| 5 | 5 | | relating to administrative procedures in the architectural |

| 6 | 6 | | barriers program at the Texas Department of Licensing and |
|---|
| 7 | 7 | | Regulation. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 469.058(a), Government Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (a) The commission or executive director may impose an |
|---|
| 12 | 12 | | administrative penalty under Subchapter F, Chapter 51, Occupations |
|---|
| 13 | 13 | | Code, on a building owner for a violation of this chapter or a rule |
|---|
| 14 | 14 | | adopted under this chapter. |
|---|
| 15 | 15 | | SECTION 2. Section 469.106(a), Government Code, is amended |
|---|
| 16 | 16 | | to read as follows: |
|---|
| 17 | 17 | | (a) Notwithstanding any other provision of this chapter, |
|---|
| 18 | 18 | | the commission shall require complete compliance with the standards |
|---|
| 19 | 19 | | and specifications adopted by the commission under this chapter |
|---|
| 20 | 20 | | that apply specifically to a building or facility occupied by a |
|---|
| 21 | 21 | | state agency involved in extending direct services to persons with |
|---|
| 22 | 22 | | mobility impairments. Those standards and specifications also |
|---|
| 23 | 23 | | apply to a building or facility occupied by the Health and Human |
|---|
| 24 | 24 | | Services Commission [Texas Rehabilitation Commission]. |
|---|
| 25 | 25 | | SECTION 3. Section 469.058(c) and Section 469.059(c), |
|---|
| 26 | 26 | | Government Code, are repealed. |
|---|
| 27 | 27 | | SECTION 4. The changes in law made by this Act do not affect |
|---|
| 28 | 28 | | the validity of a disciplinary action or other proceeding that was |
|---|
| 29 | 29 | | initiated before September 1, 2023, and that is pending on |
|---|
| 30 | 30 | | September 1, 2023. A disciplinary action that is pending on |
|---|
| 31 | 31 | | September 1, 2023, is governed by the law in effect immediately |
|---|
| 32 | 32 | | before September 1, 2023, and the former law is continued in effect |
|---|
| 33 | 33 | | for that purpose. |
|---|
| 34 | 34 | | SECTION 5. This Act takes effect September 1, 2023. |
