55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the permissible uses of the bilingual education
88 allotment provided under the Foundation School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 48.105(b), Education Code, is amended to
1111 read as follows:
1212 (b) At least 55 percent of the funds allocated under this
1313 section must be used in providing bilingual education or special
1414 language programs under Subchapter B, Chapter 29. A district's
1515 bilingual education or special language allocation may be used only
1616 for program and student evaluation, instructional materials and
1717 equipment, staff development, supplemental staff expenses,
1818 salaries [salary supplements] for teachers, incremental costs
1919 associated with providing smaller class sizes, and other supplies
2020 required for quality instruction.
2121 SECTION 2. This Act applies beginning with the 2023-2024
2222 school year.
2323 SECTION 3. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2023.
