44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the accreditation of private or independent
77 institutions of higher education.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 61.003(15), Education Code, is amended
1010 to read as follows:
1111 (15) "Private or independent institution of higher
1212 education" includes only a private or independent college or
1313 university that is:
1414 (A) organized under the Texas Non-Profit
1515 Corporation Act (Article 1396-1.01 et seq., Vernon's Texas Civil
1616 Statutes);
1717 (B) exempt from taxation under Article VIII,
1818 Section 2, of the Texas Constitution and Section 501(c)(3) of the
1919 Internal Revenue Code of 1986 (26 U.S.C. Section 501); and
2020 (C) accredited by:
2121 (i) the Commission on Colleges of the
2222 Southern Association of Colleges and Schools;
2323 (ii) the Liaison Committee on Medical
2424 Education; [or]
2525 (iii) the American Bar Association; or
2626 (iv) a recognized accrediting agency.
2727 SECTION 2. This Act takes effect September 1, 2023.
