66 relating to prohibiting the distribution or sale of certain

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter E, Chapter 443, Health and Safety
1010 Code, is amended by adding Section 443.2055 to read as follows:
1111 Sec. 443.2055. DISTRIBUTION OR SALE OF CERTAIN FLAVORED
1212 CONSUMABLE HEMP PRODUCTS PROHIBITED. (a) A person commits an
1313 offense if the person knowingly distributes, sells, or possesses
1414 with intent to distribute or sell a consumable hemp product that is
1515 marketed or packaged to appear similar to a candy.
1616 (b) An offense under this section is a felony of the second
1717 degree.
1818 SECTION 2. This Act takes effect September 1, 2023.
