4	4	A BILL TO BE ENTITLED
5	5	AN ACT
6	6	relating to the definitions of homeless, homelessness, and
7	7	variations of those terms.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 531.001, Government Code, is amended by
10	10	adding Subdivision (9) to read as follows:
11	11	(9) "Homeless," "homelessness," and variations of
12	12	those terms used in reference to the housing status of a person mean
13	13	a person lacking a fixed, regular, and adequate nighttime residence
14	14	and include:
15	15	(A) a person described by 42 U.S.C. Section
16	16	11302(a), as that section existed on January 1, 2023;
17	17	(B) homeless children and youths described by 42
18	18	U.S.C. Section 11434a, as that section existed on January 1, 2023;
19	19	and
20	20	(C) family members of homeless children and
21	21	youths described by Paragraph (B).
22	22	SECTION 2. Section 539.001, Government Code, is amended to
23	23	read as follows:
24	24	Sec. 539.001. DEFINITIONS [DEFINITION]. In this chapter:
25	25	(1) [,] "Department [department]" means the
26	26	Department of State Health Services.
27	27	(2) "Homeless," "homelessness," and variations of
28	28	those terms used in reference to the housing status of a person have
29	29	the meanings assigned by Section 531.001.
30	30	SECTION 3. Section 2306.004, Government Code, is amended by
31	31	adding Subdivision (12-b) to read as follows:
32	32	(12-b) "Homeless," "homelessness," and variations of
33	33	those terms used in reference to the housing status of a person have
34	34	the meanings assigned by Section 531.001.
35	35	SECTION 4. This Act takes effect September 1, 2023.
