55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the powers and duties of the Texas Workforce Commission
88 and local workforce development boards regarding the provision of
99 child care.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2308.256(a), Government Code, is amended
1212 to read as follows:
1313 (a) A board is composed as follows:
1414 (1) representatives of the private sector, who:
1515 (A) constitute a majority of the membership of
1616 the board; and
1717 (B) are owners of business concerns, chief
1818 executives or chief operating officers of nongovernmental
1919 employers, or other private sector executives who have substantial
2020 management or policy responsibilities;
2121 (2) representatives of organized labor and
2222 community-based organizations, who constitute not less than 15
2323 percent of the membership of the board; [and]
2424 (3) representatives of the child-care workforce, who
2525 constitute not less than 25 percent of the membership of the board
2626 and who have:
2727 (A) at least five years of experience working in
2828 child-care, early childhood, or out-of-school programs, including
2929 organizations providing care and education services to children
3030 from birth until age 12 and organizations supporting quality or
3131 credentialing for the care and education of children from birth
3232 until age 12; or
3333 (B) expertise in child care or early childhood
3434 education; and
3535 (4) representatives of each of the following:
3636 (A) educational agencies, including community
3737 colleges and secondary and postsecondary practitioners
3838 representing vocational education, that are representative of all
3939 educational agencies in the service delivery area;
4040 (B) vocational rehabilitation agencies;
4141 (C) public assistance agencies;
4242 (D) economic development agencies;
4343 (E) the public employment service;
4444 (F) local literacy councils; and
4545 (G) adult basic and continuing education
4646 organizations.
4747 SECTION 2. Section 2308.3171, Government Code, is amended
4848 by amending Subsection (c) and adding Subsection (c-1) to read as
4949 follows:
5050 (c) Each board shall post in a prominent place on the
5151 board's Internet website home page and at any physical location
5252 where the board provides services:
5353 (1) a list of local designated vendors that are
5454 child-care providers and have a quality child-care indicator listed
5555 in Subsection (a)(1), (2), (3), or (4); [and]
5656 (2) a list of local parenting classes;
5757 (3) information for parents regarding finding quality
5858 child-care providers;
5959 (4) information regarding the value of quality child
6060 care and the Texas Rising Star Program;
6161 (5) information for parents regarding:
6262 (A) eligibility for child-care assistance,
6363 including subsidized child-care services and other child-care
6464 scholarships;
6565 (B) the application process for child-care
6666 assistance; and
6767 (C) determining the status of a financial
6868 assistance application;
6969 (6) information for child-care providers regarding:
7070 (A) the process for accepting children whose
7171 parents receive child-care assistance; and
7272 (B) the Texas Rising Star Program certification
7373 process; and
7474 (7) contact information, including a telephone number
7575 and an e-mail address, where a provider may receive assistance with
7676 questions or bring a grievance.
7777 (c-1) Each local workforce development board shall make the
7878 following information available to the public on a quarterly basis:
7979 (1) data regarding child-care waitlists, including
8080 the number of children in the board's workforce development area
8181 who are:
8282 (A) on a waitlist, disaggregated by age and zip
8383 code based on the child's home address;
8484 (B) taken off a waitlist and enrolled with a
8585 child-care provider under the subsidized child-care program; and
8686 (C) added to a waitlist during the quarter;
8787 (2) the number of children in the board's workforce
8888 development area receiving subsidized child care, disaggregated by
8989 zip code based on the child's home address;
9090 (3) data regarding child-care providers, including
9191 the number of providers in the board's workforce development area
9292 who during the quarter:
9393 (A) improved the provider's Texas Rising Star
9494 Program rating level;
9595 (B) had the provider's Texas Rising Star Program
9696 rating level decrease; and
9797 (C) received quality dollars from the board; and
9898 (4) data regarding the outcomes related to quality
9999 dollars provided by the board to child-care providers in the
100100 board's workforce development area.
101101 SECTION 3. Section 302.0042(d), Labor Code, is amended to
102102 read as follows:
103103 (d) In this section, "quality child care provider" means a
104104 child care provider that:
105105 (1) participates in the commission's Texas Rising Star
106106 Program as a three-star or four-star provider; or
107107 (2) is accredited by the National Early Childhood
108108 Program Accreditation Commission or the National Association for
109109 the Education of Young Children, or holds any other accreditation
110110 the commission determines meets the quality standards of the Texas
111111 Rising Star Program.
112112 SECTION 4. Subchapter A, Chapter 302, Labor Code, is
113113 amended by adding Section 302.00434 to read as follows:
114114 Sec. 302.00434. SUBSIDIZED CHILD-CARE PROGRAM; RULE CHANGE
115115 POLICY. The commission shall develop appropriate written training
116116 and a reasonable timeline for implementing each change the
117117 commission makes to rules regarding the subsidized child-care
118118 program.
119119 SECTION 5. Subchapter A, Chapter 302, Labor Code, is
120120 amended by adding Section 302.0063 to read as follows:
121121 Sec. 302.0063. CHILD CARE PERFORMANCE TARGETS. (a) The
122122 commission shall structure performance targets for child-care
123123 services to allow local workforce development boards to address the
124124 needs in the workforce development area identified by the board
125125 through a community needs assessment.
126126 (b) The commission may establish alternative performance
127127 targets that are set by different metrics including:
128128 (1) the total number of children served by child-care
129129 providers in the board's workforce development area;
130130 (2) the number of children served by Texas Rising Star
131131 Program providers in the board's workforce development area with a
132132 three-star or four-star rating;
133133 (3) the number of infants and toddlers served by
134134 child-care providers in the board's workforce development area;
135135 (4) the number of children served by child-care
136136 providers in the board's workforce development area if the area is
137137 located in:
138138 (A) an area where the number of children younger
139139 than six years of age who have working parents is at least three
140140 times greater than the capacity of licensed child-care providers in
141141 the area; or
142142 (B) an area determined by the commission to be
143143 underserved with respect to child-care providers; and
144144 (5) the number of children served by providers in the
145145 board's workforce development area who provide care during
146146 non-traditional hours.
147147 (c) The commission by rule shall:
148148 (1) define the approval process for the alternative
149149 performance targets described by Subsection (b);
150150 (2) develop the components of and procedures for
151151 administering a community needs assessment in local workforce
152152 development areas; and
153153 (3) determine the allocation of funds to meet
154154 alternative performance targets.
155155 SECTION 6. Section 2308.256(g), Government Code, is
156156 repealed.
157157 SECTION 7. This Act takes effect September 1, 2023.
