66 AN ACT
77 relating to a grant program for technological enhancements at
88 certain health care facilities that provide mental health care
99 services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.09915 to read as follows:
1313 Sec. 531.09915. GRANT PROGRAM FOR TECHNOLOGICAL
1414 ENHANCEMENTS AT CERTAIN HEALTH CARE FACILITIES PROVIDING MENTAL
1515 HEALTH CARE SERVICES. (a) In this section, "health care facility"
1616 means:
1717 (1) a hospital licensed under Chapter 241, Health and
1818 Safety Code, that is located in a rural county; or
1919 (2) a hospital licensed under Chapter 577, Health and
2020 Safety Code.
2121 (b) The commission shall establish a grant program for the
2222 purpose of enhancing the technological capabilities of health care
2323 facilities providing mental health care services in this state.
2424 (c) To be eligible for a grant under this section, a health
2525 care facility must:
2626 (1) demonstrate how the grant money will be used to
2727 improve the quality of and access to mental health care services in
2828 this state;
2929 (2) align with the interoperability and technology
3030 standards in the 21st Century Cures Act (Pub. L. No. 114-255); and
3131 (3) meet any other additional eligibility criteria
3232 established by the commission.
3333 (d) A health care facility awarded a grant under this
3434 section may use the grant money to:
3535 (1) purchase a recordkeeping platform that uses a
3636 certified electronic health record;
3737 (2) expand the interoperability of health information
3838 in the health care facility or as part of a network with other
3939 health care providers;
4040 (3) expand a patient's access to the patient's digital
4141 health records and mental health care services;
4242 (4) improve information technology infrastructure
4343 regarding the data privacy and security of patient information,
4444 including consent management; and
4545 (5) improve the efficiency of the provision of mental
4646 health care services through the use and interconnectivity of
4747 mobile devices.
4848 (e) The commission may solicit and accept gifts, grants, and
4949 donations from any source for the purposes of awarding grants under
5050 this section.
5151 (f) Not later than December 1 of each even-numbered year,
5252 the commission shall submit a report to the legislature regarding
5353 the results of the grant program administered under this section.
5454 (g) The commission may adopt any rules necessary to
5555 implement this section.
5656 SECTION 2. This Act takes effect September 1, 2023.
