| 8 | 8 | | certain health care facilities that provide mental health care |
|---|
| 9 | 9 | | services. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 531, Government Code, is |
|---|
| 12 | 12 | | amended by adding Section 531.09915 to read as follows: |
|---|
| 13 | 13 | | Sec. 531.09915. GRANT PROGRAM FOR TECHNOLOGICAL |
|---|
| 14 | 14 | | ENHANCEMENTS AT CERTAIN HEALTH CARE FACILITIES PROVIDING MENTAL |
|---|
| 15 | 15 | | HEALTH CARE SERVICES. (a) In this section, "health care facility" |
|---|
| 16 | 16 | | means: |
|---|
| 17 | 17 | | (1) a hospital licensed under Chapter 241, Health and |
|---|
| 18 | 18 | | Safety Code, that is located in a rural county; or |
|---|
| 19 | 19 | | (2) a hospital licensed under Chapter 577, Health and |
|---|
| 20 | 20 | | Safety Code. |
|---|
| 21 | 21 | | (b) The commission shall establish a grant program for the |
|---|
| 22 | 22 | | purpose of enhancing the technological capabilities of health care |
|---|
| 23 | 23 | | facilities providing mental health care services in this state. |
|---|
| 24 | 24 | | (c) To be eligible for a grant under this section, a health |
|---|
| 25 | 25 | | care facility must: |
|---|
| 26 | 26 | | (1) demonstrate how the grant money will be used to |
|---|
| 27 | 27 | | improve the quality of and access to mental health care services in |
|---|
| 28 | 28 | | this state; |
|---|
| 29 | 29 | | (2) align with the interoperability and technology |
|---|
| 30 | 30 | | standards in the 21st Century Cures Act (Pub. L. No. 114-255); and |
|---|
| 31 | 31 | | (3) meet any other additional eligibility criteria |
|---|
| 32 | 32 | | established by the commission. |
|---|
| 33 | 33 | | (d) A health care facility awarded a grant under this |
|---|
| 34 | 34 | | section may use the grant money to: |
|---|
| 35 | 35 | | (1) purchase a recordkeeping platform that uses a |
|---|
| 36 | 36 | | certified electronic health record; |
|---|
| 37 | 37 | | (2) expand the interoperability of health information |
|---|
| 38 | 38 | | in the health care facility or as part of a network with other |
|---|
| 39 | 39 | | health care providers; |
|---|
| 40 | 40 | | (3) expand a patient's access to the patient's digital |
|---|
| 41 | 41 | | health records and mental health care services; |
|---|
| 42 | 42 | | (4) improve information technology infrastructure |
|---|
| 43 | 43 | | regarding the data privacy and security of patient information, |
|---|
| 44 | 44 | | including consent management; and |
|---|
| 45 | 45 | | (5) improve the efficiency of the provision of mental |
|---|
| 46 | 46 | | health care services through the use and interconnectivity of |
|---|
| 47 | 47 | | mobile devices. |
|---|
| 48 | 48 | | (e) The commission may solicit and accept gifts, grants, and |
|---|
| 49 | 49 | | donations from any source for the purposes of awarding grants under |
|---|
| 50 | 50 | | this section. |
|---|
| 51 | 51 | | (f) Not later than December 1 of each even-numbered year, |
|---|
| 52 | 52 | | the commission shall submit a report to the legislature regarding |
|---|
| 53 | 53 | | the results of the grant program administered under this section. |
|---|
| 54 | 54 | | (g) The commission may adopt any rules necessary to |
|---|
| 55 | 55 | | implement this section. |
|---|
| 56 | 56 | | SECTION 2. This Act takes effect September 1, 2023. |
