7 | 7 | | relating to the employment of a behavior specialist by regional |

8 | 8 | | education service centers. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter B, Chapter 8, Education Code, is |
---|
11 | 11 | | amended by adding Section 8.062 to read as follows: |
---|
12 | 12 | | Sec. 8.062. BEHAVIOR SPECIALIST. (a) Each regional |
---|
13 | 13 | | education service center shall employ as a behavior specialist a |
---|
14 | 14 | | person licensed as a behavior analyst under Chapter 506, |
---|
15 | 15 | | Occupations Code, to provide school districts served by the center |
---|
16 | 16 | | with support and resources that are necessary to assist students |
---|
17 | 17 | | and families of students. |
---|
18 | 18 | | (b) A behavior specialist: |
---|
19 | 19 | | (1) may provide support and resources that include: |
---|
20 | 20 | | (A) teacher training; |
---|
21 | 21 | | (B) classroom management and support; |
---|
22 | 22 | | (C) accommodations to curriculum and |
---|
23 | 23 | | instruction; |
---|
24 | 24 | | (D) evidence-based education techniques; |
---|
25 | 25 | | (E) behavioral strategies and tactics; |
---|
26 | 26 | | (F) personalized systems of instruction; |
---|
27 | 27 | | (G) programmatic instruction; |
---|
28 | 28 | | (H) technology solutions; and |
---|
29 | 29 | | (I) individualized education program support; |
---|
30 | 30 | | (2) may not provide services described by Section |
---|
31 | 31 | | 506.003(d), Occupations Code; and |
---|
32 | 32 | | (3) may not conduct a required school evaluation or |
---|
33 | 33 | | assessment of a student, including a functional behavioral |
---|
34 | 34 | | assessment. |
---|
35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
---|
36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
---|
37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
---|
39 | 39 | | Act takes effect September 1, 2023. |
