66 AN ACT
77 relating to the employment of a behavior specialist by regional
88 education service centers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 8, Education Code, is
1111 amended by adding Section 8.062 to read as follows:
1212 Sec. 8.062. BEHAVIOR SPECIALIST. (a) Each regional
1313 education service center shall employ as a behavior specialist a
1414 person licensed as a behavior analyst under Chapter 506,
1515 Occupations Code, to provide school districts served by the center
1616 with support and resources that are necessary to assist students
1717 and families of students.
1818 (b) A behavior specialist:
1919 (1) may provide support and resources that include:
2020 (A) teacher training;
2121 (B) classroom management and support;
2222 (C) accommodations to curriculum and
2323 instruction;
2424 (D) evidence-based education techniques;
2525 (E) behavioral strategies and tactics;
2626 (F) personalized systems of instruction;
2727 (G) programmatic instruction;
2828 (H) technology solutions; and
2929 (I) individualized education program support;
3030 (2) may not provide services described by Section
3131 506.003(d), Occupations Code; and
3232 (3) may not conduct a required school evaluation or
3333 assessment of a student, including a functional behavioral
3434 assessment.
3535 SECTION 2. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2023.
