| 7 | 7 | | relating to consideration of certain students who are dependents of |

| 8 | 8 | | members of the United States military for purposes of a school |
|---|
| 9 | 9 | | district's dropout records. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 39.308, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (f) to read as follows: |
|---|
| 13 | 13 | | (f) As part of the audit of school district dropout records |
|---|
| 14 | 14 | | under Subsection (a), the commissioner shall determine whether the |
|---|
| 15 | 15 | | district's dropout records include any student who is a dependent |
|---|
| 16 | 16 | | of a member of the United States military and who transferred out of |
|---|
| 17 | 17 | | the school district and enrolled in another district in this state |
|---|
| 18 | 18 | | without notifying the school district. The commissioner shall |
|---|
| 19 | 19 | | exclude any student described by this subsection for purposes of |
|---|
| 20 | 20 | | evaluating dropout and completion rates for the district. |
|---|
| 21 | 21 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 22 | 22 | | school year. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
