| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 48.105(b), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (b) At least 55 percent of the funds allocated under this |
|---|
| 13 | 13 | | section must be used in providing bilingual education or special |
|---|
| 14 | 14 | | language programs under Subchapter B, Chapter 29. A district's |
|---|
| 15 | 15 | | bilingual education or special language allocation may be used only |
|---|
| 16 | 16 | | for program and student evaluation, instructional materials and |
|---|
| 17 | 17 | | equipment, staff development, supplemental staff expenses, |
|---|
| 18 | 18 | | salaries [salary supplements] for teachers, incremental costs |
|---|
| 19 | 19 | | associated with providing smaller class sizes, and other supplies |
|---|
| 20 | 20 | | required for quality instruction. |
|---|
| 21 | 21 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 22 | 22 | | school year. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
