49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to preparing and delivering precinct election returns;
712 increasing a criminal penalty.
813 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
914 SECTION 1. Section 65.014(e), Election Code, is amended to
1015 read as follows:
1116 (e) An offense under Subsection (d) is a Class A [B]
1217 misdemeanor.
1318 SECTION 2. Section 66.055, Election Code, is amended to
1419 read as follows:
1520 Sec. 66.055. FAILURE TO DELIVER [JUDICIAL IMPOUNDMENT OF]
1621 ELECTION RECORDS. (a) If the precinct election records are not
1722 delivered by the deadline prescribed by Section 66.053(c):
1823 (1) the secretary of state may supervise the
1924 activities necessary to complete the count, prepare the precinct
2025 returns, and distribute the records; or
2126 (2) [,] on application by a member of the canvassing
2227 authority, a district judge shall order the precinct election
2328 records to be impounded.
2429 (b) If the precinct election records are impounded under
2530 Subsection (a)(2), the [The] district judge shall supervise the
2631 activities necessary to complete the count, prepare the precinct
2732 returns, and distribute the records.
2833 SECTION 3. The change in law made by this Act in amending
2934 Section 65.014(e), Election Code, applies only to an offense
3035 committed on or after the effective date of this Act. An offense
3136 committed before the effective date of this Act is governed by the
3237 law in effect on the date the offense was committed, and the former
3338 law is continued in effect for that purpose. For purposes of this
3439 section, an offense was committed before the effective date of this
3540 Act if any element of the offense occurred before that date.
3641 SECTION 4. This Act takes effect September 1, 2023.
