| 5 | 5 | | relating to the disposition of surplus real property no longer |

| 6 | 6 | | needed for state highway purposes. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 8 | 8 | | SECTION 1. Sections 202.021(d) and (h), Transportation |
|---|
| 9 | 9 | | Code, are amended to read as follows: |
|---|
| 10 | 10 | | (d) The commission shall: |
|---|
| 11 | 11 | | (1) determine the fair value of the state's interest in |
|---|
| 12 | 12 | | the real property; and |
|---|
| 13 | 13 | | (2) if the value is $100,000 [$10,000] or more, advise |
|---|
| 14 | 14 | | the governor of the value. |
|---|
| 15 | 15 | | (h) If the commission determines that the value of the real |
|---|
| 16 | 16 | | property is less than $100,000 [$10,000], it may authorize the |
|---|
| 17 | 17 | | executive director to execute a deed conveying the state's interest |
|---|
| 18 | 18 | | in the property without a recommendation to the governor. |
|---|
| 19 | 19 | | SECTION 2. Section 202.030(a), Transportation Code, is |
|---|
| 20 | 20 | | amended to read as follows: |
|---|
| 21 | 21 | | (a) The attorney general must approve a transfer or |
|---|
| 22 | 22 | | conveyance that is made under this subchapter if the value of the |
|---|
| 23 | 23 | | real property transferred or conveyed is $100,000 [$10,000] or |
|---|
| 24 | 24 | | more. |
|---|
| 25 | 25 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 26 | 26 | | to an interest in real property that is recommended to the governor |
|---|
| 27 | 27 | | for sale or transfer on or after the effective date of this Act. An |
|---|
| 28 | 28 | | interest recommended to the governor for sale or transfer before |
|---|
| 29 | 29 | | the effective date of this Act is governed by the law in effect |
|---|
| 30 | 30 | | immediately before the effective date of this Act, and that law is |
|---|
| 31 | 31 | | continued in effect for that purpose. |
|---|
| 32 | 32 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2023. |
