| 7 | 7 | | relating to the approval of equivalent educational programs for |

| 8 | 8 | | persons whose driver's license is suspended following conviction of |
|---|
| 9 | 9 | | certain drug offenses. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 521.376, Transportation Code, is amended |
|---|
| 12 | 12 | | by amending Subsection (b) and adding Subsection (c) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (b) The Department of State Health Services: |
|---|
| 15 | 15 | | (1) shall monitor, coordinate, and provide training |
|---|
| 16 | 16 | | to residential treatment facilities described by Section |
|---|
| 17 | 17 | | 521.374(a)(2)(C) [521.374(a)(2)] providing equivalent education; |
|---|
| 18 | 18 | | and |
|---|
| 19 | 19 | | (2) shall administer the approval of the equivalent |
|---|
| 20 | 20 | | education provided in a [residential treatment] facility described |
|---|
| 21 | 21 | | by Section 521.374(a)(2)(A) or (B). |
|---|
| 22 | 22 | | (c) The Texas Department of Criminal Justice or a community |
|---|
| 23 | 23 | | supervision and corrections department established under Chapter |
|---|
| 24 | 24 | | 76, Government Code, operating an equivalent educational program in |
|---|
| 25 | 25 | | a facility described by Section 521.374(a)(2)(A) or (B), as |
|---|
| 26 | 26 | | applicable, shall submit information regarding the program to the |
|---|
| 27 | 27 | | Department of State Health Services for approval under this |
|---|
| 28 | 28 | | subchapter. |
|---|
| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2023. |
