9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Articles 42A.053(f) and (g), Code of Criminal |
---|
11 | 11 | | Procedure, are amended to read as follows: |
---|
12 | 12 | | (f) The maximum period of community supervision in a |
---|
13 | 13 | | misdemeanor case is the same as the maximum term of confinement |
---|
14 | 14 | | applicable to the offense [two years]. |
---|
15 | 15 | | (g) Notwithstanding Subsection (d)(2) [or (f)], a judge may |
---|
16 | 16 | | extend the maximum period of community supervision in a felony case |
---|
17 | 17 | | in the manner provided by Article 42A.753 or 42A.757. |
---|
18 | 18 | | SECTION 2. Article 42A.753(a), Code of Criminal Procedure, |
---|
19 | 19 | | is amended to read as follows: |
---|
20 | 20 | | (a) On a showing of good cause, the judge may extend a period |
---|
21 | 21 | | of community supervision under Article 42A.752(a)(2) as frequently |
---|
22 | 22 | | as the judge determines is necessary, but the period of community |
---|
23 | 23 | | supervision in a first, second, or third degree felony case may not |
---|
24 | 24 | | exceed 10 years and[, except as otherwise provided by Subsection |
---|
25 | 25 | | (b),] the period of community supervision in a misdemeanor case may |
---|
26 | 26 | | not exceed the maximum term of confinement applicable to the |
---|
27 | 27 | | offense [three years]. |
---|
28 | 28 | | SECTION 3. Article 42A.753(b), Code of Criminal Procedure, |
---|
29 | 29 | | is repealed. |
---|
30 | 30 | | SECTION 4. The change in law made by this Act applies only |
---|
31 | 31 | | to an offense committed on or after the effective date of this Act. |
---|
32 | 32 | | An offense committed before the effective date of this Act is |
---|
33 | 33 | | governed by the law in effect on the date the offense was committed, |
---|
34 | 34 | | and the former law is continued in effect for that purpose. For |
---|
35 | 35 | | purposes of this section, an offense was committed before the |
---|
36 | 36 | | effective date of this Act if any element of the offense occurred |
---|
37 | 37 | | before that date. |
---|
38 | 38 | | SECTION 5. This Act takes effect September 1, 2023. |
