8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Article 42.15, Code of Criminal Procedure, is |
---|
10 | 10 | | amended by adding Subsection (a-2) and amending Subsection (b) to |
---|
11 | 11 | | read as follows: |
---|
12 | 12 | | (a-2) When imposing fines and costs, a court may not require |
---|
13 | 13 | | a defendant to pay more than five percent of the defendant's monthly |
---|
14 | 14 | | income to satisfy the fines and costs, without the agreement of the |
---|
15 | 15 | | defendant. |
---|
16 | 16 | | (b) Subject to Subsections (a-2), (c), and (d) and Article |
---|
17 | 17 | | 43.091, when imposing fines [a fine] and costs, a court may direct a |
---|
18 | 18 | | defendant: |
---|
19 | 19 | | (1) to pay the entire amount of fines [fine] and costs |
---|
20 | 20 | | when sentence is pronounced; |
---|
21 | 21 | | (2) to pay the entire amount of fines [fine] and costs |
---|
22 | 22 | | at some later date; or |
---|
23 | 23 | | (3) to pay a specified portion of the fines [fine] and |
---|
24 | 24 | | costs at designated intervals. |
---|
25 | 25 | | SECTION 2. The change in law made by this Act applies to a |
---|
26 | 26 | | defendant who is sentenced for an offense on or after the effective |
---|
27 | 27 | | date of this Act, regardless of whether the offense is committed |
---|
28 | 28 | | before, on, or after that date. |
---|
29 | 29 | | SECTION 3. This Act takes effect September 1, 2023. |
