9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subtitle A, Title 3, Occupations Code, is |
---|
11 | 11 | | amended by adding Chapter 117 to read as follows: |
---|
12 | 12 | | CHAPTER 117. TRAINING COURSE ON REPORTABLE DISEASES |
---|
13 | 13 | | Sec. 117.001. DEFINITIONS. In this chapter: |
---|
14 | 14 | | (1) "Commission" means the Health and Human Services |
---|
15 | 15 | | Commission. |
---|
16 | 16 | | (2) "Executive commissioner" means the executive |
---|
17 | 17 | | commissioner of the Health and Human Services Commission. |
---|
18 | 18 | | (3) "Qualifying health care practitioner" means an |
---|
19 | 19 | | individual who: |
---|
20 | 20 | | (A) holds a license, certificate, permit, or |
---|
21 | 21 | | other authorization issued under this title to engage in a health |
---|
22 | 22 | | care profession and who provides direct patient care; and |
---|
23 | 23 | | (B) is required to report a suspected reportable |
---|
24 | 24 | | disease to the local health authority under Section 81.042, Health |
---|
25 | 25 | | and Safety Code. |
---|
26 | 26 | | (4) "Reportable disease" has the meaning assigned by |
---|
27 | 27 | | Section 81.003, Health and Safety Code. |
---|
28 | 28 | | Sec. 117.002. REQUIRED TRAINING COURSE ON PROCEDURES FOR |
---|
29 | 29 | | REPORTABLE DISEASE REPORTING FOR CERTAIN HEALTH CARE |
---|
30 | 30 | | PRACTITIONERS. (a) A qualifying health care practitioner within |
---|
31 | 31 | | the time prescribed by commission rule shall complete a training |
---|
32 | 32 | | course approved by the executive commissioner on the procedures for |
---|
33 | 33 | | reportable disease reporting. |
---|
34 | 34 | | (b) The executive commissioner shall: |
---|
35 | 35 | | (1) approve training courses on the procedures for |
---|
36 | 36 | | reportable disease reporting; and |
---|
37 | 37 | | (2) post a list of the approved training courses on the |
---|
38 | 38 | | commission's Internet website. |
---|
39 | 39 | | (c) An approved training course under Subsection (b) may not |
---|
40 | 40 | | be less than three hours, and must include: |
---|
41 | 41 | | (1) information on the most recent list of reportable |
---|
42 | 42 | | diseases maintained under Section 81.041, Health and Safety Code; |
---|
43 | 43 | | (2) the reporting time requirements for each disease |
---|
44 | 44 | | on the list; and |
---|
45 | 45 | | (3) an overview of state agency rules relating to |
---|
46 | 46 | | reportable diseases. |
---|
47 | 47 | | (d) The executive commissioner shall update the list of |
---|
48 | 48 | | approved training courses described by Subsection (b) as necessary |
---|
49 | 49 | | and consider for approval training courses conducted by health care |
---|
50 | 50 | | facilities. |
---|
51 | 51 | | Sec. 117.003. TRAINING REQUIRED FOR LICENSE RENEWAL. A |
---|
52 | 52 | | qualifying health care practitioner shall complete a training |
---|
53 | 53 | | course described by Section 117.002 as part of the practitioner's |
---|
54 | 54 | | continuing education requirements for renewal of a license, |
---|
55 | 55 | | certificate, permit, or other authorization issued to the health |
---|
56 | 56 | | care practitioner under this title. |
---|
57 | 57 | | SECTION 2. (a) As soon as practicable after the effective |
---|
58 | 58 | | date of this Act, the executive commissioner of the Health and Human |
---|
59 | 59 | | Services Commission shall adopt rules necessary to implement |
---|
60 | 60 | | Chapter 117, Occupations Code, as added by this Act. |
---|
61 | 61 | | (b) Notwithstanding Section 117.002, Occupations Code, as |
---|
62 | 62 | | added by this Act, a health care practitioner is not required to |
---|
63 | 63 | | comply with that section before September 1, 2024. |
---|
64 | 64 | | SECTION 3. This Act takes effect immediately if it receives |
---|
65 | 65 | | a vote of two-thirds of all the members elected to each house, as |
---|
66 | 66 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
67 | 67 | | Act does not receive the vote necessary for immediate effect, this |
---|
68 | 68 | | Act takes effect September 1, 2023. |
