| 10 | 10 | SECTION 1. Section 121.002, Utilities Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | Sec. 121.002. APPLICABILITY TO AFFILIATE OF GAS UTILITY | |
| 13 | 13 | [EXCLUDED]. (a) In this section, "affiliate" has the meaning | |
| 14 | 14 | assigned by Section 101.003. | |
| 15 | 15 | (b) A person is [not] a gas utility for the purposes of this | |
| 16 | 16 | chapter if [solely because] the person: | |
| 17 | 17 | (1) is an affiliate of a gas utility; and | |
| 18 | 18 | (2) provides gas sales or marketing services. | |
| 19 | 19 | SECTION 2. This Act takes effect September 1, 2023. |
