 contracts with the Health and Human Services Commission to provide
35183518 guardianship services to a ward referred by that commission;
35193519 (4) a volunteer or an applicant selected to volunteer
35203520 with a business entity or person described by Subdivision (3); and
35213521 (5) a contractor or an employee of a contractor who
35223522 provides services to a ward of the Health and Human Services
35233523 Commission under a contract with the estate of the ward.
35243524 (a-2) The information in Subsection (a-1) regarding
35253525 applicants for employment positions must be obtained before an
35263526 offer of employment, and the information regarding applicant
35273527 volunteers must be obtained before the person's contact with a ward
35283528 of or referred by the Health and Human Services Commission.
35293529 (a-3) The information in Subsection (a-1) regarding
35303530 employees, contractors, or volunteers providing guardianship
35313531 services must be obtained annually.
35323532 (a-4) [The Health and Human Services Commission shall
35333533 provide the information obtained under Subsection (a-1) to:
35343534 (1) the clerk of the county having venue over the
35353535 guardianship proceeding at the request of the court; and
35363536 (2) the guardianship certification program of the
35373537 Judicial Branch Certification Commission at the request of the
35383538 Judicial Branch Certification Commission.
35393539 (a-5) Not later than the 10th day before the date of the
35403540 hearing to appoint a guardian, a person may submit to the clerk a
35413541 copy of the person's criminal history record information required
35423542 under Subsection (a)(5) that the person obtains from the department
35433543 not earlier than the 30th day before the date of the hearing.
35443544 (a-6)] The clerk described by Subsection (a) is not required
35453545 to obtain criminal history record information from the Department
35463546 of Public Safety for a person if the Judicial Branch Certification
35473547 Commission conducted a criminal history check on the person under
35483548 Section 155.203 and Section 155.207 [Chapter 155]. The commission
35493549 shall provide to the clerk [at the court's request] the criminal
35503550 history record information that was obtained from the department
35513551 [or the Federal Bureau of Investigation]. The clerk shall in
35523552 accordance with Section 411.087 obtain criminal history record
35533553 information from the Federal Bureau of Investigation
35543554 identification division relating to any person described by
35553555 Subsection (a) regardless of whether the Judicial Branch
35563556 Certification Commission obtains criminal history record
35573557 information relating to such person.
35583558 (b) Criminal history record information obtained by or
35593559 provided to a clerk under this Section [Subsection (a), (a-5), or
35603560 (a-6)] is for the exclusive use of the court and is privileged and
35613561 confidential.
35623562 (c) Criminal history record information obtained by or
35633563 provided to a clerk under this section [under Subsection (a),
35643564 (a-5), or (a-6)] may not be released or disclosed to any person or
35653565 agency except on court order [or with the consent of the person who
35663566 is the subject of the information]. The clerk may destroy the
35673567 criminal history record information after the information is used
35683568 for the purposes authorized by this section.
35693569 (d) [The criminal history record information obtained under
35703570 Subsection (a-4) is for the exclusive use of the court or
35713571 guardianship certification program of the Judicial Branch
35723572 Certification Commission, as appropriate, and is privileged and
35733573 confidential. The information may not be released or otherwise
35743574 disclosed to any person or agency except on court order, with the
35753575 consent of the person being investigated, or as authorized by
35763576 Subsection (a-6) or Section 1104.404, Estates Code. The county
35773577 clerk or guardianship certification program of the Judicial Branch
35783578 Certification Commission may destroy the criminal history record
35793579 information after the information is used for the purposes
35803580 authorized by this section.
35813581 (e)] The court, as that term is defined by Section 1002.008,
35823582 Estates Code, shall use the information obtained or provided under
35833583 Subsection (a) or (a-4)[, ](a-4)[(1), (a-5), or (a-6)] only in
35843584 determining whether to:
35853585 (1) appoint, remove, or continue the appointment of a
35863586 private professional guardian, a guardianship program, or
35873587 the Health and Human Services Commission; or
35883588 (2) appoint any other person proposed to serve as a
35893589 guardian under Title 3, Estates Code, including a proposed
35903590 temporary guardian and a proposed successor guardian, other
35913591 than an attorney.
35923592 (e)[(f) Criminal history record information obtained by the
35933593 guardianship certification program of the Judicial Branch
35943594 Certification Commission under Subsection (a-4)(2) may be used for
35953595 any purpose related to the issuance, denial, renewal, suspension,
35963596 or revocation of a certificate issued by the commission.
35973597 (g)] A person commits an offense if the person releases or
35983598 discloses any information received under this section without the
35993599 authorization prescribed by Subsection (c)[ or (d)]. An offense
36003600 under this subsection is a Class A misdemeanor.
36013601 (f)[(h)] The county clerk may charge a $10 fee to recover the
36023602 costs of obtaining criminal history information recordscriminal
36033603 history record information authorized by Subsection (a).
36043604 (g) A clerk is liable to those damaged if damage or loss
36053605 results to a guardianship or ward because of the neglect or failure
36063606 of the clerk to obtain criminal history record information as
36073607 required by Subsection (a).
36083608 [(i) This section does not prohibit the Health and Human
36093609 Services Commission from obtaining and using criminal history
36103610 record information as provided by other law.]
36113611 SECTION 30.08. Chapter 411, Government Code, is amended to
36123612 read as follows:
36133613 Sec. 411.1408. ACCESS TO CRIMINAL HISTORY RECORD INFORMATION:
36143614 JUDICIAL BRANCH CERTIFICATION COMMISSION. (a) In this section,
36153615 "commission" means the Judicial Branch Certification Commission
36163616 established under Chapter 152.
36173617 (b) In accordance with Section 411.087, the[The] commission
36183618 is entitled to obtain from the department criminal history record
36193619 information maintained by the department that relates to a person
36203620 who is an applicant for or the holder of a certificate,
36213621 registration, or license issued by the commission or otherwise
36223622 under Subtitle L, Title 2. The commission may not disseminate
36233623 criminal history record information obtained from the Federal
36243624 Bureau of Investigation.
36253625 (c) Criminal history record information obtained by the
36263626 commission under Subsection (b):
36273627 (1) may be used by the commission for any purpose
36283628 related to the issuance, denial, suspension, revocation, or
36293629 renewal of a certificate, registration, or license issued by
36303630 the commission or otherwise under Subtitle L, Title 2;
36313631 (2) may not be released or disclosed to any person
36323632 except:
36333633 (A) on court order; or
36343634 (B) [with the consent of the person who is the
36353635 subject of the information; or]
36363636 (C) as authorized by Section
36373637 411.1386(a-4)[(a-6)] of this code or Section 1104.404,
36383638 Estates Code, if applicable; and
36393639 (3) shall be destroyed by the commission after the
36403640 information is used for the authorized purposes.
36413641 SECTION 30.09. Chapter 411, Government Code, is amended to
36423642 read as follows:
36433643 Sec. 411.1409. ACCESS TO CRIMINAL HISTORY INFORMATION:
36443644 APPELLATE COURTS. (a) In this section, "appellate court" means the
36453645 Supreme Court of Texas, the Texas Court of Criminal Appeals, or a
36463646 court of appeals.
36473647 (b) As authorized by Section 411.087, an[An] appellate court
36483648 is entitled to obtain from the department criminal history record
36493649 information maintained by the department that relates to a person
36503650 who is an applicant for:
36513651 (1) employment with the court;
36523652 (2) a volunteer position with the court; or
36533653 (3) an appointment made by the court.
36543654 (c) Criminal history record information obtained by the
36553655 court under Subsection (b) may be used only to evaluate an
36563656 applicant.
36573657 (d) The court may not release or disclose information
36583658 obtained under Subsection (b) except on order of a district court
36593659 [or with the consent of the person who is the subject of the
36603660 criminal history record information]. Despite the issuance of an
36613661 order by a district court, the court may not disseminate criminal
36623662 history record information obtained from the Federal Bureau of
36633663 Investigation.
36643664 (e) After the expiration of any probationary term of the
36653665 person's employment, volunteer status, or appointment, the court
36663666 shall destroy all criminal history record information obtained
36673667 under Subsection (b).
36683668 SECTION 28.10. Sections 1104.403, 1104.407, 1104.408, and
36693669 1104.410, Estates Code, are repealed.
36703670 ARTICLE 31. EFFECTIVE DATE
36713671 SECTION 28.01. Except as otherwise provided by this Act,
36723672 this Act takes effect September 1, 2023.
