55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the reimbursement of certain durable medical equipment
88 providers participating in the Medicaid managed care program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 533.005, Government Code, is amended by
1111 adding Subsection (i) to read as follows:
1212 (i) In addition to the requirements specified by Subsection
1313 (a) and notwithstanding any other law, a contract described by that
1414 subsection must require the managed care organization to reimburse
1515 a specialty provider of durable medical equipment and related
1616 supplies and services who provides the equipment, supplies, or
1717 services to a recipient at a rate that is at least equal to 95
1818 percent of the rate paid under the Medicaid fee-for-service fee
1919 schedule.
2020 SECTION 2. (a) The Health and Human Services Commission
2121 shall, in a contract between the commission and a managed care
2222 organization under Chapter 533, Government Code, that is entered
2323 into or renewed on or after the effective date of this Act, require
2424 that the managed care organization comply with Section 533.005(i),
2525 Government Code, as added by this Act.
2626 (b) The Health and Human Services Commission shall seek to
2727 amend contracts entered into with managed care organizations under
2828 Chapter 533, Government Code, before the effective date of this Act
2929 to require those managed care organizations to comply with Section
3030 533.005(i), Government Code, as added by this Act. To the extent of
3131 a conflict between Section 533.005(i), Government Code, as added by
3232 this Act, and a provision of a contract with a managed care
3333 organization entered into before the effective date of this Act,
3434 the contract provision prevails.
3535 SECTION 3. If before implementing any provision of this Act
3636 a state agency determines that a waiver or authorization from a
3737 federal agency is necessary for implementation of that provision,
3838 the agency affected by the provision shall request the waiver or
3939 authorization and may delay implementing that provision until the
4040 waiver or authorization is granted.
4141 SECTION 4. This Act takes effect September 1, 2023.
