55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to donations ordered to be paid as a condition of community
88 supervision.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Article 42A.304(f), Code of Criminal Procedure,
1111 is amended to read as follows:
1212 (f) Instead of requiring the defendant to work a specified
1313 number of hours at one or more community service projects under
1414 Subsection (a), the judge may order a defendant to make a specified
1515 donation to:
1616 (1) a nonprofit food bank or food pantry in the
1717 community in which the defendant resides;
1818 (2) a charitable organization engaged primarily in
1919 performing charitable functions for veterans in the community in
2020 which the defendant resides; [or]
2121 (3) a veterans county service office established by a
2222 commissioners court under Subchapter B, Chapter 434, Government
2323 Code; or
2424 (4) in a county with a population of less than 50,000,
2525 another nonprofit organization that:
2626 (A) is exempt from taxation under Section 501(a)
2727 of the Internal Revenue Code of 1986 because it is listed in Section
2828 501(c)(3) of that code; and
2929 (B) provides services or assistance to needy
3030 individuals and families in the community in which the defendant
3131 resides.
3232 SECTION 2. This Act takes effect September 1, 2023.
