| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 29.005(d), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (d) If English is not the native language of the child's |
|---|
| 13 | 13 | | parent [is unable to speak English], the district shall: |
|---|
| 14 | 14 | | (1) provide the parent with a written or audiotaped |
|---|
| 15 | 15 | | copy of the child's individualized education program translated |
|---|
| 16 | 16 | | into Spanish if Spanish is the parent's native language; or |
|---|
| 17 | 17 | | (2) if the parent's native language is a language other |
|---|
| 18 | 18 | | than Spanish, make a good faith effort to provide the parent with a |
|---|
| 19 | 19 | | written or audiotaped copy of the child's individualized education |
|---|
| 20 | 20 | | program translated into the parent's native language. |
|---|
| 21 | 21 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 22 | 22 | | school year. |
|---|
| 23 | 23 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2023. |
