1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 755.001, Health and Safety Code, is
1212 amended to read as follows:
1313 Sec. 755.001. DEFINITIONS. In this chapter:
1414 (1) "Alteration" means a substantial change in an original
1515 design.
1616 (2) "Board" means the board of boiler rules.
1717 (3) "Boiler" means:
1818 (A) a heating boiler;
1919 (B) a nuclear boiler;
2020 (C) a power boiler;
2121 (D) an unfired steam boiler; or
2222 (E) a process steam generator.
2323 (4) "Certificate inspection" means the required internal or
2424 external boiler inspection, the report of which is used by the chief
2525 inspector to decide whether to issue a certificate of operation.
2626 (5) "Certificate of operation" means a certificate issued
2727 by the executive director to allow the operation of a boiler.
2828 (6) "Commission" means the Texas Commission of
2929 Licensing and Regulation.
3030 (7) "Department" means the Texas Department of Licensing
3131 and Regulation.
3232 (7-a) "Executive director" means the executive director
3333 of the department.
3434 (8) "External inspection" means an inspection of the
3535 exterior of a boiler and its appurtenances that is made, if
3636 possible, while the boiler is in operation.
3737 (9) "Heating boiler" means a steam heating boiler, hot water
3838 heating boiler, hot water supply boiler, or potable water heater
3939 that is directly fired with oil, gas, solar energy, electricity,
4040 coal, or other solid or liquid fuel.
4141 (10) "High-temperature water boiler" means a water boiler
4242 designed for operation at pressures exceeding 160 pounds per square
4343 inch or temperatures exceeding 250 degrees Fahrenheit.
4444 (11) "Hot water heating boiler" means a boiler designed for
4545 operation at a pressure not exceeding 160 pounds per square inch or
4646 temperatures not exceeding 250 degrees Fahrenheit at or near the
4747 boiler outlet.
4848 (12) "Hot water supply boiler" means a boiler designed for
4949 operation at pressures not exceeding 160 pounds per square inch or
5050 temperatures not exceeding 250 degrees Fahrenheit at or near the
5151 boiler outlet if the boiler's:
5252 (A) heat input exceeds 200,000 British thermal units
5353 per hour;
5454 (B) water temperature exceeds 210 degrees Fahrenheit;
5555 or
5656 (C) nominal water-containing capacity exceeds 120
5757 gallons.
5858 (13) "Inspection agency" means an authorized inspection
5959 agency providing inspection services.
6060 (14) "Inspector" means the chief inspector, a deputy
6161 inspector, or an authorized inspector.
6262 (15) "Internal inspection" means a complete and thorough
6363 inspection of the interior waterside and fireside areas of a boiler
6464 as construction allows.
6565 (16) "Miniature boilers" means boilers designed and
6666 constructed not to exceed the following dimensions:
6767 (a) 16 inches inside diameter of shell;
6868 (b) 20 square feet of heating surface (not applicable
6969 to electric boilers);
7070 (c) 5 cubic feet of gross volume exclusive of casing
7171 and insulation; and
7272 (d) 100 psig maximum allowable working pressure.
7373 (17) (16) "Nuclear boiler" means a nuclear power plant
7474 system, including its pressure vessels, piping systems, pumps,
7575 valves, and storage tanks, that produces and controls an output of
7676 thermal energy from nuclear fuel and the associated systems
7777 essential to the function of the power system.
7878 (18) (17) "Portable boiler" means a boiler primarily intended
7979 for use at a temporary location.
8080 (19) (18) "Potable water heater" means a boiler designed for
8181 operation at pressures not exceeding 160 pounds per square inch and
8282 water temperatures not exceeding 210 degrees Fahrenheit if the
8383 boiler's:
8484 (A) heat input exceeds 200,000 British thermal units
8585 per hour; or
8686 (B) nominal water-containing capacity exceeds 120
8787 gallons.
8888 (20) (19) "Power boiler" means:
8989 (A) a high-temperature water boiler; or
9090 (B) a boiler in which steam is generated at a pressure
9191 exceeding 15 pounds per square inch for a purpose external to the
9292 boiler.
9393 (21) (20) "Process steam generator" means an evaporator, heat
9494 exchanger, or vessel in which steam is generated by the use of heat
9595 resulting from the operation of a processing system that contains a
9696 number of pressure vessels, such as used in the manufacture of
9797 chemical and petroleum products.
9898 (22) (21) "Repair" means the work necessary to return a
9999 boiler to a safe and satisfactory operating condition without
100100 changing the original design.
101101 (23) (22) "Safety appliance" means a safety device such as a
102102 safety valve or a safety relief valve for a boiler provided to
103103 diminish the danger of accidents.
104104 (24) (23) "Standard boiler" means a boiler that bears a Texas
105105 stamp, the stamp of a nationally recognized engineering
106106 professional society, or the stamp of any jurisdiction that has
107107 adopted a standard of construction equivalent to the standard
108108 required by the executive director.
109109 (24-a) (23 a) "Steam cooker" means a steam heating boiler
110110 that is:
111111 (A) designed to steam cook food;
112112 (B) operated at a pressure not exceeding five pounds
113113 per square inch; and
114114 (C) equipped with a safety appliance operated at a
115115 pressure not exceeding five pounds per square inch.
116116 (25)(24) "Steam heating boiler" means a boiler designed for
117117 operation at pressures not exceeding 15 pounds per square inch.
118118 (26)(25) "Unfired steam boiler" means an unfired pressure
119119 vessel in which steam is generated. The term does not include:
120120 (A) vessels known as evaporators or heat exchangers; or
121121 (B) vessels in which steam is generated by using the
122122 heat that results from the operation of a processing system that
123123 contains a number of pressure vessels, as used in the manufacture of
124124 chemical and petroleum products.
125125 SECTION 2. Subsection (a), Section 755.022, Health and
126126 Safety Code, is amended to read as follows:
127127 (a) This chapter does not apply to:
128128 (1) boilers owned or operated by the federal
129129 government;
130130 (2) pressure vessels or process steam generators, other
131131 than steam collection or liberation drums of process steam
132132 generators;
133133 (3) manually fired miniature boilers that:
134134 (A) are constructed or maintained for
135135 locomotives, boats, tractors, or stationary engines only as a hobby
136136 for exhibition, recreation, education, or historical purposes and
137137 not for commercial use;
138138 (B) have an inside diameter of 12 inches or less
139139 or a grate area of two square feet or less; and
140140 (C) are equipped with a safety valve of adequate
141141 size, a water level indicator, and a pressure gauge;
142142 (4) boilers that are designed for operation only at
143143 atmospheric pressure and that are equipped with two independent
144144 means to prevent the buildup of pressure;
145145 (5) steam cookers; or
146146 (6) espresso machines;
147147 (7) Miniature boilers, as defined in Sec. 755.001(16)
148148 of this Chapter, that are integrated as a component of a medical
149149 device regulated by the United States Food and Drug Administration;
150150 or
151151 (8) Unfired pressure vessels contained within an
152152 autoclave.
153153 SECTION 3. This Act takes effect September 1, 2023.
