66 AN ACT
77 relating to required reportable disease training for certain health
88 care practitioners.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 3, Occupations Code, is
1111 amended by adding Chapter 117 to read as follows:
1212 CHAPTER 117. TRAINING COURSE ON REPORTABLE DISEASES
1313 Sec. 117.001. DEFINITIONS. In this chapter:
1414 (1) "Commission" means the Health and Human Services
1515 Commission.
1616 (2) "Executive commissioner" means the executive
1717 commissioner of the Health and Human Services Commission.
1818 (3) "Qualifying health care practitioner" means an
1919 individual who:
2020 (A) holds a license, certificate, permit, or
2121 other authorization issued under this title to engage in a health
2222 care profession and who provides direct patient care; and
2323 (B) is required to report a suspected reportable
2424 disease to the local health authority under Section 81.042, Health
2525 and Safety Code.
2626 (4) "Reportable disease" has the meaning assigned by
2727 Section 81.003, Health and Safety Code.
2828 Sec. 117.002. REQUIRED TRAINING COURSE ON PROCEDURES FOR
2929 REPORTABLE DISEASE REPORTING FOR CERTAIN HEALTH CARE
3030 PRACTITIONERS. (a) A qualifying health care practitioner within
3131 the time prescribed by commission rule shall complete a training
3232 course approved by the executive commissioner on the procedures for
3333 reportable disease reporting.
3434 (b) The executive commissioner shall:
3535 (1) approve training courses on the procedures for
3636 reportable disease reporting; and
3737 (2) post a list of the approved training courses on the
3838 commission's Internet website.
3939 (c) An approved training course under Subsection (b) may not
4040 be less than three hours, and must include:
4141 (1) information on the most recent list of reportable
4242 diseases maintained under Section 81.041, Health and Safety Code;
4343 (2) the reporting time requirements for each disease
4444 on the list; and
4545 (3) an overview of state agency rules relating to
4646 reportable diseases.
4747 (d) The executive commissioner shall update the list of
4848 approved training courses described by Subsection (b) as necessary
4949 and consider for approval training courses conducted by health care
5050 facilities.
5151 Sec. 117.003. TRAINING REQUIRED FOR LICENSE RENEWAL. A
5252 qualifying health care practitioner shall complete a training
5353 course described by Section 117.002 as part of the practitioner's
5454 continuing education requirements for renewal of a license,
5555 certificate, permit, or other authorization issued to the health
5656 care practitioner under this title.
5757 SECTION 2. (a) As soon as practicable after the effective
5858 date of this Act, the executive commissioner of the Health and Human
5959 Services Commission shall adopt rules necessary to implement
6060 Chapter 117, Occupations Code, as added by this Act.
6161 (b) Notwithstanding Section 117.002, Occupations Code, as
6262 added by this Act, a health care practitioner is not required to
6363 comply with that section before September 1, 2024.
6464 SECTION 3. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2023.
