55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a law enforcement agency's use of deadly force by means
88 of a drone.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 9.54, Penal Code, is amended by amending
1111 Subsection (b) and adding Subsection (c) to read as follows:
1212 (b) Notwithstanding any other law and subject to Subsection
1313 (c), the use of force, including deadly force, involving a drone is
1414 justified under this subchapter only if:
1515 (1) at the time the use of force occurred, the actor
1616 was employed by a law enforcement agency;
1717 (2) the use of force:
1818 (A) would have been justified under another
1919 provision of this subchapter; and
2020 (B) did not involve the use of deadly force by
2121 means of an autonomous drone; and
2222 (3) before the use of force occurred, the law
2323 enforcement agency employing the actor adopted and submitted to the
2424 Texas Commission on Law Enforcement a policy on the agency's use of
2525 force by means of a drone, as required by Article 2.33, Code of
2626 Criminal Procedure, and the use of force conformed to the
2727 requirements of that policy.
2828 (c) The use of deadly force involving a drone is justified
2929 under Subsection (b) only if:
3030 (1) the actor reasonably believes that the use of
3131 deadly force by means of a drone is necessary to protect the actor
3232 or another from an imminent threat of death or serious bodily
3333 injury; and
3434 (2) before the actor's use of deadly force occurred,
3535 the head of the law enforcement agency employing the actor, on a
3636 case-by-case basis, specifically approved the actor's use of deadly
3737 force by means of a drone.
3838 SECTION 2. The change in law made by this Act applies only
3939 to an offense committed on or after the effective date of this Act.
4040 An offense committed before the effective date of this Act is
4141 governed by the law in effect on the date the offense was committed,
4242 and the former law is continued in effect for that purpose. For
4343 purposes of this section, an offense was committed before the
4444 effective date of this Act if any element of the offense occurred
4545 before that date.
4646 SECTION 3. This Act takes effect September 1, 2023.
