55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the payment of certain fines and costs by a defendant.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 42.15, Code of Criminal Procedure, is
1010 amended by adding Subsection (a-2) and amending Subsection (b) to
1111 read as follows:
1212 (a-2) When imposing fines and costs, a court may not require
1313 a defendant to pay more than five percent of the defendant's monthly
1414 income to satisfy the fines and costs, without the agreement of the
1515 defendant.
1616 (b) Subject to Subsections (a-2), (c), and (d) and Article
1717 43.091, when imposing fines [a fine] and costs, a court may direct a
1818 defendant:
1919 (1) to pay the entire amount of fines [fine] and costs
2020 when sentence is pronounced;
2121 (2) to pay the entire amount of fines [fine] and costs
2222 at some later date; or
2323 (3) to pay a specified portion of the fines [fine] and
2424 costs at designated intervals.
2525 SECTION 2. The change in law made by this Act applies to a
2626 defendant who is sentenced for an offense on or after the effective
2727 date of this Act, regardless of whether the offense is committed
2828 before, on, or after that date.
2929 SECTION 3. This Act takes effect September 1, 2023.
