55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to individuals who may provide services as personal
88 attendants under Medicaid and other public benefits programs
99 administered by the Health and Human Services Commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.05115 to read as follows:
1313 Sec. 531.05115. FAMILY MEMBERS AS PERSONAL ATTENDANTS. (a)
1414 In this section:
1515 (1) "Consumer" has the meaning assigned by Section
1616 531.051.
1717 (2) "Personal attendant" means an individual who is
1818 authorized to provide attendant care services to a consumer who is
1919 eligible to receive those services under:
2020 (A) Medicaid, including a waiver or other program
2121 established under:
2222 (i) Section 1115 of the Social Security Act
2323 (42 U.S.C. Section 1315);
2424 (ii) Section 1915(b), (c), or (k) of the
2525 Social Security Act (42 U.S.C. Section 1396n(b), (c), or (k)); or
2626 (iii) Section 1929 of the Social Security
2727 Act (42 U.S.C. Section 1396t); or
2828 (B) a social services block grant under Title XX
2929 of the Social Security Act.
3030 (b) To the extent permitted by federal law, a personal
3131 attendant who provides services to a consumer may be a family member
3232 of the consumer, including the consumer's parent or spouse.
3333 SECTION 2. If before implementing any provision of this Act
3434 a state agency determines that a waiver or authorization from a
3535 federal agency is necessary for implementation of that provision,
3636 the agency affected by the provision shall request the waiver or
3737 authorization and may delay implementing that provision until the
3838 waiver or authorization is granted.
3939 SECTION 3. This Act takes effect September 1, 2023.
