| 7 | 7 | | relating to the authorization for and transfer of a charter for an |
|---|
| 8 | 8 | | adult high school charter school program. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 12.255, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (b-1) and (f) and amending Subsections (d) and |
|---|
| 12 | 12 | | (e) to read as follows: |
|---|
| 13 | 13 | | (b-1) A charter granted under former Section 29.259 may be |
|---|
| 14 | 14 | | transferred by the charter holder to a nonprofit entity described |
|---|
| 15 | 15 | | by Section 12.256 if the commissioner is provided notice of the |
|---|
| 16 | 16 | | transfer. |
|---|
| 17 | 17 | | (d) A charter granted under former Section 29.259 or |
|---|
| 18 | 18 | | transferred by the charter holder to a nonprofit entity under |
|---|
| 19 | 19 | | Subsection (b-1) may not be counted toward the limit under |
|---|
| 20 | 20 | | Subsection (c). |
|---|
| 21 | 21 | | (e) Except as provided by Subsection (f), a [A] nonprofit |
|---|
| 22 | 22 | | entity granted a charter under the program may not enroll more than |
|---|
| 23 | 23 | | 350 students in an adult education program operated under that |
|---|
| 24 | 24 | | charter during the first two years after the charter is granted. |
|---|
| 25 | 25 | | (f) Subsection (e) [This subsection] does not apply to: |
|---|
| 26 | 26 | | (1) a charter granted under former Section 29.259; |
|---|
| 27 | 27 | | (2) a[, regardless of whether that] charter [is] |
|---|
| 28 | 28 | | transferred under Subsection (b-1); or |
|---|
| 29 | 29 | | (3) a charter granted under Subsection (c) to a |
|---|
| 30 | 30 | | nonprofit entity that operates an open-enrollment charter school |
|---|
| 31 | 31 | | designated as a dropout recovery school under Section 39.0548 that |
|---|
| 32 | 32 | | has graduated not less than 1,000 students in each of the three |
|---|
| 33 | 33 | | school years preceding the school year in which the nonprofit |
|---|
| 34 | 34 | | entity begins operating an adult education program [to another |
|---|
| 35 | 35 | | nonprofit entity as provided by law]. |
|---|
| 36 | 36 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 37 | 37 | | school year. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2023. |
