| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 281.056(b-1), Health and Safety Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b-1) The county attorney, district attorney, or criminal |
|---|
| 13 | 13 | | district attorney, as appropriate, with the duty to represent the |
|---|
| 14 | 14 | | county in civil matters shall, in all legal matters, represent a |
|---|
| 15 | 15 | | district located in: |
|---|
| 16 | 16 | | (1) a county with a population of 800,000 or more that |
|---|
| 17 | 17 | | borders the United Mexican States; or |
|---|
| 18 | 18 | | (2) a county with a population of 3.4 million or more[; |
|---|
| 19 | 19 | | or |
|---|
| 20 | 20 | | [(3) a county with a population of more than 800,000 |
|---|
| 21 | 21 | | that was not included in the boundaries of a hospital district |
|---|
| 22 | 22 | | before September 1, 2003]. |

| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
