55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the pediatric acute-onset neuropsychiatric syndrome
88 advisory council.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 119A.003, Health and Safety Code, is
1111 amended by amending Subsection (a) and adding Subsection (d) to
1212 read as follows:
1313 (a) The advisory council is composed of the following 19
1414 members:
1515 (1) one member designated by the executive
1616 commissioner;
1717 (2) two members of the senate appointed by the
1818 lieutenant governor;
1919 (3) two members of the house of representatives
2020 appointed by the speaker of the house of representatives; and
2121 (4) 14 members appointed by the governor with the
2222 following qualifications:
2323 (A) three members who are health care providers,
2424 as defined by Section 161.201;
2525 (B) one member who is a licensed health care
2626 provider with expertise in treating persons with pediatric
2727 acute-onset neuropsychiatric syndrome, including pediatric
2828 autoimmune neuropsychiatric disorders associated with
2929 streptococcal infections, and autism;
3030 [(B) one member who is an osteopathic physician
3131 with experience treating persons with pediatric acute-onset
3232 neuropsychiatric syndrome, including pediatric autoimmune
3333 neuropsychiatric disorders associated with streptococcal
3434 infections;]
3535 (C) one member who is a pediatrician with
3636 experience treating persons with pediatric acute-onset
3737 neuropsychiatric syndrome, including pediatric autoimmune
3838 neuropsychiatric disorders associated with streptococcal
3939 infections;
4040 (D) one member who is a child psychiatrist with
4141 experience treating persons with pediatric acute-onset
4242 neuropsychiatric syndrome, including pediatric autoimmune
4343 neuropsychiatric disorders associated with streptococcal
4444 infections;
4545 (E) [one member who is an immunologist with
4646 experience treating persons with pediatric acute-onset
4747 neuropsychiatric syndrome, including pediatric autoimmune
4848 neuropsychiatric disorders associated with streptococcal
4949 infections, and the use of intravenous immunoglobulin;
5050 [(F) one member who is a dietician or
5151 nutritionist who provides services to children with autism spectrum
5252 disorders, attention-deficit/hyperactivity disorders, and other
5353 neuro-developmental conditions;
5454 [(G)] one member with experience in conducting
5555 research on pediatric acute-onset neuropsychiatric syndrome,
5656 including pediatric autoimmune neuropsychiatric disorders
5757 associated with streptococcal infections, obsessive-compulsive
5858 disorder, tic disorders, and other neurological disorders;
5959 (F) [(H)] one member who is [licensed by this
6060 state to practice as] a social worker;
6161 (G) [(I)] one member who is a representative of
6262 the Texas Education Agency with expertise in special education
6363 services;
6464 (H) [(J)] one member who is a psychologist
6565 licensed under Chapter 501, Occupations Code;
6666 (I) [(K)] one member who is a representative of a
6767 professional organization in this state for school nurses;
6868 (J) [(L)] one member who is a representative of
6969 an advocacy and support group in this state for individuals
7070 affected by pediatric acute-onset neuropsychiatric syndrome,
7171 including pediatric autoimmune neuropsychiatric disorders
7272 associated with streptococcal infections;
7373 (K) [(M)] one member who is a representative of
7474 an advocacy and support group in this state for individuals
7575 affected by autism; and
7676 (L) [(N)] one member who is a parent of a child
7777 who has been diagnosed with pediatric acute-onset neuropsychiatric
7878 syndrome or autism.
7979 (d) An advisory council member appointed under Subsection
8080 (a)(2) or (3) may designate another individual to serve in the
8181 member's place on the advisory council at the pleasure of the
8282 member. An advisory council member who designates another
8383 individual to serve in the member's place under this subsection
8484 shall provide written notification to the chair of the advisory
8585 council.
8686 SECTION 2. Section 119A.005, Health and Safety Code, is
8787 amended to read as follows:
8888 Sec. 119A.005. CHAIR AND VICE CHAIR. Members of the
8989 advisory council shall elect from among its [the legislative]
9090 members by a majority vote [of the advisory council] a chair and
9191 vice chair.
9292 SECTION 3. This Act takes effect September 1, 2023.
