55 relating to administrative procedures in the architectural
66 barriers program at the Texas Department of Licensing and
77 Regulation.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 469.058(a), Government Code, is amended
1010 to read as follows:
1111 (a) The commission or executive director may impose an
1212 administrative penalty under Subchapter F, Chapter 51, Occupations
1313 Code, on a building owner for a violation of this chapter or a rule
1414 adopted under this chapter.
1515 SECTION 2. Section 469.106(a), Government Code, is amended
1616 to read as follows:
1717 (a) Notwithstanding any other provision of this chapter,
1818 the commission shall require complete compliance with the standards
1919 and specifications adopted by the commission under this chapter
2020 that apply specifically to a building or facility occupied by a
2121 state agency involved in extending direct services to persons with
2222 mobility impairments. Those standards and specifications also
2323 apply to a building or facility occupied by the Health and Human
2424 Services Commission [Texas Rehabilitation Commission].
2525 SECTION 3. Section 469.058(c) and Section 469.059(c),
2626 Government Code, are repealed.
2727 SECTION 4. The changes in law made by this Act do not affect
2828 the validity of a disciplinary action or other proceeding that was
2929 initiated before September 1, 2023, and that is pending on
3030 September 1, 2023. A disciplinary action that is pending on
3131 September 1, 2023, is governed by the law in effect immediately
3232 before September 1, 2023, and the former law is continued in effect
3333 for that purpose.
3434 SECTION 5. This Act takes effect September 1, 2023.
