55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the inclusion of Junior Reserve Officer Training Corps
88 and Leadership Officer Training Corps programs as public school
99 career and technology education programs and the indicator of
1010 achievement for military readiness under the public school
1111 accountability system.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 29.182(b), Education Code, is amended to
1414 read as follows:
1515 (b) The state plan must include procedures designed to
1616 ensure that:
1717 (1) all secondary and postsecondary students have the
1818 opportunity to participate in career and technology education
1919 programs;
2020 (2) the state complies with requirements for
2121 supplemental federal career and technology education funding;
2222 (3) career and technology education is established as
2323 a part of the total education system of this state and constitutes
2424 an option for student learning that provides a rigorous course of
2525 study consistent with the required curriculum under Section 28.002
2626 and under which a student may receive specific education in a career
2727 and technology program that:
2828 (A) incorporates competencies leading to
2929 academic and technical skill attainment;
3030 (B) leads to:
3131 (i) an industry-recognized license,
3232 credential, or certificate; or
3333 (ii) at the postsecondary level, an
3434 associate or baccalaureate degree;
3535 (C) includes opportunities for students to earn
3636 college credit for coursework; and
3737 (D) includes, as an integral part of the program,
3838 participation by students and teachers in activities of career and
3939 technical student organizations supported by the agency and the
4040 State Board of Education; [and]
4141 (4) a school district provides, to the greatest extent
4242 possible, to a student participating in a career and technology
4343 education program opportunities to enroll in dual credit courses
4444 designed to lead to a degree, license, or certification as part of
4545 the program; and
4646 (5) courses of study in a Junior Reserve Officer
4747 Training Corps program or Leadership Officer Training Corps program
4848 are provided as part of a career and technology education program.
4949 SECTION 2. Section 39.053(c), Education Code, is amended to
5050 read as follows:
5151 (c) School districts and campuses must be evaluated based on
5252 three domains of indicators of achievement adopted under this
5353 section that include:
5454 (1) in the student achievement domain, indicators of
5555 student achievement that must include:
5656 (A) for evaluating the performance of districts
5757 and campuses generally:
5858 (i) an indicator that accounts for the
5959 results of assessment instruments required under Sections
6060 39.023(a), (c), and (l), as applicable for the district and campus,
6161 including the results of assessment instruments required for
6262 graduation retaken by a student, aggregated across grade levels by
6363 subject area, including:
6464 (a) for the performance standard
6565 determined by the commissioner under Section 39.0241(a), the
6666 percentage of students who performed satisfactorily on the
6767 assessment instruments, aggregated across grade levels by subject
6868 area; and
6969 (b) for the college readiness
7070 performance standard as determined under Section 39.0241, the
7171 percentage of students who performed satisfactorily on the
7272 assessment instruments, aggregated across grade levels by subject
7373 area; and
7474 (ii) an indicator that accounts for the
7575 results of assessment instruments required under Section
7676 39.023(b), as applicable for the district and campus, including the
7777 percentage of students who performed satisfactorily on the
7878 assessment instruments, as determined by the performance standard
7979 adopted by the agency, aggregated across grade levels by subject
8080 area; and
8181 (B) for evaluating the performance of high school
8282 campuses and districts that include high school campuses,
8383 indicators that account for:
8484 (i) students who satisfy the Texas Success
8585 Initiative (TSI) college readiness benchmarks prescribed by the
8686 Texas Higher Education Coordinating Board under Section 51.334 on
8787 an assessment instrument in reading or mathematics designated by
8888 the coordinating board under that section;
8989 (ii) students who satisfy relevant
9090 performance standards on advanced placement tests or similar
9191 assessments;
9292 (iii) students who earn dual course credits
9393 in the dual credit courses;
9494 (iv) students who demonstrate military
9595 readiness by:
9696 (a) enlisting [enlist] in the armed
9797 forces of the United States or the Texas National Guard;
9898 (b) achieving a passing score set by
9999 the applicable military branch on the Armed Services Vocational
100100 Aptitude Battery test; or
101101 (c) successfully completing a Junior
102102 Reserve Officer Training Corps program;
103103 (v) students who earn industry
104104 certifications;
105105 (vi) students admitted into postsecondary
106106 industry certification programs that require as a prerequisite for
107107 entrance successful performance at the secondary level;
108108 (vii) students whose successful completion
109109 of a course or courses under Section 28.014 indicates the student's
110110 preparation to enroll and succeed, without remediation, in an
111111 entry-level general education course for a baccalaureate degree or
112112 associate degree;
113113 (viii) students who successfully met
114114 standards on a composite of indicators that through research
115115 indicates the student's preparation to enroll and succeed, without
116116 remediation, in an entry-level general education course for a
117117 baccalaureate degree or associate degree;
118118 (ix) high school graduation rates, computed
119119 in accordance with standards and definitions adopted in compliance
120120 with the Every Student Succeeds Act (20 U.S.C. Section 6301 et seq.)
121121 subject to the exclusions provided by Subsections (g), (g-1),
122122 (g-2), (g-3), and (g-4);
123123 (x) students who successfully completed an
124124 OnRamps dual enrollment course;
125125 (xi) students who successfully completed a
126126 practicum or internship approved by the State Board of Education;
127127 (xii) students who are awarded an associate
128128 degree; and
129129 (xiii) students who successfully completed
130130 a program of study in career and technical education;
131131 (2) in the school progress domain, indicators for
132132 effectiveness in promoting student learning, which must include:
133133 (A) for assessment instruments, including
134134 assessment instruments under Subdivisions (1)(A)(i) and (ii), the
135135 percentage of students who met the standard for improvement, as
136136 determined by the commissioner; and
137137 (B) for evaluating relative performance, the
138138 performance of districts and campuses compared to similar districts
139139 or campuses; and
140140 (3) in the closing the gaps domain, the use of
141141 disaggregated data to demonstrate the differentials among students
142142 from different racial and ethnic groups, socioeconomic
143143 backgrounds, and other factors, including:
144144 (A) students formerly receiving special
145145 education services;
146146 (B) students continuously enrolled; and
147147 (C) students who are mobile.
148148 SECTION 3. Section 48.106, Education Code, is amended by
149149 adding Subsection (a-2) to read as follows:
150150 (a-2) In addition to the amounts under Subsections (a) and
151151 (a-1), a district is entitled to an annual allotment equal to the
152152 basic allotment, or if applicable, the sum of the basic allotment
153153 and the allotment under Section 48.101 to which the district is
154154 entitled, multiplied by:
155155 (1) 1.28 for each student enrolled in an approved
156156 Leadership Officer Training Corps program, as determined by the
157157 agency; and
158158 (2) 1.47 for each student enrolled in an approved
159159 Junior Reserve Officer Training Corps program, as determined by the
160160 agency.
161161 SECTION 4. This Act applies beginning with the 2023-2024
162162 school year.
163163 SECTION 5. This Act takes effect immediately if it receives
164164 a vote of two-thirds of all the members elected to each house, as
165165 provided by Section 39, Article III, Texas Constitution. If this
166166 Act does not receive the vote necessary for immediate effect, this
167167 Act takes effect September 1, 2023.
