6	6	AN ACT
7	7	relating to the pediatric acute-onset neuropsychiatric syndrome
8	8	advisory council.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 119A.003, Health and Safety Code, is
11	11	amended by amending Subsection (a) and adding Subsection (d) to
12	12	read as follows:
13	13	(a) The advisory council is composed of the following 19
14	14	members:
15	15	(1) one member designated by the executive
16	16	commissioner;
17	17	(2) two members of the senate appointed by the
18	18	lieutenant governor;
19	19	(3) two members of the house of representatives
20	20	appointed by the speaker of the house of representatives; and
21	21	(4) 14 members appointed by the governor with the
22	22	following qualifications:
23	23	(A) three members who are health care providers,
24	24	as defined by Section 161.201;
25	25	(B) one member who is a licensed health care
26	26	provider with expertise in treating persons with pediatric
27	27	acute-onset neuropsychiatric syndrome, including pediatric
28	28	autoimmune neuropsychiatric disorders associated with
29	29	streptococcal infections, and autism;
30	30	[(B) one member who is an osteopathic physician
31	31	with experience treating persons with pediatric acute-onset
32	32	neuropsychiatric syndrome, including pediatric autoimmune
33	33	neuropsychiatric disorders associated with streptococcal
34	34	infections;]
35	35	(C) one member who is a pediatrician with
36	36	experience treating persons with pediatric acute-onset
37	37	neuropsychiatric syndrome, including pediatric autoimmune
38	38	neuropsychiatric disorders associated with streptococcal
39	39	infections;
40	40	(D) one member who is a child psychiatrist with
41	41	experience treating persons with pediatric acute-onset
42	42	neuropsychiatric syndrome, including pediatric autoimmune
43	43	neuropsychiatric disorders associated with streptococcal
44	44	infections;
45	45	(E) [one member who is an immunologist with
46	46	experience treating persons with pediatric acute-onset
47	47	neuropsychiatric syndrome, including pediatric autoimmune
48	48	neuropsychiatric disorders associated with streptococcal
49	49	infections, and the use of intravenous immunoglobulin;
50	50	[(F) one member who is a dietician or
51	51	nutritionist who provides services to children with autism spectrum
52	52	disorders, attention-deficit/hyperactivity disorders, and other
53	53	neuro-developmental conditions;
54	54	[(G)] one member with experience in conducting
55	55	research on pediatric acute-onset neuropsychiatric syndrome,
56	56	including pediatric autoimmune neuropsychiatric disorders
57	57	associated with streptococcal infections, obsessive-compulsive
58	58	disorder, tic disorders, and other neurological disorders;
59	59	(F) [(H)] one member who is [licensed by this
60	60	state to practice as] a social worker;
61	61	(G) [(I)] one member who is a representative of
62	62	the Texas Education Agency with expertise in special education
63	63	services;
64	64	(H) [(J)] one member who is a psychologist
65	65	licensed under Chapter 501, Occupations Code;
66	66	(I) [(K)] one member who is a representative of a
67	67	professional organization in this state for school nurses;
68	68	(J) [(L)] one member who is a representative of
69	69	an advocacy and support group in this state for individuals
70	70	affected by pediatric acute-onset neuropsychiatric syndrome,
71	71	including pediatric autoimmune neuropsychiatric disorders
72	72	associated with streptococcal infections;
73	73	(K) [(M)] one member who is a representative of
74	74	an advocacy and support group in this state for individuals
75	75	affected by autism; and
76	76	(L) [(N)] one member who is a parent of a child
77	77	who has been diagnosed with pediatric acute-onset neuropsychiatric
78	78	syndrome or autism.
79	79	(d) An advisory council member appointed under Subsection
80	80	(a)(2) or (3) may designate another individual to serve in the
81	81	member's place on the advisory council at the pleasure of the
82	82	member. An advisory council member who designates another
83	83	individual to serve in the member's place under this subsection
84	84	shall provide written notification to the chair of the advisory
85	85	council.
86	86	SECTION 2. Section 119A.005, Health and Safety Code, is
87	87	amended to read as follows:
88	88	Sec. 119A.005. CHAIR AND VICE CHAIR. Members of the
89	89	advisory council shall elect from among its [the legislative]
90	90	members by a majority vote [of the advisory council] a chair and
91	91	vice chair.
92	92	SECTION 3. This Act takes effect September 1, 2023.
