A BILL TO BE ENTITLED
AN ACT
relating to the composition of a county election board.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 51.002, Election Code, is amended by
amending Subsection (b) and adding Subsection (b-1) to read as
follows:
(b) For the general election for state and county officers
and for a special election for an officer regularly elected at the
general election, the county election board consists of the
following members:
(1) the county judge;
(2) the[,] county clerk;
(3) the[,] voter registrar;
(4) the[,] sheriff;
(5) the[, and] county chair of each political party
required to nominate candidates by primary election; and
(6) as a nonvoting member, the county elections
administrator, if applicable.
(b-1) For an election other than an election described by
Subsection (b) [other elections], the board consists of the
following members:
(1) the county judge;
(2) the[,] county clerk;
(3) the[,] voter registrar;
(4) the[, and] sheriff; and
(5) as a nonvoting member, the county elections
administrator, if applicable.
SECTION 2. This Act takes effect September 1, 2023.
